California: You owe us taxes on those IOUs

Bruce McQuain calls this the theater of the absurd, but that implies humor and entertainment value. Unfortunately, California’s attempt to get hard cash in taxes based on payments to businesses it made with imaginary money is neither humorous or entertaining.  It does demonstrate the complete disconnect from reality suffered by the state’s political class in Sacramento:

Small businesses that received $682 million in IOUs from the state say California expects them to pay taxes on the worthless scraps of paper, but refuses to accept its own IOUs to pay debts or taxes. The vendors’ federal class action claims the state is trying to balance its budget on their backs.

Lead plaintiff Nancy Baird filled her contract with California to provide embroidered polo shirts to a youth camp run by the National Guard, but never was paid the $27,000 she was owed. She says California “paid” her with an IOU that two banks refused to accept – yet she had to pay California sales tax on the so-called “sale” of the uniforms.

California wants Baird and her colleagues to pay taxes on money she never received.  The state of California hasn’t paid her the money they owe her, but they want her to pay the money she owes them.  In any other situation, a court would laugh this one right out the door, and perhaps the federal court will do so.  Baird would have no chance at all in a state court.

When governments start issuing IOUs instead of actual US currency, they are legitimizing that kind of transaction for themselves.  To give Baird a pile of literally worthless paper and then object to Baird responding in kind is the worst kind of hypocrisy.  Either California’s government deals in scrip, or it doesn’t, but the rules should be the same in either direction.

It’s difficult to think of a more breathtakingly stupid series of actions in government than what we’ve seen in California over the last few months.  This one is practically pathological.

Drawing upon the state of California’s escalating budget deficit, high taxes and strict business regulations, the Nevada Development Authority (NDA) launched an advertising campaign on Friday, August 07, 2009 that seeks to attract business owners to relocate to Southern Nevada. More so than in past years’ campaigns, NDA foresees many California businesses considering relocation due to the state’s current troubles.

The campaign highlights Nevada’s business-friendly attitude and the fact that business owners pay no corporate or personal income tax and have much lower workers’ compensation rates. “Just looking at the numbers, I don’t know why a California business owner would NOT relocate to Southern Nevada,” said Somer Hollingsworth, NDA president and CEO. “Business owners would be able to make more money, hire more employees, and buy more equipment. They could do more with their business in Nevada than they ever could in California.”

The campaign comes on the heels of the California economic crisis in which the state faces a $26.3 billion budget deficit for which lawmakers have not provided a responsible solution and is projected to reach $42 billion over the next year. California has started issuing IOUs for a variety of payments it owes, but banks stopped accepting IOUs after July 17, 2009.

The advertising campaign consists of television commercials and print advertisements that illustrate the contrast between California and Nevada’s business environments. It is supported by publicity, grassroots and viral marketing efforts.

I listened to a couple of car dealers talk on the radio this weekend about how much money they are in the hole for the “cash for clunkers” deal. Evidently, they are responsible for the $3500-$4500 that the “clunker” was worth and have to hold that debt until the government makes restitution on the deal. Many dealers are really strapped for cash and they haven’t been told when/if they are going to get that money from the government. I wonder how many dealers will be going under?

State and federal governments have been so ensconced in their ivory towers that they have even lost touch with the basics of capitalism and currency values. Sad….

The CA budget may not be implemented for some time. The lead Democrat in the Assembly is suing to overturn the Governor’s exercise of his line-item veto power…which case should be laughed out of court, but this is CA, and likely everything will be on hold until the case is dealt with.

In the meantime, SEIU is moving from “persuasion” to “power” and may be striking soon. I am hoping they do. I suspect the response from the people really paying the bill for CA’s governmental insanities at all levels will not be a happy one, and SEIU might find they are less powerful than they think.

To really understand California politics, and the culture that creates it, you have to understand the psychology of the addict/dealer relationship. The addicts will do absolutely anything, including prostituting themselves and selling their children, to keep the flow of drugs coming. And the dealers will lie and manipulate the addicts all day and all night to keep the flow of power and money coming. Taken together, they create a culture so utterly dysfunctional and thoroughly poisonous that in the long run they will end up killing each other.

