Kennedy wants law changed in Massachusetts … again
posted at 9:30 am on August 20, 2009 by Ed Morrissey
During the time MItt Romney was governor of Massachusetts, Senator John Kerry ran for President and looked at times that he might win. The state legislature, egged on by Kerry’s Senate partner Ted Kennedy, changed the law regarding the selection of a replacement Senator to require a state election, keeping Romney from the possibility of appointing — quelle horreur! — a Republican in Kerry’s place. Now that Ted Kennedy is perhaps too ill to continue, Kennedy now wants the law changed back, since there’s a Democrat in the governor’s chair.
A cancer-stricken Sen. Edward M. Kennedy has written a letter to Massachusetts leaders asking that they change state law to allow a speedy replacement of him in Congress.
The note has been sent to Gov. Deval Patrick and the state’s Senate president and House speaker while Congress considers an overhaul of the nation’s health care system, one of Kennedy’s projects.
The letter acknowledges the state changed its succession law in 2004 to require a special election within five months to fill any vacancy. At the time, legislative Democrats — with a wide majority in both chambers — were concerned because then-Republican Gov. Mitt Romney had the power to directly fill any vacancy created as Democratic Sen. John Kerry ran for president.
But Kennedy writes “it is vital for this commonwealth to have two voices speaking for the needs of its citizens and two votes in the Senate during the approximately five months between a vacancy and an election.”
Well, it is now, since Deval Patrick and not Mitt Romney governs Massachusetts. Now, apparently, the needs of a democratic process can take a back seat to the needs of a, um, Democratic process. Suddenly, Kennedy sees the need to have Massachusetts represented by two Senators immediately after an opening, rather than wait for the will of the people.
If there’s a bigger pile of hypocrisy (outside of Washington DC), someone please be sure to mention it in the comments.
The rule of law prevails because it’s seen by most as a fair, non-partisan measure of public behavior. There are good arguments to be made for both gubernatorial appointment and special elections as processes for filling mid-term vacancies in Congress. However, actions by a state legislature and demands by partisan hacks to keep going back and forth depending on the party registration of the Governor makes a mockery of the rule of law and underscores the fact that machine politics runs Massachusetts. (via JiangxiDad)
Update: John Fund moves the story a bit more:
The Boston Globe now notes Mr. Kennedy’s current request “puts lawmakers in a delicate position.” They “are nervous about being accused of engineering a self-serving change to help their party” just a few years after ramming through a similar self-serving change.
It’s sad to see Senator Kennedy sign on to such an obvious ploy. Under the law he now proposes, he would likely not have become a U.S. Senator in 1962, after his brother became president. At the time, Ted Kennedy was too young to be appointed to JFK’s seat. A faithful Kennedy ally was appointed by the state’s Democratic governor for two years as a stand-in until Ted was old enough to run and win in 1962. Under the changes Mr. Kennedy now wants, a special election would instead have been held in early 1961 — an election he would not have been eligible to run in — and he likely would have faced a formidable incumbent if he chose to run as a novice when the seat next came up in November 1962. In the event, Mr. Kennedy secured the Democratic nomination only after his brother’s operatives convinced most of the state’s prominent Democrats not to run. Even so, young Teddy managed to win only 53% of the vote in the general election in a strong year for Democrats with his own brother in the White House.
Be sure to read it all.

IMO, he is on life support now. He could not even attend Eunice’s funeral. I’m sure he had nothing to do with writing that letter, it was probably written by his staff who want to keep their jobs and auto-penned. They are trying to keep him alive so they can wheel him into the White House for the signing of the Edward Kennedy Health Care Reform Act.
Meanwhile, the people of Massachusetts effectively have only one Senator, and Kennedy is drawing a salary while not performing any duties, which is illegal. Liberals were screaming about this while Minnesot worked out the dispute over the Franken/Coleman race, but they are curiously silent about the people of Mssachusetts not having two Senators.

Leine’s? My, you are from the midwest, aren’t you?
Jeff has taken quite a flaming here today. I have to say, in his defense… These career politicians like TK just never seem to go away. They want to stay in their positions forever, until they finally die in office at a very old age. So I can understand why, to some people, their deaths are something to be celebrated, since that is the only way to finally get them out of office.
If only we had term limits, some of these reviled career politicians would just fade into oblivion and we might not have such strong feelings against them.

