Will Baltimore prosecute other journalists, too?

Before we answer that question, we first have to know the person making the decisions about prosecutions in Maryland. Who exactly is Patricia Jessamy, the Baltimore City State’s Attorney whose office threatened to prosecute the undercover reporters that exposed ACORN’s pimp-protecting and tax-evasion operation? Chris at HAP does a lot of legwork on Jessamy — and finds a partisan Democrat who has invested both time and money in supporting Barack Obama:

Chris also has links to Jessamy’s personal contribution to Obama’s campaign, as well as her position on a steering committee for his campaign. Jessamy isn’t exactly an uninterested party when it comes to Obama and those organizations that support him. That explains the odd decision by the prosecutor to consider charges against the people who uncovered a conspiracy to evade taxes and shield pimps, rather than the conspirators themselves.

But what else has Jessamy done while in office? Mark Tapscott points out that Jessamy likes to highlight her connection to a local children’s shelter:

Jessamy, a Democrat, was appointed to the State’s Prosecutor position in 1995 and has since been re-elected to the job three times. Among the items listed on Jessamy’s extensive resume of accomplishments is that she is president of the Baltimore Child Abuse Center. She also lists her prior membership on the Governor’s Council on Child Abuse and Neglect from 1995 to 1998!

Let’s be clear about what is happening here: O’Keefe and Giles dressed up as a pimp and prostitute and walked into the Baltimore ACORN office seeking “tax advice” for a brothel that would include the use of 13-year-old sex slaves from San Salvador. Two ACORN advisors happily provided all kinds of advice about how to deceive federal and state tax authorities about the true nature of the “business,” and how to insure that the prostitutes “keep their mouths shut.”

In other words, two ACORN employees appear to have voluntarily become accessories to multiple federal, state and local crimes, including child abuse, interstate transportation for purposes of prostitution, tax evasion, and immigration law violations. The two ACORN employees may also have thus provided hard evidence that their employer should be prosecuted as a criminal enterprise under the RICO statutes.

And the Baltimore City State’s Attorney may prosecute the two people responsible for exposing this heinous operation!

On one hand, Jessamy brags about helping children who are abused or neglected. On the other hand, when she discovers evidence that the local ACORN office helps abusers evade detection and protect their child-prostitution rings, she aims her prosecutorial guns at — the people who expose them. Does that help children or hurt them?

Let’s get back to the original question about Jessamy’s roundup of undercover journalists. Jessamy has been in office since 1995. Has she ever pursued this kind of prosecution of undercover journalists in Baltimore before going after the people who went after ACORN? Hot Air reader Carrie W notes at least two times when a local Baltimore TV station used undercover journalists with cameras to record people without their knowledge, and won awards for their efforts. Did Jessamy go after WMAR in 2000?

Baltimore’s Beggars

Anchor Stan Stovall went “undercover” as a vagrant to experience what life is like for Baltimore’s beggars. For two days, Stovall wore a disguise–donning makeup and a scraggly beard–and roamed the popular tourist areas of Charm City. “I had to admit I had some reservations about getting made up as a homeless person,” Stovall says. “I could tell you how people would treat me without getting [a disguise.]” But he did it anyway, panhandling during the day and returning to the station for the nightly newscast. “It was one of the ideas that was submitted to look at the issue of panhandling–of whether those people were really homeless and needed the money,” says WMAR News Director Sandra McKeller. “We decided to do it for [the May sweeps] and add a twist by adding our anchor dressed up and actually get the perspective of being a panhandler.” McKeller said the piece tried to examine the plight of homelessness. The burning question Stovall wanted to answer: Should you give panhandlers money? “Some of the research I found in talking with homeless advocates…and even homeless people themselves was you should not give them cash,” he says.

Now, this description doesn’t make clear that WMAR had a hidden camera and mike on Stovall, but that’s certainly the implication. Would a local TV station go to that much trouble and not get the interactions on camera? If that isn’t quite clear enough, though, WMAR’s award-winning effort in 2006 is explicit:

Judges’ Comments: This is just darn good journalism. We didn’t hear enough about the conversation your producer had in the hidden camera part of the story. We loved the MySpace connection & the thoughtfulness of the other people involved in a past scheme. Excellent.

Hidden cameras? Darn good journalism … for WMAR, and apparently not anything in which Jessamy was interested. In 2009, when those hidden cameras go after a group supporting Barack Obama and his policies — well, that’s a different matter altogether. It shows that Jessamy is less interested in enforcing the law and helping children than she is in abusing her power to attack critics who threaten Obama’s power and policies.

