American Legion spitting nails over photo of dying Marine
posted at 6:28 pm on September 4, 2009 by Ed Morrissey
The American Legion has issued a blistering statement about the Associated Press decision to publish a photo of a dying Marine over the objections of the Marine’s family. I received this directly from the Legion earlier this afternoon:
INDIANAPOLIS (September 4, 2009) – “Outrageously irresponsible,” is how the leader of the nation’s largest veterans organization characterized the Associated Press’s decision to release a photo of a dying U.S. Marine taken in Afghanistan.
“The lack of compassion and common decency shown by the Associated Press in releasing this photograph is stunning,” said American Legion National Commander Clarence E. Hill, a retired Navy captain. “Lance Corporal Joshua Bernard is a hero who gave his life for his country. His family is understandably offended. I have asked the American Legion state commander in Maine to reach out to his family. Indeed everybody in The American Legion stands with his family.”
The photo shows Bernard bleeding after being struck by a rocket-propelled grenade in a Taliban ambush Aug. 14. Before the photograph was publicly released, Secretary of Defense Robert Gates asked Thomas Curley, AP’s president and chief executive officer to refrain from transmitting the image. “Out of respect for his family’s wishes, I ask you in the strongest of terms to reconsider your decision. I do not make this request lightly…The issue here is not law, policy or constitutional right – but judgment and common decency.”
“Secretary Gates was right,” Hill added. “The issue is judgment and common decency. There is some information, some actions that occur, that are simply too private, too personal, and too tragic to be intentionally broadcast into the homes of millions. For families with loved ones overseas, the fear of what might happen to them is a near constant companion. This photo not only keeps open the wounds of war for the Bernard family, but it also increases the fear for the families of those who are still facing the reality of sudden death every day.”
Hill called for a review by the Department of Defense of the rules governing embedded media. “This should never have occurred in the first place, nor should it be allowed to occur again,” Hill said. “Ironically, when I visited Camp Delta at Guantanamo, the photographer was prohibited from taking images showing the faces of detained terrorists. Yet, photographers are allowed to shoot photographs of fallen American heroes? Where is the common sense? Where is the common decency?”
With a membership of 2.6-million wartime veterans, The American Legion was founded in 1919 on the four pillars of a strong national security, veterans affairs, Americanism, and patriotic youth programs.
I’m not sure I can put this any better, although I recommend reading Mudville Gazette’s take on the matter. Politico has a comprehensive report about the Pentagon’s outrage, and it should be noted that Politico did not run the picture with the story:
Defense Secretary Robert Gates is objecting “in the strongest terms” to an Associated Press decision to transmit a photograph showing a mortally wounded 21-year-old Marine in his final moments of life, calling the decision “appalling” and a breach of “common decency.”
The AP reported that the Marine’s father had asked – in an interview and in a follow-up phone call — that the image, taken by an embedded photographer, not be published. The AP reported in a story that it decided to make the image public anyway because it “conveys the grimness of war and the sacrifice of young men and women fighting it.” …
Gates wrote to Thomas Curley, AP’s president and chief executive officer. “Out of respect for his family’s wishes, I ask you in the strongest of terms to reconsider your decision. I do not make this request lightly. In one of my first public statements as Secretary of Defense, I stated that the media should not be treated as the enemy, and made it a point to thank journalists for revealing problems that need to be fixed – as was the case with Walter Reed.”
“I cannot imagine the pain and suffering Lance Corporal Bernard’s death has caused his family. Why your organization would purposefully defy the family’s wishes knowing full well that it will lead to yet more anguish is beyond me. Your lack of compassion and common sense in choosing to put this image of their maimed and stricken child on the front page of multiple American newspapers is appalling. The issue here is not law, policy or constitutional right – but judgment and common decency.”
I’m not sure which is more despicable — the decision to run the photo, or their self-serving claptrap afterwards about honoring the service of men and women in the war by exploiting their death. It demonstrates truly warped thinking and values. The AP should apologize immediately and withdraw the image, although that would probably not stop its dissemination now.
Update: I wrote soldier when I should have written Marine in the headline. My apologies. I can’t believe I only got one e-mail on that, though.

I think this is beyond tasteless. It is cruel (dare I say “torture”?)to the family who requested that it not be published.
It is pornographic.
And it is more…particularly as presented by the Huff Post.
They and AP are gloating over the death of this young man. I insist that these creatures so hate the armed forces, the men and women who serve in them, and the families who support them that they gloat over this young man’s death.

The American Legion is right though – this is wrong.

