Swiss to Polanski: You’re not going anywhere

Roman Polanski lost a bid today to get released on bail pending adjudication of an extradition to the US to face charges of … bail jumping. Apparently, that irony was not lost on Switzerland, which deemed him a flight risk and refused to consider alternate means of securing him before the extradition process. That means Polanski will spend at least the next several weeks in jail:
Roman Polanski lost his first bid to win his freedom Tuesday as the Swiss Justice Ministry rejected an appeal by the director to be immediately released from prison, an official said.
“We continue to be of the opinion that there is a high risk of flight,” said ministry spokesman Folco Galli, explaining the decision.
Galli told The Associated Press that the risk was too great for the government to accept bail or other security measures in exchange for the release of the filmmaker who is wanted by U.S. authorities for having sex in 1977 with a 13-year-old girl.
The extradition process could take months, the Associated Press reports. That’s another irony in itself, as Polanski likely faced no more than six additional weeks in prison when he skipped in 1977. The judge in the case had already informed Polanski that he didn’t have to abide by the sentencing recommendation of the prosecution in the plea deal, which Polanski acknowledged in court, but at most the judge would have forced Polanski to serve out the entire 90-day psychological observation period rather than the 42 days served.
International outrage by cultural elites in the US and France have done nothing to dissuade the Swiss from proceeding with the extradition process, either. Critics of the arrest have backed down from accusations of illegality on the part of Swiss authorities, and it appears that the extradition treaty with the US makes it likely that they will hand Polanski to the US at the end of the process.
At this point, Polanski might do better to waive an extradition fight and get to the US as quickly as possible. Spending months in a Swiss prison just to serve another several months in the US is a questionable strategy for a 76-year-old fugitive. He’d be more likely to get lenient treatment, and if nothing else would save himself a few months in jail.

Not to mention that a broad swath of American leftists would hold marches, sit ins and teary-eyed gatherings in Polanski’s honor if he were here in the U.S.

Child molesters don’t generally do well in prison…especially high profile child molesters.
He’d be better off putting his energy in avoiding general population and influencing where he’s to be incarcerated than fighting extradition.

You must have missed it.
He was doing to Switzerland for an award. He usually makes trips like this without announcing it, so paperwork can’t be drawn up in time.
This time, he announced it ahead of time, which gave the authorities time to draw up the paperwork. And they did.

There was a documentary made where a lawyer said he had an unethical conversation with a judge. Polanski tried to get the charges dismissed based on that, then the lawyer recanted that, and it just wound up putting people in place where no one could back down.

Who knows? Maybe the Swiss banks needed to cut some kind of deal in order to limit they’re newly required transparency and so they arranged this little capture as one of many favors?

pedestrian got it right. Based on false information by a former LA district attorney that went into that “Wanted and Desired” movie, Polanski’s attorney became overly aggresive in filing for dismissals thus causing the LA DA’s office to investigate. They found out their former collegue misled the movie’s director but still had to resolve the filing response and deadlines that were created by the barking dogs. Delicious irony…the guy that lied about the judge had given up on seeing justice served and saw no downside to playing along for the movies sake. He was assured the movie would not be released over here too.
Between the movie producer and that guy they accidentantly set in motion the events that led to his arrest. He who laughs last laughs loudest or something.

Polanski abrogated the terms of his agreement when he fled the country, as far as I’m concerned. When he’s finally dragged back to America kicking and screaming, he should be charged with “rape-rape“, and face maximum sentencing. There should also be a ‘truth in sentencing’ clause brought up, just to let others like him know that there will be a zero tolerance policy for his kind of crap.
Put Polanski UNDER the prison.

Good for the Swiss.
Polanski could get a couple more months for jumping bail, but one would have to look at the laws in place in 1978 CA. Also, any sentencing judge would probably credit Polanski for the time served in the Swiss jail.
Now I do not think Polanski has US citizenship, and I’m not an immigration lawyer, but I think a statutory rape conviction would permanently bar him from entering the US, except for servind his sentence. At least I hope so. And if not, the law needs to be changed. We have enough creeps here already.

I hope he fights it for years and years and years. And then when he comes to the US he fights it for years and years and years. And when he is sentanced he gets the 90 days observation as the original deal was and then 10 years for evading prosecution, dying in prison at the age of 89.