How about it, Baltimore? Time for Jessamy to retire, and to find a City State’s Attorney who goes after criminals rather than the people who expose them? And will Maryland journalists take a stand on behalf of Hannah Giles and James O’Keefe?

I don’t think that prosecutorial discretion is the real issue here. In my view, prosecutorial discretion should only be used to make an exception to enforcing a law. I think the discussion should be about whether the law in question should be amended or even repealed.

Otherwise, Loretta King has no background, no Wikipedia entry. She keeps the internet swept clean of any reference beyond her cases, and even there, of anything she finds undesirable.

That’s our federal tax dollars at work, sanitizing the internet of any biography on ACTING ASSISTANT ATTORNEY GENERALS.

How long or what else does it take on her part, btw, to get past “acting” the DOJ position?

This is indeed the moment of the Citizen Journalist.

As more and more hidden cameras and hidden microphones are seen being used to expose the corruption of the Left and their various sub-organizations, fully expect Leftist Legislators at the Local, State, and Federal level to push for sweeping ‘reform’ BANNING the use of hidden cameras by ordinary citizen journalists (non-law enforcement personnel) to record people without their prior expressed written permission.

This way, what happens in such Leftist organizations around the country (and there are plenty of them) will remain undetected and continue to operate without fear of exposure.

Then, the Left can continue to fund such organizations with billions of tax dollars while claiming they are merely helping honest grassroots efforts which assist poor people.

Did you know that the KKK was formed in 1866 by the Democrats to lynch and terrorize Republicans, black and white. To combat the terrorizim the Republicans passed the Civil Rights act of 1866 and the Reconciliation Act of 1867 that would create a fairer system for blacks in the south.

The 14th Amendment was pushed by Republicans to grant blacks citizenship.

C’mon, anybody can see why Jessamy wants to prosecute O’Keefe and Giles. They’re the real public danger here — not those prostitution/child abuse/tax fraud-enabling thugs at ACORN. Jessamy needs to get these criminals O’Keefe and Giles off the streets before they do even more damage. There’s no telling what type of corruption they might expose next. Why, if Jessamy doesn’t stop them now, they might show up someday in the State Attorney’s office in Baltimore with hidden cameras, and just think where that might lead . . . .

For clarification:

I find the setup in this smaller states confusing. There is a Baltimore County State Attorney and a Baltimore City State Attorney. However, Baltimore City is in Baltimore County but considered independent. Seems like a waste of money and resources not to have both offices combined.

As despicable as their behavior was, I don’t see where the acorn staff in the tape committed a crime. There were no teenage prostitutes smuggled into the country. If I said I had murdered someone and the body is in my basement and asked you to help me move it and you agreed, I doubt it would be a crime because I didn’t murder anyone and stuff the body in my basement.

Of course, the head of these offices are big time democrats. It’s a political job. Disgusting but true.

Some of you are complaining that the media is ignoring this story. However, in some major papers you would have to dig deep to find a mention of what occurred on 9/11. Well of course that is the real problem with our country at the moment. Those agencies refuse to report or highlight anything that would be deemed a negative towards The One, Pelosi, Reid and the liberal establishment.

Unfortunately they hold the key to public opinion, public opinion forces politicians to change course.

Don’t count of the MSM to change any time soon, after all they are the ones who elected Obama, Pelosi, Reid and the current liberal set.

Fox is the only agency upholding journalistic integrity. Imagine how much lower we would fall without them.

And Acorn has a strong supporter in Rep. Elijah Cummings (member of the Progressive Caucus) who Jessamy, for some really odd reason felt the need to contribute $500, in January 2009. Cummings is in one of the safest seats in Congress, and had $650k cash on hand as of 12/31/08.

Yesterday, the Census Bureau dump them, but I’m surprised that the IRS hasn’t dump them yet, considering they were counseling tax fraud while at the same time providing tax preparation services, underwritten by the IRS’ VITA program.

The Democrats Are Already Winning the 2010 Elections — Which Is What Happens When the Justice Department Is REALLY Politicized [Andy McCarthy]

Never a dull moment with the Justice Department of Eric Holder, aka “the right man at the right time to protect our citizens in the critical years ahead.”

Georgia is required to seek DOJ approval before implementing voting protocols because of the Voting Rights Act of 1965 [link above] (see George Will here and Roger Clegg here). Quite apart from the fact that the VRA is an anachronism in modern America, is there not something perverse about canceling out the votes of eligible citizens — the inevitable result of permitting ineligible citizens and non-citizens to vote, as DOJ is effectively forcing Georgia to do here — under the auspices of something called the “Voting Rights Act”?