I have spent several decades on this planet. Gradually I became a Conservative with the arrival of Ronald Reagan. I had a rudimentary knowledge of economics and the rules. My father instilled in me to not spend more money than I earned.
It has been my observation that Democrats always believe in the money fairy. They stubbornly believe that when someone is in power that there is more money available and the powerful one (mostly Republican) is holding out on them. When their guy is in power the powerful one is never confronted, but he also believes there is money somewhere else and someone is holding out on him or her. Liberalism is a mental disease and they try to project it on everyone else that is sane.

It’s not like money is real. Their mistake was giving California real goods and services. They should have printed goods and services chits which California could redeem later after they paid up.

Saves a lot on shipping. In fact just do electronic promise transfers or EPFs. The banks are living on promises right now, so they will understand how to do the bookkeeping

That is pretty much what Obama and the Congress has turned the US dollar into already.

Up here in the boonies we are a little ahead of the curve. We have a barter system starting to catch on and work pretty well. I’ve already been able to trade the rights to the harvest of the hay out of my fields, and winter RV and boat storage in my out buildings, for needed upkeep and upgrades on my property. Also have bartered fall hunting rights for future payment in meat. Saving me cash and tax payments.

I think I even saw John Galt drive by yesterday and wave. He was smiling.

Californians may be reduced to that level soon. I wonder what the elite in Hollywood have left to bargain with when their cash is no good.

Now there is an idea worthy of effort.

Can we get together and have a sort of national tax revolt?

Submit IOU’s in lieu of payment for taxes we owe the feds and the state?

If you have preplanned, normally one should be paying nothing as a refund or getting a very minimal annual refund.

It is your money…pre-planning year by year can save you a bundle. Why should government use your money for a year and then give you back a portion of the principle as a “refund?” Lord knows how many people I know look to April and May as a bonus…the government is sending them money…horray, yippie….BS.

They are sending you back your own money, which they used interest free for a year.

Start either working on your tax obligations to have no or a minimal refund, then start sending IOU’s to the feds and state…see how long that works out for them. In California especially.

That little instructive bit said,

I moved out of the Democratik Republik of Kalifornia in the summer of 2007. I registered my car in the new state and notified the Kalifornia DMV of the transaction. In the summer of 2008 we received a renewal notice from the Kalifornia DMV. We again notified them that the car had been registered in a different state. Well guess what it is now the summer of 2009 and what did I just receive. 3 guesses and only one counts. That’s right a vehicle registration notice from the Kalifornia DMv with an additional wrinkle. I had been turned over to the Kalifornia Franchise Tax board for failing to pay Kalifornia Vehicle taxes with a threat to take my property away under a tax lien. I solved it by having a lawyer get involved. Turns out they knew the vehicle was registered in a different state but ignored what was in their computer system. And to think people what the government to take over our health care system.

It makes me sick that my state has devolved in my lifetime into a corrupt socialist toilet. It was the greatest place growing up years ago
When my surviving parent passes, I am long gone if it stays like this.

It was in California that a burglar was injured by the house occupants during a break in and sued for damages and COLLECTED. It was also in California that Good Samaritans rescuing people in distress were successfully sued for causing injuries. So why not California asking for cash interest on IOUs. It all makes sense if you’re a rang tang ding dong.

The current crop of legislators really have no experience in true government. They think budget reconciliation is an accounting game, where you slip the bill to the next year. Their idea of legislation is to whip up another bill that really impacts life, such as all dogs must be restrain in cars.

Lordy, it just couldn’t get any worse than this idiocy, though.

Exactly. What I have been saying all along. With the drop of 22% in personal tax revenues, and 57% in corporate tax revenues, to the feds the last quarter, due to the recession, a tax revolt would quickly bring the wheels of government to a halt. It would certainly give them something to immediately work on instead of health care.

They could even send the SEIU goons out into the hitherlands to collect. /evil grin

They take from the people producing goods, the government decides what value to assign to those goods, then doesn’t pay them. Meanwhile the government demands tax on the money that wasn’t paid for the goods they took.

It’s not even communism, this is Chicago mob at it’s worst.
