Homeland Security decertifies Arizona sheriff for immigration enforcement
posted at 1:36 pm on October 7, 2009 by Ed Morrissey
Say, isn’t the primary mission of the Department of Homeland Security to, er, secure the homeland? Someone needs to remind Janet Napolitano of that mission, which includes enforcing immigration laws, after her agency decertified Maricopa County Sheriff Joe Arpaio and his deputies for acting as ICE agents in that specific mission. Arpaio’s sin? He apparently had too much enthusiasm for the job (via USA Today blog On Deadline):
The U.S. Department of Homeland Security has stripped Maricopa County Sheriff Joe Arpaio of his authority to arrest suspected illegal immigrants based solely on their immigration status.
But Arpaio said Tuesday he plans to continue his controversial “crime suppression operations,” despite DHS’s decision to not renew an agreement that would allow the sheriff to continue immigration enforcement on the streets. …
Arpaio said he believes DHS made the changes to stop his “crime suppression operations,” which are saturation patrols in designated areas where deputies would find illegal immigrants by stopping them for traffic infractions and minor violations.
The Department of Justice and other federal agencies are investigating the sheriff’s office on accusations of racial profiling during the crime suppression operations.
In a Pulitzer Prize-winning series published in July 2008, the Tribune found the sheriff’s office’s illegal-immigration sweeps violated federal regulations intended to prevent racial profiling. The five-part series also found that the sweeps diverted resources from core law-enforcement functions, which in some cases caused response times to increase.
The Tribune’s point about resource allocation within the sheriff’s department is well taken — and completely irrelevant. The DHS does not have the authority to dictate resource allocation of county sheriffs anywhere. The people of Maricopa County make the determination of whether their sheriff has allocated resources to their liking, not the federal government. Arpaio stands for election every four years, and so far no challenger has come within 10 points of Arpaio. If Maricopa County residents are unhappy with Arpaio’s management of resources, they’re not demonstrating it.
If the Maricopa County Sheriff Department violated civil-rights rules, then the Department of Justice has the duty to investigate and to take corrective action. So far, though, no one has proven anything of the sort — and that still wouldn’t be the jurisdiction of DHS. Instead of working with Arpaio, whose publicity-seeking manner admittedly makes cooperation somewhat more unlikely on the issue of methods, the DHS instead cut off Maricopa County from assisting DHS from enforcing immigration law, which tends to give an indication of the priority of such enforcement in this administration.
Update: I got an e-mail questioning whether the front-page pic was Arpaio. Just in case, I’ve substituted another.

Only insane, or corrupt liberals would revoke authority of law enforcement to enforce laws. They can’t win the amnesty argument so they’ll stop all enforcement. That way, ACORN can sign up millions of new voters for the liberals. ID? They don’t need no stinkin ID!
“I live in Maricopa County and Jay-No left this state in such a screwed up mess, it’s disgusting. Sheriff Joe & her have been going at it for years on this. I’m with Joe on this one. I “hope” he shoves it up her arsenal.”
Rotorjoe, spread the word…there’s consequences to electing liberals. Here in Orlando, the RNC rushed out and endorsed Charlie Crist who is a bigger RINO than Graham and McCain put together. There’s a conservative movement to elect Marco Rubio (a real conservative) to replace Martinez who was also in the McCain/Grahamnesty mold. Hopefully, we’ll be successful and hopefully Arizona will elect conservatives to replace your liberals and RINOs. Otherwise, we’re all screwed.

Why is anyone surprised? The same thing would’ve happened under Bush and everyone knows it. It is politically antithetical to the current leftward trend in American politics to in any way, shape, or form uphold our immigration laws.
Bush started it and Obama will finish it. Borders were open then, they are open now. No change.

You ever visit the nether regions of the border states?
Ever witness the human trafficking, drug trafficking, general lawlessness of those areas?
Ever talk with people who LIVE in those lawless areas, hear their fear about their own SAFETY?
It’s a war zone down there in some areas.
American citizens should be protected from these border incursions by illegals.
I’m thinking you never had to really ever worry about your safety when it came to illegal aliens.
And I knew someone would get around to blaming Bush.

