Democrats strip ACORN of funding in continuing resolution
posted at 10:20 am on September 26, 2009 by Ed Morrissey
It seems as though Democrats have realized the political danger of their association with ACORN. The Boston Globe reports that Democrats have included in the continuing resolution that will keep government funded in absence of a budget a clause that excludes ACORN from funds in the bill. In fact , it appears to prohibit ACORN from receiving any funds at all from any federal source (via Instapundit):
Abandoned by even many of its Democratic allies, ACORN hit back today at Congress after it slapped the latest penalty on the community advocacy group.
The House voted today to avert a possible government shutdown next week by temporarily extending the current federal budget. But Democrats inserted a provision saying that ACORN could not receive funding under the stopgap measure or any prior legislation.
Needless to say, this did not make Bertha Lewis, ACORN’s CEO, terribly pleased. Lewis and Rep. Jerrold Nadler (D-NY) continued to insist that the language amounted to a bill of attainder and is unconstitutional. This is nonsense, of course; Congress can choose to give cash to organizations, and can also choose not to give cash to organizations. There is no application of due process, because ACORN is not entitled to taxpayer funding.
Perhaps Lewis realizes that acting like a victim after the series of videos showing ACORN employees assisting child-prostitution trafficking and tax evasion won’t be a big seller. In her statement, she asks that a few betes noirs of the Left get the ACORN treatment from Congress, including the Big Kahuna of fringe-nutcase conspiracists, Halliburtion:
“One unintended – and positive – consequence of the witch hunt against ACORN is that it could help rein in the likes of Halliburton and Blackwater and even Wall St,” she said in the statement. “If the standard is that organizations that have broken the law shouldn’t get federal money, then let’s set that standard consistently. There are numerous corporations that have been proven records of malfeasance. For its part – and although we don’t claim perfection in our work for poor and working families – ACORN has never been convicted of any crime in a court of law – the conservative imagination and the media are another matter.”
Well, the difference is that (a) Halliburton wins 87% of its contracts through competitive bidding for projects authorized by Congress, (b) ACORN got its federal funding through non-competitive grants processes, and (c) conservatives didn’t want Congress bailing out Wall Street in the first place. Other than that, Lewis is right on point. When teenagers use the “everyone else does it” defense, it usually works, right?
The most interesting part is that the Democrats threw ACORN under the bus again after two weeks of horrendous publicity, and without too much specific pushing on this bill for that action from the GOP. There is no chance that Republicans can stop the continuing resolution, nor do they necessarily want to do so, which means this will become law, at least for a while. Two young adults with good camera technology and a bad wardrobe have dismantled the federal trough to ACORN, and that is really amazing.

That’s the real story for me. Truth to power.
I’m confident that the democrats will find a sneaky way to get money back to these sex slave traffickers.

and (d) companies that get government contracts actually provide something in return. Handing out tax dollars to a group that merely distributes it among the poor is not comparable to paying for a bridge, road, or software.

I thought an ACORN office (Seattle) had to fire about 12 employees and enter into a consent decree over some voter-registration charges. Forgive me if she wants to quibble over whether it’s the national organization or one of its chapters. These aren’t isolated instances.
BuckeyeSam on September 26, 2009 at 11:42 AM
The reason they can claim nonprofit status is they use up all the income in administrative salaries and fundraising activities. Alan Keyes is skilled at this.

1. What bill(s) is this found in?
2. Have they passed?
chemman on September 26, 2009 at 12:00 PM
Nonsense, I would argue that they should be taping every single meeting unless the taxpayer recieving advice from their organization doesnt want it being done and those tapes sent to be reviewed for violations of their funding.
A tax payer funded organization has zero expectation of privacy in a public office environment. The client may, but the organization does not.

