Senate to close ObamaCare loophole for illegal immigrants that media claims doesn’t exist

posted at 3:53 pm on September 11, 2009 by Allahpundit

I don’t get it. The modern-day Murrow told us last night that Joe Wilson was wrong, wrong, wrong.

If a man can’t trust Keith Olbermann to tell him the truth, who can he trust?

The controversy over Republican Rep. Joe Wilson’s shouting out “You Lie!” at the President over his claim that illegal immigrants wouldn’t benefit from health-care reform apparently sparked some reconsideration of the relevant language. “We really thought we’d resolved this question of people who are here illegally, but as we reflected on the President’s speech last night we wanted to go back and drill down again,” said Senator Kent Conrad, one of the Democrats in the talks after a meeting Thursday morning. Baucus later that afternoon said the group would put in a proof of citizenship requirement to participate in the new health exchange — a move likely to inflame the left.

Why would the left be inflamed? Putting laws on the books about illegal immigrants and then studiously ignoring them is a longstanding American tradition. Meanwhile, as expected, Wilson’s starting to rake in big dough from his outburst; a flash poll shows him actually trailing Rob Miller by a single point while the national media throws everything they’ve got at him, but expect Miller’s lead to go the way of The One’s bounce in the next few weeks as things calm down.

Pelosi’s going to try to extend the Two Minutes Hate by another minute next week with a floor resolution punishing Wilson for not apologizing profusely enough, I guess. A cynic might see it as an attempt to manufacture Democratic unity while war is waged over the public option behind the scenes; good thing I’m not a cynic. Oh, and on the very day that an unnamed senior White House official is calling Wilson “a pimple on the ass of progress,” former McCain aide Mark McKinnon is promising to donate to Wilson’s opponent because, see, he just can’t stand incivility. Exit question: Have he and Meghan McCain collectively uttered one unkind word about the torrent of “political terrorist”/angry mob rhetoric that’s been pouring from the mouth of the Democratic river this past month? Maybe they have and I’ve just missed it.

Update: Proving once again that Wilson’s entirely right to be suspicious of the left’s plans for illegals under ObamaCare, TPM sounds decidedly miffed that, ahem, “undocumented residents” won’t be allowed to buy health insurance. Fun Orwellian bonus: Aside from directly quoting Kent Conrad, the word “illegal” doesn’t appear in the post.

It is strange when you think about it. If the media had reported on Reverend Wright before Super Tuesday rather than after, Hillary would probably have gotten the nomination..she very nearly pulled it off as it was.

Just think, days after 9/11 while the ruins of the WTC were still smoldering, Barack Obama’s pastor said the chickens have come home to roost. Yep, they certainly have. But not in the way Reverend Wright meant.

I bet Obama was there that Sunday, nodding his head and saying Amen.

Terrye on September 11, 2009 at 5:08 PM

Too bad somebody didn’t stand up and yell “Liar” when Obama lied about abortions not being covered. Steps to amend this have also been rejected by Democrats. This abortion of a bill deep-sixes, obliterates, the long-standing Hyde Amendment. And you can kiss conscience exceptions bye-bye as well.

All these ‘patches’ are actually worse than useless and stupid, though. The whole mess is too littered with the dumbest, most invasive taxes. It needs a do over…it needs to be SCRAPPED.

marybel on September 11, 2009 at 5:12 PM

McKinnon is just one on many RINO strategists like Mike Murphy and Kevin Madden. These guys would be just as happy working for the Dims and are a better ideological fit. They view Sarah Palin, Jim DeMint, Joe Wilson and Michele Bachman as the enemy rather than Obama, Piglosi and Reid.

The best way to get rid ot this pond scum is by “Primarying” RINOs like Bennett, McCain, Crist, Kirk, Murkowski and Isakson to name but a few.

No more RINOs!

I listened to Judge Andrew Napolitano’s analysis of the bill. If the government offers insurance to one group, they are forced to offer to all groups.

Wow.

So Sarah Palin is an idiot, she’s inventing this whole ‘death panel’ thing, and every independent source that has investigated her claim has found she’s crazy…but then the Congressmen agree to take the provision out of the bills and change them.

Now Joe Wilson is a liar, a rude boob………….(but they’ll explicitly say in the bill now you have to prove citizenship).

“Fine tuning” a preposterous, unworkable, with-a-new-huge-tax-guaranteed burden is imbecilic, expecially during a serious recession with 10 % unemployment, widespread housing foreclosures, faltering dollar, and a stagnant economy- all while a growing deficit and already-failing Medicare and Medicaid and Social Security cannot be handled by the present fiscal and governnment whiz kids.

A couple of mornings ago, Judge Napolitano on Fox and Friends explained that the courts will not allow an exclusionary rule. The California law that excluded health benefits to illegal aliens was struck down by two courts and SCOTUS refused to hear the appeal.

There could be a clause that excludes illegals, but the courts will not allow it.

We need a constitutional amendment to define what a citizen is.

daesleeper: This is how they trick people. As already pointed out, they leave out any mechanism of enforcement. They just do not pass any laws for enforcement. Or, they do not fund it. Another politician dirty trick is to say they need money for firemen or police in order to raise taxes. The money goes into one large fund and they all siphon it off for everything but what people voted it for. If they have language that says it will not be used for anything but X, they get around it by having dept X make a loan to depts Y and Z. They then forgive the loan. Yes, they tax you and then they treat it as if it is their own money to loan, give away, etc.

