Video: Dean says no tort reform because trial lawyers too intimidating

A moment of clarity from Howard Dean, courtesy of CNS News, who took this video at the town-hall forum of Rep. Jim Moran (D-VA). When an angry constituent wondered why a supposedly comprehensive “reform” of the health-care system doesn’t include tort reform to lower costs of malpractice insurance and reduce defensive medicine, Dean responds as “a doctor and a politician.” Apparently, neither has the courage to face the trial-lawyer lobby:
Former Democratic National Committee Chairman Howard Dean, a medical doctor who served as governor of Vermont, said at a town hall meeting on Tuesday night that Democrats in Congress did not include tort reform in the health care bill because they were fearful of “taking on” the trial lawyers.
“This is the answer from a doctor and a politician,” said Dean. “Here is why tort reform is not in the bill. When you go to pass a really enormous bill like that the more stuff you put in, the more enemies you make, right? And the reason why tort reform is not in the bill is because the people who wrote it did not want to take on the trial lawyers in addition to everybody else they were taking on, and that is the plain and simple truth. Now, that’s the truth.”
Yes, that is the truth. Instead of taking on trial lawyers in an honest attempt to lower actual costs, the Democrats have decided to demonize insurers — who have incentives in place to keep costs low — and doctors. I wonder how Dean feels about Barack Obama’s attempts to paint physicians as greedy Tonsil Vultures and Foot Rustlers? In those instances, I’m pretty sure Dean responds as a politician instead of a doctor.
Malpractice tort abuse doesn’t create all of the unnecessary costs in health care, but it causes a significant portion of them. Any attempt at a comprehensive reform without tackling that area makes the entire effort look like political maneuvering for other purposes than real reform and cost control. At the very least, it makes the Democrats look rather craven — as Dean himself admits.

After Sarah Palin’s column calling for tort reform, abcnews obligingly helped the Democrats’ spin machine by running articles claiming that tort reform efforts in various states have not worked well. Coming now from Dean himself, I wonder what the latest spin will be.

Congressman Chet Edwards (D-TX) was asked this same question last night at his townhall in Bryan (scheduled after he was named a “milk carton congressman”). His answer was that although healthcare doesn’t fall under the 10th Amendment because of Medicare/Medicaid, tort reform is a state issue, not a federal issue. So Congress can look at one part of healthcare costs, but not the whole picture. Go figure.
He was a slick, slimy weasel on all his answers.

While part of me appreciates the brief moment of honesty from Dean, these politicians have some serious stones to stand there and tell us that they’re unwilling to challenge the trial lawyers. And of course we know it’s the same with the unions. And the pro-amnesty crowd.
Dick Morris was right about the Dems having several different constituencies and how they can’t afford to alienate any of them. The problem they’re having now is that in order to pass health care….errrr, insurance reform, it requires that they screw over the seniors, one of their most important voting blocs.
And to make matters worse, the rest of the country is rising up in opposition and letting the Dems know they’ve had enough.

Here a story I heard about Dean. While governor, he changed the eligibility requirement for state medical assistance to take in account the existence of an unborn child and then let women who so qualified use their assistance to abort that child at the taxpayers expense.

Here is an honest answer:
Howard Dean: The reason tort reform is not in the bill is because the trial lawyers give millions to Democrat politicians every year. We have been bought off.
There is a second reason you will not see tort reform. Tort reform would go a long way toward solving the problems with medical care here in the US. If we were to solve the problems we would no longer have an excuse to implement what we really want; single payer socialized medicine.
And that is the truth.

They don’t want to take on trial lawyers because most of the senators and representative ARE lawyers, and they benefit from creating more laws that only lawyers can understand or interpret for us low-life taxpayers.
Does anybody remember Irwin Schiff in the late 1970s? He was a tax rebel who pointed out that lawyers have created an aristocracy within our government by creating a convoluted system of laws, such as the tax code. So when the taxpayer unwittingly gets into a jam with with the IRS for overlooking box 47e, he/she has to get a lawyer to straighten the legal problems.
Sounds rather self-serving.
