Is Sunstein a good target on “czars”?

Dave Weigel reports on the effort to target Cass Sunstein as part of an overall attack on the explosion of “czars” in the Obama administration for the Washington Independent. Glenn Beck and others have focused attention on Sunstein, sometimes inaccurately, as a radical cut from the same cloth as Van Jones. Sunstein may be a liberal, but he’s no Van Jones — and for that matter, he’s no czar either, at least not in the common understanding of the term:
On January 8, The Wall Street Journal broke the news that Harvard Law School Professor Cass Sunstein would be nominated to run the White House Office of Information and Regulatory Affairs. It was a surprising choice for a job, created in 1980, that monitors and manages the federal government’s regulatory apparatus. And it was welcomed as an olive branch from an incoming Democratic president to conservatives and libertarians.
“[Sunstein's] writings on regulation and the herd mentality deserve a voice in the incoming Administration,” the newspaper’s editorial board wrote, in one of vanishingly few positive assessments it has given Barack Obama’s White House. “Mr. Sunstein brings important qualifications to [the Office of Information and Regulatory Affairs], and Mr. Obama has made a savvy choice in putting him there.” The editorial’s headline emphasized just what a happy surprise the appointment had been: “A Regulator With Promise – Really.”
Nine months later, Sunstein is still not working at the regulatory office. In May, he went through confirmation hearings before the Senate Committee on Homeland Security and Governmental Affairs. In June, Sen. Saxby Chambliss (R-Ga.) placed a hold on his nomination, citing concerns about Sunstein’s opposition to hunting. In July, Sen. John Cornyn (R-Texas) placed another hold on Sunstein, for the same reason. On August 7, before leaving for recess, Sen. Harry Reid (D-Nev.) filed for cloture on the nomination. But another senator, who has not made his or her name public, has placed a hold on Sunstein, making it unclear when the Senate might take up his nomination.
A “czar” does not get Senate confirmation. The post for which Sunstein has been nominated requires Senate confirmation and is subject to Congressional oversight. That differs greatly from the post Jones held, which had neither, with predictable results. Czars exist outside of the checks and balances provided by the legislative branch on executive power, which makes them a dangerous expansion of presidential power, and worthy of a concerted campaign to end those appointments. But Sunstein isn’t one of the czars.
The Senate and individual Senators have to decide what they feel is too radical for confirmation, of course. However, the guiding principle for most of our nation’s history is that a President has the right to choose his advisers in order to implement his policies. Absent evidence of, say, paranoid-conspiracy thinking, people usually allow that elections have consequences. Sunstein is a liberal thinker, not one I’d promote for a policy position in a government. Obama won the election, though, and gets to make those appointments.
In this argument, though, Sunstein opponents have a very handy precedent. George Bush wanted to make John Bolton his UN ambassador, and Bolton had plenty of qualifications for the position. Democrats blocked the appointment not because Bolton was unqualified, but because they didn’t like his politics. Should that appointment have been blocked? No, but it was, and Democrats set that precedent.
In the end, though, does Sunstein’s record really justify an extraordinary effort to keep him out of his appointment? Obama will eventually fill that position one way or the other, and Sunstein will probably be the mildest candidate for the job. We should focus on the very real threat of czars and presidential overreach rather than a mainstream liberal appointment.

The 2nd Amendment is no more based in fear than any of the others in the Bill of Rights. After all, each of them restrain government from tyranny. The Fifth Amendment keeps government from compelling testimony from defendants, the First Amendment prevents the silencing of political speech of the opposition, and so on. Did the shrieking of Bush critics over the NSA terrorist surveillance program and accusations of government snooping on their telephone calls not reflect hysterical fear? That’s a silly argument.

Denial ain’t a river in Egypt, pal. Cass Sunstein makes Van Jones look like a piker. Jones is a blowhard who talks in platitudes about “change” just like Obama without any substance, and landed on the “green jobs” issue because that’s where the money and fame were. He was an easy target and he folded like a cheap card table.
Cass Sunstein is a committed radical who has thought about and suggested radically different approaches to defining fundamental rights of citizens in this country. He actually has a following among serious people. And he is being nominated to a serous position where he could wield great influence in implementing his radical theories through the regulatory process.
If you think this guy’s views will be as acceptable to average Americans as Obama’s fluff speech to students was, you are very very wrong.

My surviving family (my mother as a 10yr old and my grandparents) walked through a mine field to escape Marxist inspired government. So yes; it is getting old. This time, though, my family won’t run from Marxists. We make our stand here.

Good call, Ed.
I hope conservatives don’t make illogical or unsustainable arguments about Sunstein. Say what you will about Harvard and the University of Chicago, but his work at these institutions provides plenty of history on Sunstein’s opinions and his work.
I just hope they stick to the facts. He’s a lefty, but he’s no Van Jones.

so, don’t fight this appointment? if we can stop the mildest candidate, why wouldn’t we be able to stop a more extreme candidate? what do we need anyone in this position for anyway? its been vacant for 9 months and the world has not stopped.

It was a link to an article reporting that over a million guns were sold in August to American citizens. Technically, it was just the number of successful background checks, but it’s still significant.
My point was that since Americans clearly are not moving towards a more anti-gun attitude(despite the fact that many shriek in terror at the concept of open carry), nailing some jackass claiming the Second Amendment is based in fear would be ideal.

While Sunstein is, in fact, not a czar since there has been some pretense at getting the advice and consent of the Senate, the fact of the matter is that nobody should be confirmed until there is a reckoning with all these unconfirmed czars running around. Either they go through the vetting process or they are banned under penalty of law from any role in regulation or public policy.

Yes, Sunstein is a big government liberal, just like Obama. No surprise there. Hopefully, all GOP Senators will oppose his nomination on the basis that his philosophy disqualifies him from advising the President on government regulation. I really hope he only gets in on Democrat votes.

Why should we support the appointment of anybody who openly is against the provisions of the Constitution? Sunstein doesn’t have the right to pick and choose the amendments that apply.

Please note that my two black labs have obtained legal representation and plan to sue if Sunstein gains Senate approval. Since they are black they have support from ACORN and the ACLU.
If that doesn’t work, our cats are organizing a petition and planning a class action lawsuit.

Cass Sunstein is incredibly dangerous, but he may not be the best target because he has such a calm persona and his ideas are incredibly abstract. It’s easier to target a guy who makes rap albums and uses words like “asshole.”

I think Sunstein is pretty much textbook liberal as it’s defined these days, that is, he’s the kind of statist that the administration wants for a regulatory position.
Is that enough reason to keep him out? Maybe if you believe that the administration’s running out of nanny-state regulators and the next appointment would be a Van Jones-quality comedy act.

The fact that Sunstein is not Black means this issue has no legs. It does not increase Beck’s ratings to go after a White guy. Plus, he does not scare Beck audience like a scary Negro.
Sunstein will has nothing to worry about. Sunstein could be a serial killer but because he is White Fox News will lose interest in him very quickly. There are no ratings there.
Beck should go after a Obama-OJ issue. His ratings will get past even Spongebob if he does that. Scary Negros = great ratings from Conservatives. That is why Rev. Wright was a ratings bonanza and Bill Ayers was nothing.

As a vegetarian and animal lover, I think Sunstein’s approach to “animal rights” goes too far (as described by Wikipdeia and others). Such an unbalanced approach disquaifies him to regulate the “people.”
