Video: Specter shocked, shocked to find individual mandate in ObamaCare

This kind of thing is so predictable that it’s a wonder that we haven’t seen more of these moments coming from the increasingly rare open town-hall forums this month. When legislators don’t bother to read bills before supporting them, they will obviously fail to know all the nuggets of disasters contained within them. The beauty of this clip is that the question that flummoxes Specter comes not from a Tea Party protester but from one of Specter’s putative allies from a union:

The key takeaway comes at the end:

“In a free society, if people absolutely insist on not being covered, that’s ultimately going to be their choice.”

Had Specter done his job, he would already know about Section 401 of the House version of ObamaCare. King Banaian read it over a week ago and highlighted this particular portion in order to make clear that the bill does indeed impose individual mandates and assigns penalties for non-compliance:

In General- Subchapter A of chapter 1 of the Internal Revenue Code of 1986 is amended by adding at the end the following new part:

Subpart a. tax on individuals without acceptable health care coverage.
‘Subpart A–Tax on Individuals Without Acceptable Health Care Coverage

‘Sec. 59B. Tax on individuals without acceptable health care coverage.

Sec. 59b. tax on individuals without acceptable health care coverage.

‘(a) Tax Imposed- In the case of any individual who does not meet the requirements of subsection (d) at any time during the taxable year, there is hereby imposed a tax equal to 2.5 percent of the excess of–
‘(1) the taxpayer’s modified adjusted gross income for the taxable year, over
‘(2) the amount of gross income specified in section 6012(a)(1) with respect to the taxpayer.
‘(b) Limitations-
‘(1) TAX LIMITED TO AVERAGE PREMIUM-
‘(A) IN GENERAL- The tax imposed under subsection (a) with respect to any taxpayer for any taxable year shall not exceed the applicable national average premium for such taxable year.
‘(B) APPLICABLE NATIONAL AVERAGE PREMIUM-
‘(i) IN GENERAL- For purposes of subparagraph (A), the ‘applicable national average premium’ means, with respect to any taxable year, the average premium (as determined by the Secretary, in coordination with the Health Choices Commissioner) for self-only coverage under a basic plan which is offered in a Health Insurance Exchange for the calendar year in which such taxable year begins.
‘(ii) FAILURE TO PROVIDE COVERAGE FOR MORE THAN ONE INDIVIDUAL- In the case of any taxpayer who fails to meet the requirements of subsection (e) with respect to more than one individual during the taxable year, clause (i) shall be applied by substituting ‘family coverage’ for ‘self-only coverage’.
2) PRORATION FOR PART YEAR FAILURES- The tax imposed under subsection (a) with respect to any taxpayer for any taxable year shall not exceed the amount which bears the same ratio to the amount of tax so imposed (determined without regard to this paragraph and after application of paragraph (1)) as–
‘(A) the aggregate periods during such taxable year for which such individual failed to meet the requirements of subsection (d), bears to
‘(B) the entire taxable year.

Why doesn’t Specter know about this part of ObamaCare?  Shouldn’t he have educated himself on the particulars of the “reform” before attempting to defend it in town-hall meetings?  More critically, would Specter commit to opposing a bill that explicitly rejects his stated standard?  If not, why not?

Read the bill, Senator.  Inform yourself rather than spread “disinformation,” or Linda Douglass may have to track you at the White House’s Snitch Central.

Mom, I have come to the conclusion that the liberals really do not know how to love. They see Trig Palin as a mistake, not a warm happy person that spreads joy to all around him.
I live in a blue state and I am a hospice nurse. Recently,
I had a patient whose mom is a big lib who makes a lot of money. The patient’s money was paying for a 24 hour caregiver. All the bitch daughter ever said was “the money is running out.” All I thought was “don’t you have any.” They truly don’t see what one gains from caring for someone else. I remember one day before this woman died she said, “how do you show your mother that you love her.” I did not have the heart to tell her that when my mother got sick and before she passed I took her to my house and the kids and I cared for her. They really lack something. The best thing you can do for Anna is pray for her that someday she may “get it.”

I’m not trying to give Specter any excuses (the man should probably resign), but should we expect a Senator to know specific provisions in a House bill?

Yes we should. It is their job. Consider that they can spend 40 hours a week reading, writing, discussing, speaking on, and voting on legislation. So if they work a full week doing their job, then they should know the bill backwards and forwards.

And that isn’t even mentioning that each Congressman has a full staff of lawyers, etc. to help read/write bills.

Funny, Arlen is the one who said a few weeks ago that “they divide up the bill and read it and make judgements very fast”. Well, apparently not. Someone should tell Sebelius (who defended him at that earlier town hall) that he hasn’t read the bill. But, if I recall correctly, the issue about forcing people to buy into the system was in Hillary’s version of healthcare reform back in Bill’s first term. I can’t imagine why anyone, especially Arlen who has been around forever, would be surprised.

As I tweeted (@raybury) earlier today, this section does not apply if you have a religious objection… provided:

1) Your denomination existed before 1951 (not church X, but offshoot Z of synod Y of church X). Scientology would not count.
2) The goverment RECOGNIZED YOUR CHURCH AND CONFIRMS ITS BELIEFS and thinks it has an adequate social welfare program. The Amish would be an example.
3) You apply for a time-limited waiver to the SSA.

These provisions aren’t new, but previously they only mattered for folks with religious objections to Social Security and Welfare who were also self-employed, a much smaller cohort than those with the same objections who would be charged the 2.5% tax.

(Odd that 2.5% is one-fortieth, same as the zakat.)

Which is why there are only really two moral questions on the topic of abortion:
1. When is the child considered a person, who’s life is protected.
2. What circumstances rise to the level that said life can be take in self defense as justifiable homicide.

(Politically, of course, there is also the question of whether you can be required to pay for the killing if you disagree about those two questions as applied to a specific case)

When I was pregnant 20 years ago, I didn’t have an ultrasound. Insurance woudln’t pay for one unless a problem was suspected. But they do them routinely now, and I think that is a good thing.

That practice alone has opened the eyes of a lot of people.

Ann, you are never going get it. It is a moral issue. There is no difference between the way I feel and the men on this thread. We believe in our hearts that is wrong. It has nothing to do with being a man or a woman.

I have a very comfortable moral framework. It’s personal. It’s been worked out over a lifetime.

And I don’t need you to correct it.

I’ve been thinking about my life, issues, and what’s right and wrong for over 40 years..

What I find insulting, frankly, about both the left and the right?

You seem to imagine that people don’t think about issues.

You dismiss just like the left does.

I’ve had ‘end-of-life counselling’ in private hospitals and from the VA. You get asked to fill out a more-or-less standard “Advanced Directives” form. Do you want extraordinary measures to save you should you be vegatitive? If you slip into a coma, who do you want to make the plug-pulling decision? Anything else you want? I answered, “No dialysis, no ostomies, and when I’m gone everybody should party hearty”. I sure don’t want a beholden-to-0bama bureaucrat involved anywhere in the process. Down with 0bamaCare!! Down with 0bamaism!!!

On a slightly related issue, some here have been talking about birth control. What’s really amazing is that some of the same people who refuse to use bleached toilet paper because of the chemicals involved have no problem pumping themselves full of a synthetic hormone cocktail to avoid the natural consequence of sexual activity. But of course abstinence would be unreasonable.