When was the last time AP did a pic of a partial birth abortion. Shouldn’t Americans see those also?
An anonymous woman getting an abortion is a private affair.

karenhasfreedom on September 4, 2009 at 6:41 PM
Actually, I agree with showing the picture. Here is why. President Obama is trying to straddle the fence, and the War on Terror is only one issue. This picture will further erode his base of support among the young anti-American radicals that make up his staff in the White House, and his most vocal supporters.
Further, it shows the type of hypocracy that the press is engaged in. A N. Y. Times reporter is hostage for a year? Protect his privacy by not one news organization telling us about it. A Marine dies? Show photos of his last moments, he’s not one of us.
Way to go AP. I’m proud of you for both hurting the President with his own supporters, and further demonstrating that there is a glaring double standard in your world.

This is f##king unbelievable.
liberals and their journalist friends are nothing but scum.
To sensitive to publish the Mohammad cartoons.
I have yet to see the pictures of a partial birth abortion on the front page of huffington post or an AP story.
Come on liberals, you are so gun ho about showing the “truth” no matter who it hurts, print the Mohammad cartoons front and center brave ones.
Show everybody how proud you are of shoving that steel rod through a childs head because they are “inconvenient”.
Better yet.You liberals could really show how brave you are in publishing the truth in dealing with the serial murderers and rapist you love to put back on the streets.
They routinely record the cries of pain and agony of their victims.
Take pictures and make videos of the sadistic torture inflicted on their victims.
We have many repeat felons that have gone back and committed worse offenses.
Guess liberals would think it was just great to go right to the families and show them the photos of their tortured, murdered son or daughter.
Probably could not get enough watching the pain double over the parent while they listen to the cries of pain while they are being killed.
Yea liberals, tell us all about how important the “truth” is while you laugh and dance looking at one of our brave Soldiers die and having it plastered all over the country.
Bet you get a real kick knowing how much pain this family is going through seeing their dying soon used for you political propaganda.

We have a President who likes to say, “I won”, but who has an aversion to the word “victory” being applied to American troops.
Let’s bring our troops home. But first let’s do whatever is necessary to enable them to complete the assignment.

S. Weasel on September 4, 2009 at 6:53 PM

progressoverpeace on September 4, 2009 at 6:54 PM
E&P has the picture if you wish to see it. I personally don’t find it graphic but it is heart-wrenching. The family asked that AP not run it, then AP should obey.
However, I must say that dead soldiers were often photographed during WWII. Were they published in newspapers? Not likely, since moral was vastly more important than shocking the American homefront. In fact, back then, most people would have thought the photos were treasonous. After the war, these photos were used in books, and magazines. I think I do remember a Life Magazine article depicting dead soldiers on Normandy beach during the war.
I wouldn’t run this photo today, because as a previous poster said, the Marine’s death would be exploited by the anti-war nutjobs to promote their propaganda. And the leftists would NEVER view the photo with reverence and solemnness

The posting of that pic is just the latest example of the Left’s risng drumbeat against the war in Afghanistan. It is a classic, perhaps even a cliched, tactic. What better way to undermine a war than to undermine the public support for it? And what better way to undermine the public support for it than to post a picture of a dying soldier? I simply posted that Bosnia was carried out under Clinton and it did not make it.

Years ago, I skim read a book on censorship during WW2. No, graphic photos were not published during WW2. In fact, they were not published after WW2. Obviously, you can find photos of dead soldiers on the internet, however, they are not really graphic. They are not depicted as they look in real life. This disrespect of our enlisted men and their families is fairly new.

In WWII? No. I agree. After the war though, I have seen photos identifying the dead soldier. Certainly not all photos. Besides, some of that information was probably lost after the war.
The AP could have not identified the soldier. Would that have been more appropriate? Hard to say. It might have made this controversy go away. Though its still somewhat graphic to certain people. The distance from the Marine that the photo was taken, makes it hard to see any details, so not id-ing the soldier when publishing the pic would have been better.

It is not enough that we express our outrage when the AP pulls such a repugnant stunt…as it has pulled similar outrageous stunts many times before …or when the NYT publishes national security secrets that get our soldiers killed. They get away with it, they get rewarded with publicity.
We need to stop rewarding them. We need to get our news elsewhere. And by we, I mean each of us, as well as all conservative blogs like Hot Air, and like Michelle Malkin, need to actively avoid the AP and NYT whenever possible.
I removed the NYT from my sidebar when they first published national security secrets. I refuse to link to them (every link generates revenue). I refuse to buy their paper. I complain to businesses that offer it. I wish much bigger blogs like this would put their money where their mouth is. Cite another source. Cite generic “news reports”. Don’t cite anyone.
But stop rewarding them. What is the purpose of all this new media, if we cant get away from the old media that is so destructive?
