Kennedy wants law changed in Massachusetts … again
posted at 9:30 am on August 20, 2009 by Ed Morrissey
During the time MItt Romney was governor of Massachusetts, Senator John Kerry ran for President and looked at times that he might win. The state legislature, egged on by Kerry’s Senate partner Ted Kennedy, changed the law regarding the selection of a replacement Senator to require a state election, keeping Romney from the possibility of appointing — quelle horreur! — a Republican in Kerry’s place. Now that Ted Kennedy is perhaps too ill to continue, Kennedy now wants the law changed back, since there’s a Democrat in the governor’s chair.
A cancer-stricken Sen. Edward M. Kennedy has written a letter to Massachusetts leaders asking that they change state law to allow a speedy replacement of him in Congress.
The note has been sent to Gov. Deval Patrick and the state’s Senate president and House speaker while Congress considers an overhaul of the nation’s health care system, one of Kennedy’s projects.
The letter acknowledges the state changed its succession law in 2004 to require a special election within five months to fill any vacancy. At the time, legislative Democrats — with a wide majority in both chambers — were concerned because then-Republican Gov. Mitt Romney had the power to directly fill any vacancy created as Democratic Sen. John Kerry ran for president.
But Kennedy writes “it is vital for this commonwealth to have two voices speaking for the needs of its citizens and two votes in the Senate during the approximately five months between a vacancy and an election.”
Well, it is now, since Deval Patrick and not Mitt Romney governs Massachusetts. Now, apparently, the needs of a democratic process can take a back seat to the needs of a, um, Democratic process. Suddenly, Kennedy sees the need to have Massachusetts represented by two Senators immediately after an opening, rather than wait for the will of the people.
If there’s a bigger pile of hypocrisy (outside of Washington DC), someone please be sure to mention it in the comments.
The rule of law prevails because it’s seen by most as a fair, non-partisan measure of public behavior. There are good arguments to be made for both gubernatorial appointment and special elections as processes for filling mid-term vacancies in Congress. However, actions by a state legislature and demands by partisan hacks to keep going back and forth depending on the party registration of the Governor makes a mockery of the rule of law and underscores the fact that machine politics runs Massachusetts. (via JiangxiDad)
Update: John Fund moves the story a bit more:
The Boston Globe now notes Mr. Kennedy’s current request “puts lawmakers in a delicate position.” They “are nervous about being accused of engineering a self-serving change to help their party” just a few years after ramming through a similar self-serving change.
It’s sad to see Senator Kennedy sign on to such an obvious ploy. Under the law he now proposes, he would likely not have become a U.S. Senator in 1962, after his brother became president. At the time, Ted Kennedy was too young to be appointed to JFK’s seat. A faithful Kennedy ally was appointed by the state’s Democratic governor for two years as a stand-in until Ted was old enough to run and win in 1962. Under the changes Mr. Kennedy now wants, a special election would instead have been held in early 1961 — an election he would not have been eligible to run in — and he likely would have faced a formidable incumbent if he chose to run as a novice when the seat next came up in November 1962. In the event, Mr. Kennedy secured the Democratic nomination only after his brother’s operatives convinced most of the state’s prominent Democrats not to run. Even so, young Teddy managed to win only 53% of the vote in the general election in a strong year for Democrats with his own brother in the White House.
Be sure to read it all.

If I celebrated Hitlers death or Stalin’s death, that would not be conservative? Or should I respect them? When you really come down to it, I mean really come down to it, Ted Kennedy, in his job as a U.S. Senator, is responsible for as many deaths on this planet than perhaps either of these two monsters mentioned.

Obviously, Teddy wants one of his kids or nieces/nephews to be appointed to his

Since they are singularly undistinguished (and some have proven to have morals even worse than Uncle Ted’s), none of them would have a snowball’s chance in Hell of winning an actual election, especially in this anti-Democrat, anti-government environment.Has anyone commented about the possible amazing irony that if Ted dies and this law has not been changed, Mitt Romney might actually run for the Senate — and win?

