Congress blocking Gitmo-closing funds in 2010

Regardless of whether Barack Obama thinks he can make his self-imposed deadline for closing the detention facility at Guantanamo Bay, Congress has no intention of helping him do it.  Republicans and Democrats have combined in both chambers of Congress to deny funding in 2010 for any effort to close Gitmo and transfer its detainees to the US.  Almost 90 Democrats in the House defied their party leadership to support a ban on the funds:

Lawmakers are using their authority to direct federal spending to prevent the Obama administration from closing the prison at Guantanamo Bay.

In their race to complete a dozen appropriations bills for the fiscal year that began this week, members of both chambers are including policy language aimed at halting the administration’s decision to transfer prisoners from the Cuban facility to prisons in their districts.

The latest example came on Thursday when the House instructed conferees negotiating with the Senate on a final version of the Homeland Security spending bill to include language prohibiting the transfer of Guantanamo detainees to U.S. soil. The bill already includes a provision prohibiting the detainees from air travel within or to the United States.

They’re not being subtle about it, either, or leaving it to chance.  The Hill reports that the House has passed four appropriations bills with language denying funds for the purpose of closing Gitmo.  The Senate seems just as adamant about it, too.  They have already inserted the language into the Defense appropriation, which is still under consideration.

Rep. David Obey called Congress an “unjointed turkey” on the question for failing to come up with its own plan to close Gitmo.  He apparently labors under the delusion that a grand consensus exists to close the one facility built for the express purpose of housing unlawful combatants captured in the war on terror.  Rasmussen’s last polling on this question showed that 55% of likely voters oppose closing Gitmo, while only 32% support the idea.  Three-quarters believe that the process will free dangerous terrorists, with 56% “very concerned” about that prospect.  Only 56% of Democrats support the closure of Gitmo, hardly a mandate, while 62% of independents oppose it.   There isn’t an age or income demographic that supports Obama’s policy.

Can Obama close Gitmo with these funding restrictions?  He’s not likely to stop trying, but Congress is doing all it can to block him.

Well this gives Obama an out. He can blame Congress(specifically the GOP of course) for preventing him from keeping his campaign promise.

In the end though, he’s still accomplished jack and squat.

After the obvious snub by the IOC at the mystique of Obamaland, isn’t it time to shelf the “well, keeping this place open is not doing us any favors on the world-opinion stage” argument? And without that, there really is no rationale for closing the most secure place for dealing with these types of criminals.

Not only is moving Gitmo detainees to one’s own State a political suicide-pill, so too is moving them to anywhere in the mainland US, from where they might escape, or proselytize among the current prison population. Capitol Hill knows what the White House refuses to acknowledge – the ones up for reelection next November don’t want any more “incumbecitis” than what’s already built up.

Those are the best. I grew up in MD but live in DE now. I still cross the line to get to the nearest High’s to pick some up once in awhile (they are the only ones that sell them around here). They came out with cake recently, it’s pretty good (the cookies are still better).

Happy to hear this news. A measure of sanity still prevails in Congress.

I don’t know how much ammo a guard at a US prison has on hand ( I have never needed to know) but I don’t think it is enough to withstand an assault by determined US based terrorists cell combined with riots inside the prison by the detainees and their supporters.

I really don’t want to read about terrorists using/abusing our court system to inflict damage on the US.

I don’t want our schools/theatres/hospitals etc taken over by terrorists and demands for release of detainees from US prisons to ever happen. Perhaps I am wrong but is seems like AQ and the Taliban know it is the US military holding the detainees. If they move the detainees to American soil, that thinking will shift and it will be US citizens imprisoning their comrades. Whole new can of ugly worms opens up then.

Once any Gitmo detainee arrives on US soil…it gets really complicated, and fast. Once on US soil, they have to be granted full protections of our judicial system, hence they might be brought to trial, but, this is where it gets messy, any evidence against any of them will be summarily tossed out since the custody of evidence required for a proper trial is lacking…they were captured in a battlefield environment, they may have been coerced, and none of them were “Mirandized.” So, once on US soil, they will either be released, or worse [from a Constitutional point of view] held without charges awaiting not a trial, but some sort of bastardized process that flaunts the Constitution. The idea of persons kept in US prisons with no possibility of fair trial is an attack on our Constitution, hence, the most salient reason Gitmo was chosen in the first place for captees rounded up outside US judicial jurisdiction, and still in compliance with Geneva.

Boumediene v. Bush broke the long-held US Supreme Court 1950 ruling on Johnson v. Eisentrager by affording detainees habeus corpus protections in violation of Geneva and established precedent…all done as part of a “blame Bush” apparently popular atmosphere when Boumediene v. Bush was addressed by the USSC at the time.

War or law enforcement? The edges of that distinction have already been well-frayed by those who still view terrorism on the scale of AQ as some sort of simple law enforcement problem. Why send the US military to Afghanistan and other locales? Why not just send the FBI to do it all since there are still those in this Adminstration who view terrorism of the AQ kind as a mere law enforcement matter?

Yes, there is concern about having blood-thirsty terrorists brought to a neighborhood near you, but the larger matter is that most still ignore the obvious peril to all of us under the US judicial system should any of these Gitmo detainees be brought to the US…and our own Constitution suffer because of it.

Nope. getalife is busy supervising the daycare center that was opened for the Liberal adults that were in charge. They are being reprogrammed to take charge of the Gitmo inmates when they are moved. They will be relocated to a warehouse San Fran Nan has picked out for them on Fisherman’s Wharf.

I had a similar idea….sedate each detainee and implant a GDS tracking device; release them expecting they’ll return to their Al Queda brethern; wait 10 months; then, on 9/11/10 send guided missles to each and every GDS device.

Congress created this mess when they began directing spending after Nixon attempted to impound spending. Finally the “Chickens come home to roost,” as a well know paster is quoted as saying. Create a problem, live with it. Indicative of the increasing ineffectiveness of this president. Even his own party is ignoring him now. Took, what, all of 9 months?