Kennedy has known he is not going back for a long time now. There is ACTUALLY no evidence that he is even still alert and thinking to write such a letter. Rumors from people who know is he is not. The dems know they have this important vote coming up so now they will throw him under the bus with the rest of Obama’s “supporters” so they can get that vote in there! They KNOW that reconcilliation will NOT work and they need the votes!

Nice rose-colored glasses.
The point is that the soldiers had no choice in the matter, because they were ordered to do so by those in power. The mothers made their choice, and were never ordered to choose one way or another by those in power. Therefore, the Teddy=Hitler analogy is appalling.
MadisonConservative on August 20, 2009 at 11:56 AM
As much as I do not wish a painful life or death on even my worst enemy, I think that Ted Kennedy has always been self-serving in perpetuating his own and his family’s “legacy.” His emotive plea to his fellow senators to pass the health (insurance) bill with his name attached is a cheap, transparent trick. The irony is that his own private insurance plans, the best that his wealth and the taxpayers’ largesse gives to its political class,so very much exceeds what he offers (and will deny) to the majority of Americans. His history of expiating his own limousine-liberal guilt on the backs of hardworking, law-abiding citizens is legendary.
I hope that Ted Kennedy meets a merciful Maker because all of the bluster and bloviating and rationalizing that he has done in his life would try the patience of a deity less than perfect.

Hitler forced people to die. Teddy didn’t force anyone to die. Individual citizens had to make that choice. If no one had chose to have an abortion, there wouldn’t be an issue.

I don’t consider Ted Kennedy a political opponent. Joe Lieberman is a political opponent. I don’t agree with him on hardly anything, but I could get through a policy disagreement over dinner, shake his hand, and drive home afterwards.
Ted Kennedy is a drunken demagogue scumbag. Never worked an honest day in his life; got away with murder, and is likely a multiple rapist. Is he as bad as Hitler? Not hardly. My digust with Ted Kennedy has nothing to do with his policy beliefs and everything to do with the crimes he has perpertrated and gotten away with because of the power of his sh*tbag family. Am I glad he suffered? Not really. I feel little empathy for his pain that I might for another stranger. But I will be glad when he’s gone and I hope they have the fires stoked up extra hot that day because he has a lot to answer for.
I won’t be baking ‘death cupcakes’ (hur hur hur) but I will probably get a nice big mouthful of whiskey and spit it all over the front page picture of his big stupid fat face. Respect is earned. You gotta give it to get it. Kennedy deserves nothing. Forget the hearse. Save some carbon credits and roll a garbage truck.
And seeing how the left is going to do whatever they want when someone from the right dies, I’m not going to curry favor and attempt to model good behavior to them. After the Sarah Palin hanging in effigy last Halloween, I’m more than happy to jump in the mudpit and gouge some eyes with the libs. Trying to be above it all isn’t working.

If Romney still wants the seat, great. But I haven’t seen anything from his camp about the situation. My guess he still has the ridiculous idea that he could actually win the republican primary for president, and will pass on a decent chance of picking up the senate seat.
Which is par for the course for a MA republican, they have little interest in serving the people, big interest in using it as a stepping stone for something else.

The irony?
When he dies, this divorced abortion advocate, will be honored by the Catholic Church.
They will probably state some garbage about him receiving absolution, or forgiveness.
The one thing that the Catholic (and other denominations) seem to forget is that to receive forgiveness, you must ask forgiveness from the person you transgressed towards.
In other words, the only way to receive forgiveness for murder, is by asking that person for forgiveness…hence the only way to seek forgiveness (as a Christian) for murder, is to die yourself. God isn’t so dumb after all…

I think the seat should be offered first to someone in Mary Jo’s family if any are residents of MA. It would be a grand gesture to right the wrong done to them by Toddy Kennedy.
It won’t be many years before the Kennedy name will have less awe outside of MA. Hopefully at some point, the gleam & awe in MA will begin to fade.
It’d be nice to see Romney politic into the Senate seat. Doubt it in MA. They’d rather let the seat gather dust than allow a Repub. fill it. I like Romney, depsite his governmental health program is a near failure. I doubt he’ll ever be the Repub. Presidential nominee.

