Kennedy wants law changed in Massachusetts … again

During the time MItt Romney was governor of Massachusetts, Senator John Kerry ran for President and looked at times that he might win.  The state legislature, egged on by Kerry’s Senate partner Ted Kennedy, changed the law regarding the selection of a replacement Senator to require a state election, keeping Romney from the possibility of appointing — quelle horreur! — a Republican in Kerry’s place.  Now that Ted Kennedy is perhaps too ill to continue, Kennedy now wants the law changed back, since there’s a Democrat in the governor’s chair.

Seriously:

A cancer-stricken Sen. Edward M. Kennedy has written a letter to Massachusetts leaders asking that they change state law to allow a speedy replacement of him in Congress.

The note has been sent to Gov. Deval Patrick and the state’s Senate president and House speaker while Congress considers an overhaul of the nation’s health care system, one of Kennedy’s projects.

The letter acknowledges the state changed its succession law in 2004 to require a special election within five months to fill any vacancy. At the time, legislative Democrats — with a wide majority in both chambers — were concerned because then-Republican Gov. Mitt Romney had the power to directly fill any vacancy created as Democratic Sen. John Kerry ran for president.

But Kennedy writes “it is vital for this commonwealth to have two voices speaking for the needs of its citizens and two votes in the Senate during the approximately five months between a vacancy and an election.”

Well, it is now, since Deval Patrick and not Mitt Romney governs Massachusetts.  Now, apparently, the needs of a democratic process can take a back seat to the needs of a, um, Democratic process.  Suddenly, Kennedy sees the need to have Massachusetts represented by two Senators immediately after an opening, rather than wait for the will of the people.

If there’s a bigger pile of hypocrisy (outside of Washington DC), someone please be sure to mention it in the comments.

The rule of law prevails because it’s seen by most as a fair, non-partisan measure of public behavior.  There are good arguments to be made for both gubernatorial appointment and special elections as processes for filling mid-term vacancies in Congress.  However, actions by a state legislature and demands by partisan hacks to keep going back and forth depending on the party registration of the Governor makes a mockery of the rule of law and underscores the fact that machine politics runs Massachusetts. Update: John Fund moves the story a bit more:

The Boston Globe now notes Mr. Kennedy’s current request “puts lawmakers in a delicate position.” They “are nervous about being accused of engineering a self-serving change to help their party” just a few years after ramming through a similar self-serving change.

It’s sad to see Senator Kennedy sign on to such an obvious ploy. Under the law he now proposes, he would likely not have become a U.S. Senator in 1962, after his brother became president. At the time, Ted Kennedy was too young to be appointed to JFK’s seat. A faithful Kennedy ally was appointed by the state’s Democratic governor for two years as a stand-in until Ted was old enough to run and win in 1962. Under the changes Mr. Kennedy now wants, a special election would instead have been held in early 1961 — an election he would not have been eligible to run in — and he likely would have faced a formidable incumbent if he chose to run as a novice when the seat next came up in November 1962. In the event, Mr. Kennedy secured the Democratic nomination only after his brother’s operatives convinced most of the state’s prominent Democrats not to run. Even so, young Teddy managed to win only 53% of the vote in the general election in a strong year for Democrats with his own brother in the White House.

More generally, when a senator becomes too ill, or senile to preform the functions of his position, it is time for a new senator. Either recall, re-elect, or appoint a healthy, younger person.

The US Senate is not the place to go for hospice care in your final days.

Transparency, honesty, bi-partisan, co-operation, new way, change, no more old style politics, listening to the people, responsive to the people, reaching across the aisle, etc.

The White House and Senate Democratic leaders, seeing little chance of bipartisan support for their health-care overhaul, are considering a strategy shift that would break the legislation into two parts and pass the most expensive provisions solely with Democratic votes.

The thing that makes me the most angry about our ‘leaders’ and our politicians is that they don’t care.

They are NOT looking out for what is good for us. They only care about what helps THEM personally. Seriously, this was the problem with Kings and Monarchs. Why would they care what anyone else needed if they got what they needed.

This type of stuff really makes me angry at what our system of government has become. It isn’t now what it was originally intended. Our founders would be embarrassed by both Mass senators.

I’m less offended by the politics of appointing a successor than I am in the way the drunken bastard is attempting to grease the wheels so his wife can immediately take his spot in the Senate. If the need for a replacement is immediate, the people of Mass. would be far better served with a real appointee with real credentials than somebody whose only claim to the job is by marriage.

Ted Kennedy should be the poster boy for the Democrats. Fat, bloated and dying, he spent his entire life skirting the rules and sticking it to the people who played by the rules.

All he’s thinking about is the Democrat’s holy grail, government run healthcare.

But last fall he noted more than 40 other states fill congressional vacancies by gubernatorial appointment. He also cited the state’s deteriorating fiscal condition as one argument to skip a special election and empower the governor to fill vacancies.

Everybody else does it, and we’ve got to think of something other than cutting programs in our welfare state to appear to be fiscally responsible after hiking the sales tax 20%. Besides, can I appoint myself, I’m F’ed in the next gubernatorial election, people think I’m a lame duck on both sides of the aisle.

The only one I can think of that comes close is when the New Jersey Supremos decided in 2002 to replace Senator Toricelli with Frank Lautenberg on the ballot after the deadline for changes because it was “in the public interest that there be a competetive Democrat in the election”.

Is Massachusetts legislature in session? No. How would the governor attempt to trump or avoid the law? Either issue an executive order or else leave the state short a senator.

Truly sad to see the state that I consider to be the rabel rousers of the revolution, Sam Adams, Sons of liberty, etc. devolve into what it is today. MA schools need to go private so the great history of MA can be taught to the kids and the states stature reclaimed.

Poor Teddy is worried that even in Massachusetts, in an actual election a Kennedy might not win his seat. So gubernatorial appointment is the only sure way to keep it in the family. How nice.

As for the Massachusetts Democratic Party, in the interests of efficiency they should quit flip-flopping between the two succession laws. Just make one omnibus provision that the governor appointments the successor if the governor is a Democrat; and if not the succession goes to election. I mean, if you’re going to be that crassly cynical, why not go all the way?

This isn’t outside Washington DC, but a bigger pile even for them would be if Kennedy shows up to vote for a health care bill. Hey, they dragged Patches out of rehab to vote.

For Teddy to miss his sisters funeral but show up to vote for whatever the House passes would be a much bigger pile.