I’m not so sure that I understand the analogy between the feds relationship with Halliburton and Blackwater (private enterprises) and the feds relationship with ACORN. The private enterprises enter into contracts with the feds to provide goods and services; if the feds don’t like their performance, they don’t renew or, presumably, they have an out under the contracts. I haven’t seen the story lately, but what has Obama down about the contract with the firm hired to provide security in Afghanistan?
With ACORN, a tax-exempt entity (though not necessarily a 501(c)(3), though some of its tentacles are), it’s supposed to be providing something for the common good–VITA participation, voter registration, who knows what (part of the problem itself). ACORN has clearly failed. So terminate its funding. Not surprisingly, ACORN’s response is typical of welfare mentality–an “entitlement” has been created and consistently funded so to eliminate it is supposedly unconstitutional. Horsehockey.
If nothing else, ACORN highlights the need for taxpayers to begin demanding that Congress end the miscellaneous funding of tangential, non-profit organizations over which they exercise no control. Let these organizations go hat in hand to donors in their communities. Those donors, who will be affected by the performance of the organizations, are in a better position to watchdog them and to decide whether they have merit or not. Why should we finance federal employees to review grant applications and to make recommendations about funding when they have no responsibility for oversight?
And if it means an end to that faith-based initiative started by Bush–great. I’m a Christian (certainly no model of one), but I think it’s ridiculous for “faith-based” organizations to be lining up with their hands out for federal tax dollars. That kind of conduct doesn’t sound as if it involves a whole lot of faith. Instead, it sounds a lot like ACORN–what do you have to do to game the system successfully.

Bertha Lewis, capo di tutti capi of the ACORN mob, must feel like Al Capone when they charged him with “tax evasion”.
De Niro in “The Untouchables”:
“Now, I have done nothing to harm these people but they are angered with me, so what do they do, doctor up some income tax, for which they have no case. To speak to me like men, no, to harass a peaceful man. I pray to god if I ever had a grievance I’d have a little more self respect.”
Sorry, Bertha, we know you’ve done FAR WORSE than just traffic in little girls…but hey, it’s what we caught you at!

It never fails. Every year Congress has to keep the government from shutting down by instituting what is known as the Continual Resolution Authority Process, otherwise known as CRAP. The term is appropriate for an august body that serves the American people with nothing but CRAP.

CNN leads the pack with investigative reports:
“Today, GOP leaders in both houses of Congress submitted legislation to prohibit any federal funds being made available to a non-profit group dedicated to the nation-wide distribution of acorns.
This reporter was unable to grasp why the GOP is attempting to place limits on trees. Many attempts were made via Google search, but no relevant quotes or stories by other news agency’s were found.”

Game over. Acorn is in a death spiral from which it is impossible to recover. Federal money is being cut off, and private money is drying up (who’d want to throw more money into an obviously lost cause which is only likely to embarrass the donor?). Tax liens are being applied.
Meanwhile more and more state and federal investigations are underway, and lawsuits are in the pipeline. Acorn has no way to pay for the enormous legal expenses these will entail. Employees are either being laid off or are jumping ship, and some of them will decide to try to gain a bit of fame and money by telling all they know.
Nor can Acorn simply reconstitute itself under other names. There’s enough attention being focused on Acorn that any such off-shoots will be investigated and exposed. Not enough people will dare get involved in those off-shoots.
The funny thing is that we still haven’t seen the next wave of videos from Giles and O’Keefe. My guess is that those videos were originally scheduled to come out a week ago. But the current wave of publicity, which is finally echoing in the mainstream media, hasn’t yet subsided; in some ways it’s still building. So Breitbart is continuing to delay the videos so as to not step on the current news. When things finally slow down, he’ll dump a new batch to keep the pressure on.

I just hope Giles and O’Keefe are training their replacements. They can’t do it again, because they’re known now, but we need MORE of this, not LESS.
The government and MSM will ignore leftist malfeasance until the evidence is OVERWHELMING, so the only thing we can do is overwhelm them.
If we have to spend all our efforts exposing leftist corruption, we may not actually progress much, but maybe we can stop the slide down into destruction.

RE the post, I love Bertha’s semantics tap dance about ACORN not being convicted in court of any crime. She doesn’t talk about the employees of ACORN, working for ACORN, who were convicted on 500 counts of voter fraud. So yeah, ACORN wasn’t convicted, just the people who work for and carry out the missions of ACORN.