I don’t believe in celebrating the deaths of political opponents. If Barney Frank keeled over tomorrow, I would say a prayer for his soul and post nothing but sympathy for his bereaved family and friends. I will do no such thing for Ted Kennedy and it all comes down to Chappaquiddick.
The facts are clear and incontrovertible: When asked to choose between doing all he could to save a woman’s life and salvaging his political career, Kennedy chose to salvage his political career. Kennedy deserves nothing but contempt and that contempt pushes out compassion.
But it goes beyond that. What Kennedy did and represents strikes at the fundamental moral nature of our society and our political system. Anyone with conscience knows that Kennedy should have been sent to prison and should have been kicked out of public office. The fact that the people of Massachusetts have reelected this waste of human flesh again and again makes them complicit in Kennedy’s crime. They know what he did and what he is, and yet they reelect him because of the ‘D after his name and the “honor” they give his family name. They have validated Kennedy’s decision just as if they walked beside him that night, passing up every opportunity to rescue Mary Jo Kopechne.
A free people should demand more of themselves.
So no, he will receive no compassion from me. He will receive no prayers or kind words. And this latest news comes as no surprise. Why should a man who cared so little for human life and valued politics so highly at Chappaquiddick, act any different at the end of his life? In the end I can only paraphrase from a Man for a All Seasons:
” Why Ted, it profits a man nothing to give his soul for the whole world… but for Massachusetts?”

I worked at the statehouse for 4 years. It isn’t that Republicans use this as a stepping stone, the problem is that once one becomes Governor he really see how impotent he is. Having one party rule means that everything you veto is overridden, anything you want to change you can’t and if you are creative and find a new way to do something the legislature changes the rules midstream. Plus 90% of what a Ma governor signs that isn’t vetoed is home rule bills which consist of naming highways after people, allowing cities and towns to add new liquor licenses, and giving people the right to give their sick days away to a sick co-worker. Even Deval is suffering at the hands of Beacon Hill because neither the Speaker or the Senate President want to be second fiddle to any Mass Governor Republican or Democrat. Also I don’t think becoming Ambassador to Canada was much of a stepping stone for former Gov Celluci.

The mere fact that Kennedy himself, or his aids, felt the need to pen such a letter of recommendation to the MA governor, and legislators, reeks of worry. They must know that if it were put to a vote, the general public is fed up with the democrats, and their childish, and dangerous way of governing, and would promptly put a republican in the seat.
It has to be a consideration, considering MA is usually a blue state!
capejasmine on August 20, 2009 at 3:37 PM
If Kennedy is really concerned about the people of his State having the uninterrupted service of a Senator who will represent them, then he should ask the Governor and the State Legislature to schedule a special election as quickly as possible and inform them that he is resigning his office effective one week after a replacement has been elected.
This would be a much more effective way to assure that the people of MA have someone who will represent their interests, than asking the legislature to change the law. His illness already makes it difficult, if not impossible, for him to provide the representative presence in Congress that he claims he wants for his constituents.

Somehow forgot to mention that Kennedy was supportive of what is creating the problem to begin with.
Typical…

Just write the new law to say that when a Democrat is Governor, he makes the appointment and when it is not, there is a vote.

Politics in Massachusetts, and just about all of New England is getting to resemble Saddam’s Iraq. You can be sure there will be no troops sent to liberate the people and restore democracy. Most offices have a Democrat only running for them, unless you get a Green or Rainbow party candidate. The Kennedy’s are a corrupt lot that hold extreme power. I don’t know one person that has ever admitted to voting for Teddy, but he is a royal all the same. Their behavior is un-American and repugnant.
Teddy recently was fined for paying fees late and send a nasty letter to the town office calling everyone unprofessional. How dare one fine the criminal boss, Kennedy. Here is the epitome of what the Democratic party claims to work against, who is wealthy and surrounded by his ill gotten gains, yet he collects his salary and benefits from the taxpayer and writes nasty notes to public servants that are simply doing their jobs and need the income from them

I thought wishing for the death of, or the ill health of, a politician was cause for the ban hammer.
I might include wishing for the eternal damnation of someone because you don’t agree with their politics is foolish and cruel.
But, hey, that’s just my take.

“Don’t agree with their politics?”
Not accurate.
If I don’t agree with my neighbor’s politics, we can be friends, because the way he votes and the policies he believes in don’t affect my life.
On the other hand, Ted Kennedy believed in and enacted policies on immigration, social programs and abortion, that do affect myself and every American. Adversely.
Where his soul resides after life is up to God, but I’ll be damn glad he’s out of the Senate, by any means necessary.

Can anyone say Arnold?
Senator Kennedy saves California by having the Governator appointed as US Senator in Massatussets.
Gotta hand it to the Kennedys…they are a crafty bunch.

I don’t think we’ll have to worry too much about the law being changed in MA. Most likely, Uncle Ted will be dead before they can get it changed. On second thought, maybe not.