Handel’s letter demonstrates the absurdity of the claims by DOJ’s Civil Rights Division of undue burdens simple verification — i.e., the process airport security personnel put you through if you want to get on an airplane and Amtrak randomly puts you through to get on a train — imposes on minority voters:

It is important to underscore that not a single person has come forward to say he or she could not vote because of the verification process. Further, while DOJ argues that the process is somehow discriminatory, the historic voter turnout among Hispanic and African-American voters in the 2008 general elections clearly says otherwise.

This outrage does not happen in a vacuum. It comes on the heels of the Civil Rights Division’s astounding dismissal of the slam-dunk voter intimidation case against members of the New Black Panther Party in Philadelphia (a case in which the Justice Department surrendered after it had already won), and Justice’s blatant undermining of a federal law that commands states to purge their voter registration lists of ineligible voters (e.g., citizens who have died or moved out of state) in order to minimize opportunities for fraud. (See Hans von Spakovsky’s incisive work on these issues, here and here). At the same time the Justice Department is busy preserving the infrastructure of fraud, congressional Democrats are filling the overflowing coffers of the notorious voter-fraud practitioners at ACORN — longtime allies of President Obama.

No need to wait another 18 months: We are losing the 2010 election right now.

On this record, note well the eventual effect from self-righteous kneejerk inspired legislation. The infinitely punitive, anti-civil-rights levy against an entire state, NEVER EXONERATED though honor for Georgian integrity is long past due.

To merely kick an ACORN from one locale only moves it, spreading its wealth to another locale. While combating to destroy the utterly corrupt ACORN organization, here’s a cause worth achieving: Rescind VRA of 1965. Target the legalized root of the ACORN. Otherwise, moto perpetuo, ACORN has a legalized laboratory STATE in which to grow anti-Constitutional authoritarian radicalism, unencumbered.

We are seeing the downward spiral of the MSM happening at a very fast clip. Jones is gone, Sargant reassigned at the NEA, Census Bureau has cut ties with ACORN. All of these things happened without a word from the MSM. Frankly, if I were a lib, I would start looking for other sources for my news. I wouldn’t much care for being in the dark, even if it is news I don’t want to hear.

Wow, just wow.

I was at a town hall meeting with Congressman Vern Buchanan last night. He packed our local Van Wezel Opera House to the rafters with a raucous but friendly crowd, over 1700 people, almost all friendly to him.

But when ACORN came up, people went nuts (no pun intended). They don’t want another nickel going to this insanely corrupt “community organization”.

Go ahead, prosecute them, and watch the overwhelming support for them come out to throw Jessamy out of office.

It certainly looks like any investigative news organization which has a hidden camera or audio recorder is in violation of this law, unless they’ve obtained help from law enforcement.

This is quite an interesting law. I’m wondering what crime not listed under (2)(ii)(1) is being protected?

One other aspect of all this, I’m not certain if someone else mentioned it as I haven’t read all through the thousands of comments.

On the Baltimore tape, at one point one of the ladies informs the couple that in exchange for all this help they are getting, they would be “required to join ACORN.”

While it could arguably be said that providing advice may not necessarily be illegal and stuff, these two are not only providing advice on how to get away with their sick, disgusting “business,” they would REQUIRE people THEY KNOW ARE COMMITTING SERIOUS FELONIES to actively join their ranks.

If you think about that, that’s almost more disturbing than the rest of it.

This “solid” Republican State of Texas couldn’t even get the bill requiring voter ID to a legislative vote, AGAIN! ACORN is alive and well in Austin and all along the Rio Grande, enabling the violence from murdering marauders from Mexico.

God bless Rick Perry. No one’s perfect, and we all need help to be wise and to do our best. Perry has consistently led the fight to protect our border with Mexico. Perry enabled Texas to create more jobs than the rest of the US, despite Obama’s damned Democrat purge vs. US oil and nuclear energy production. And Perry listens when the people of Texas tell him NO. Ex: Perry doesn’t force an idea to violate any citizen’s civil rights (he nixed the mandatory STD vaccination for puberty females).

Hutchison, you sold yourself, your sold us from D.C., and now you want to enable the citizenship for illegal aliens by dividing Texas while enriching yourself on the hard work that Perry has accomplished. So Kay Bailey Hutchison, if you’re going to retire from the Senate because you’re all worn out and no good for conservatives anymore, then RETIRE.