Man that went right over my head.
Now that it was pointed out I see it was quite good.
I’m a former pilot so I get nit picky with aviation stuff. It’s nasty to say but I and a lot of other pilots I know think JFK Jr. did a disservice to pilots with that flight. He really should have scrubbed the flight because it was a pooch screw from the start. He took off late and without the instructor that was going to accompany him because it was a new plane he didn’t have much time in. Rumor has it the instructor backed out because of conditions and other pilots I’ve talked to said that it was really nasty between Block Island and the Vineyard that night.
There is and old saying that Stupidity is natures dead sentence and JFK Jr. was stupid on that night.
RagTag on August 20, 2009 at 11:29 AM
I think this disagreement over the dead is pretty common with those lacking a deep understanding of Scripture. I’d be willing to bet BadgerHawk and MadLibertarian are reacting this why due to the prevailing superstitions toward “speaking ill” left over from previous eras.

I’m afraid I have no eloquence or witty remarks today, but merely a simple warning. We are five years, maybe ten, tops, away from elements of the populace just simply refusing to be governed by those of the other party. They will withdraw their consent from the social compact. These elements exist on both sides, but the power and willingness of the media to carry water for one side and not the other means it most likely will be a case like this one, where a Democrat gets too cute with the rules yet again, the media will not castigate as they would with a Republican, real consequences for who holds power result, the camel’s back gets broken, and future republics get a useful object lesson in what not to do (the way Athens was needed to show both democracy could be done and how not to do it).
Five years. Ten years tops. At that time we will see if E.J. Dionne’s argument laid out elsewhere today has any, shall we say, logical fallacies that are at war with what experience has shown.

Now you’ve hit on the real Achilles heel of the Kennedy clan. Their arrogance and sense of entitlement that normal rules do not apply. JFK Jr. was flying a plane he wasn’t really qualified to fly but thought he could manage. Teddy Kennedy inadvertently killed a woman and figured out how to get away with it. Michael Kennedy (RFK’s son) was killed because he was on a ski slope too advanced for his skills. Patrick Kennedy has managed to stay in public office despite having mental problems and being a habitual abuser of substances.

Don’t forget that Ted Kennedy’s legacy also includes the disgraceful smearing of Judge Robert Bork, who otherwise would be sitting on the Supreme Court today instead of the semi-worthless Anthony Kennedy. And this began the deterioration of the judicial nomination process into hyper-partisanship, which has produced tremendous and unnecessary political division in America, prevented many qualified people, liberal as well as conservative, from being confirmed to the federal bench and scared many others away from even trying, and politicized the Judicial Branch in a way that certainly has the Founders rolling over in their graves. It has led to mediocrities like Sonia Sotomayor on the Supreme Court.
Ted Kennedy deserves nothing but scorn for all of this. It is a horrible legacy he leaves, not a positive one for anyone except his own overrated family.

President Obama on Thursday named 16 people, including leading scientist Stephen Hawking and U.S. Senator Edward Kennedy, as the recipients of the 2009 Presidential Medal of Freedom, the White House said in a statement.
…
Senator Edward M. Kennedy has served in the United States Senate for forty-six years, and has been one of the greatest lawmakers – and leaders – of our time. From reforming our public schools to strengthening civil rights laws and supporting working Americans, Senator Kennedy has dedicated his career to fighting for equal opportunity, fairness and justice for all Americans. He has worked tirelessly to ensure that every American has access to quality and affordable health care, and has succeeded in doing so for countless children, seniors, and Americans with disabilities. He has called health care reform the “cause of his life,” and has championed nearly every health care bill enacted by Congress over the course of the last five decades. Known as the “Lion of the Senate,” Senator Kennedy is widely respected on both sides of the aisle for his commitment to progress and his ability to legislate.
So tell me, everyone. Is it for his ability to drive freely, not caring about where the road ends? Or is it his ability to swim free of a submersed car with an innocent woman inside?
Tell me, Senator, about Mary Jo Kopechne’s freedom. Did you contribute to hers, or did you drunkenly revoke hers?
Sorry, but I can’t really type more without having to censor most of my words.

…you’re comparing American woman to German soldiers.
I wasn’t aware American women were under orders to kill their children. I’m pretty sure they make their own damned choice.
German soldiers were under orders to kill.
Your comparison is ludicrous, and disgusting.

Fools like MadLibertarian believe that if the sin is spread around to millions, it absolves the creature who initiated the slaughter… unless Hitler did it.

Wow, the very SAME person that warns he’s about to SWEAR ion here because someone got a stupid award, finds fault with me celebrating the same persons death. Amazing

And yet, I never wished for his death, or would celebrate it. Frankly, my anger in that post was more towards Obama and to those sugar-coating Teddy’s career.