There is a simple way around this. Have the county, city, or state pass a law or ordinance that makes it illegal to be on the streets if you are an illegal alien.
That way Sheriff Joe can enforce a LOCAL law rather than a Federal one.

I have to wonder whether this means anything. Presumably Arizona, or even Maricopa County, has some kind of illegal immigration law on their own books. Does this matter on any level other than a pathetic political move by DHS?
Also, as far as I know, local law enforcement have discretion whether or not to allocate resources to enforcing federal law.
Ed’s right. It is up to the people of Maricopa County, and their elected Sheriff to determine their level of involvement with such activities.
Janet Napolitano is an odious person, is what I’m trying to say here.

I’m all in favor of immigration. But that doesn’t mean that everyone should be let in.
Illiterate Mexican peasants do not have any right to come here. Period. And it does not benefit the United States to allow illiterate Mexican peasants into this country by the millions when there are plenty of illiterate American welfare wards who are unemployed.
We should always be open to anyone and everyone to come here if they can contribute to America, and want to be come Americans. This includes people with skills and/or education. Not berry pickers and janitors.
The problem is that BOTH major parties have a vested interest in illegal immigration, because the Democrats see them as wards of the state who’s votes they can buy, and both parties get contributions from the corporations who victimize American workers by avoiding fair market value of labor by employing illegals. Which in my mind is a TREASONOUS act.

He was elected by the peole that live there, and since he seems to stay in office, I’d guess he is probably doing what those people want him to do. Stalin did the same thing, according to A. Solzhenitzen in Gulag Archipelago.
If someone lagged to keep the ‘revolution’ alive, he was thrown in jail for not being behind it enough.
If someone did only what was expected, he went to jail for the same reason.
But if he worked hard to advance the revolution with all he had, he was secretly a traitor in Stalin’s eyes, because that kind of enthusiasm made him suspect for trying to make the leadership look bad so as to usurp political power for himself.
Funny that DHS thinks it can ‘decertify’ a duly-elected officer of the law who isn’t part of DHS.

Arizona Has Big Decline in Auto Theft
October 7, 2009
Thefts of cars and trucks in the Phoenix area are down 33 percent over last few years according to law enforcement and insurance industry experts.
Roughly 55,300 cars, trucks and motorcycles were stolen in 2004, compared with 37,200 last year.
Officials site several reasons for fewer car thefts including new police technology, such as automatic license-plate readers, “bait” cars, and better security features in new cars.
A report in the Arizona Republic noted that police in Glendale transformed it auto-theft detective squad from a unit of uniformed officers into a high-tech unit with plainclothes and undercover officers.
The chief of the Maricopa County Attorney’s Office Auto Theft Bureau Bill Montgomery said the drop can also be linked to the increased presence of federal law enforcement along the Arizona-Mexico border.
Montgomery said smugglers are stealing fewer cars because it’s harder to get over the border.
Napolitano wants more auto thefts.

We need to close the border … protecting the border is one of the few things that is in the legitimate domain of government. We need to make it easy to immigrate, and easy to be deported. Want to work here: Welcome. Want to go on welfare , or steal from us? Permanent deportation … and place any “anchor” children in foster care.

Yes, but it really does not mean all that much. The ICE certification was only a legal manuver that DHS used to allow local LE to act as sort of ICE deputies in while they were doing their normal LE work. DHS got more out of it than the Sheriff’s Dep.t did, as it gave them a large pool of manpower they didn’t have to pay for. Decertifying them only means that A: The local LE officers no longer have to concern themselves with ICE missions or goals, and B: ICE will have to bring in more federal manpower to cover any needs they have. I’d also expect that the few ICE agents that are there might get to feeling really, really lonely the next time they get into a situation where they need the Sheriff’s Dept. to cover their As*.