In another closely related matter, Democrats show their Bi-Partisanship.

Former Newsweek correspondent and now pundit-cum-lobbyist Richard Wolffe, who penned a recent book about President Barack Obama, quotes an alleged senior White House aide in a blog posting Friday in which the aide says that Obama heckler Rep. Joe Wilson (R-SC) is a “pimple on the ass of progress.”

Conventional wisdom has it that the president and his team lost August, when cable went wall-to-wall with reports on town hall forums erupting with constituents upset with the president’s plans for health-care reform. But Obama’s team sees it slightly differently. “If you look at the polling, we didn’t lose ground in August,” a senior Obama adviser said. “We lost it in July and June, when Congress was in town.”

That might seem an academic distinction; after all, the headline about the polls was Obama’s approval ratings went down, significantly. But in this adviser’s view, the town hall dramas didn’t take the toll everybody think they did; rather, the outbursts were largely politically irrelevant. “I don’t think the protestors hurt us,” the senior adviser said. “We’ve done three town hall meetings and they were all fine.”

In fact, the White House is more than ready to brush aside the now-infamous protest of Rep. Joe Wilson of South Carolina, who yelled at the President during his televised address. “I think this is a pimple on the ass of progress,” said the senior adviser.

I’d like to know who this advisor is?

This is great news. Or is it? In particular, is it constitutional? 26 years ago, the Supreme Court, in Plyler v. Doe, held that a Texas school district could not exclude illegal alien children from receiving a public education. Since then, any immigrants rights groups have argued (successfully) that this rule extends far beyond educational benefits. Will healthcare benefits be next? If so, is this really a ruse designed to offer a pretextual compromise that would otherwise not be a bargaining at all?

How are employers going to determine citizenship, when they are knowingly hiring aliens?

They are going to use SSN’s given them and shut up

Right now, I assume the snakes in the Senate are setting up a vetting process that will be the same as the ID needed for driver’s licenses. A worthless sham, unless the credentials are seriously investigated by someone other than the employer or a clerk at the local Secretary of State. Many States are facilitating the protecting of illegals

At the point illegals are identified, is the law going to be obeyed and illegals deported and employers punished?

I shall not hold my breath.

They will not want to determine who is a citizen because this health care is employer related.

Yeah, nothing like a belt and suspenders and a few clothespins and velcro wraps to make the wingnuts happy. I doubt it’ll satisfy ‘em, though.

I wonder how many of the nutters citing the CRS report on HR 3200 actually bothered to read it? You know, like the part that explains that the Commissioner responsible for administering the exchange credit program has to actually, you know … ensure compliance with the “no aid to illegal aliens” provision.

However, others note that under §142(a)(3) of
the bill, it is the responsibility of the Health Choices Commissioner (Commissioner) to administer the “individual affordability credits under subtitle C of title II, including determination of eligibility for such credits.” Thus, it appears, absent of a provision in the bill specifying the verification procedure, that the Commissioner would be responsible for determining a mechanism to verify the eligibility of noncitizens for the credits.

CRS Report

Illegal immigrants can already get private insurance. This bill prohibits them from getting federally subsidized insurance.

To fighton03, cont’d:

Possibly you should read the bill. The credits in question are not tax credits, but premium credits.

In 2013, under §241 of H.R. 3200, certain individuals would be eligible for premium credits (i.e.,
subsidies based on income) toward their required purchase of health insurance. Even whenindividuals have health insurance, they may be unable to afford the cost sharing (deductible andcopayments) required to obtain health care. Under H.R. 3200, those eligible for premium credits
would also be eligible for cost-sharing credits (i.e., subsidies).

CRS Report

skylark on September 12, 2009 at 2:25 AM

Q Will illegals get govt subsidies if they fall into the applicable income category ?

Q. Will TIN #’s be used to establish federal ID for illegals to give them govt subsidies ( which in majority of cases will be 100 % for large families)

Q. In case of illegals with anchor babies, will the whole family be considered ONE UNIT and as such shoved into govt subsidies , just like they do for food-stamps and welfare ?

Q. When gangbangers, drugpushers and other criminals who are also illegals end up in hospitals with no/multiple IDs, and no insurance, will they pay for their medical care ?

Q. Will anchor babies be used to avoid deportation of criminal illegals ?

Q. So what will change for illegals ? If it won’t be difficult for them to mooch off American taxpayer, if they will not be punished for their crimes and if they would still be able to live off the anchor-babies ( free education, free medical, free food, free housing, , free college, free money ) what exactly are the NEW provisions aiming for?

As long as illegals can
1. use anchor-babies as meal tickets
2. live off US taxpayers
3. drive in USA with metricula cards
4. avoid deportation even after criminal activity
5. purchase SS cards / DLs of US citizens , in USA
6. work for cash ,with no repurcussions at all

this whole charade is not even worth the paper it is written on.
It is a legislation to get the taxpaying US citizens to bend over, one more time and not be able to stand up again. EVER

He blogged for the Huffington Post, stating that he had fought in Iraq and helped rebuild that country and had come home to find that the Congressman [Addison Graves Wilson] from his district and his government in Washington were neglecting the same things in his own country. Miller ran his entire campaign without help from the national Democrats and still managed to garner 46% of the vote.

So how much of a boost will Addison Graves [Joe ?] Wilson’s “You lie!” faux pas give the ex-Marine [Rob Miller]?
