Breaking: Wise Latina now Justice Wise Latina

68-31, with just nine Republicans voting yes. The era of voting based on qualifications is now well and truly dead, having fallen into a coma a few years ago when The One decided he couldn’t vote for Roberts and Alito because they didn’t have big enough hearts or something. The GOP’s going to play his game from now on. Oh well.
All but one of 60 Dems voted for Sotomayor; Sen. Ted Kennedy (D-MA) missed the vote. Ailing Sens. Robert Byrd (D-WV) and Barbara Mikulski (D-MD) appeared on the floor in wheelchairs to vote yes.
Nine GOPers voted for her: Sens. Lamar Alexander (TN), Kit Bond (MO), Susan Collins (ME), Lindsey Graham (SC), Judd Gregg (NH), Dick Lugar (IN), Mel Martínez (FL), Olympia Snowe (ME) and George Voinovich (OH).
The official swearing in is on Saturday. I don’t know what’s left to say at this point after weeks of blather, except maybe that there’s a fair chance of a bona fide Chris Matthews racial leg thrill this afternoon on “Hardball.” He had one just yesterday, in fact, in response to Clinton bringing home those two journalists from North Korea. Can he muster another today or does he need more, er, “recovery time”?

I disagree. This is not to be taken lightly. 1/9th of activist ruling has been secured for at least another generation. There is a strong likelyhood that 1 to 2 more seats will be up in this term alone (JPS is 89, Ginsburg is 76 and in poor health).

Look, she’s not any more concerning than Souter, Breyer, Stevens, Ginsburg, or any other liberal justice to have assumed a spot on SCOTUS.
Does that mean she should have been confirmed? Well, no.
Frankly, it’s not about any “litmus tests” except her willingness to uphold the constitution. But there’s serious concern, especially due to her consistently-questionable private statements, as to whether she can do this. There are over 300 million Americans. This is really the best we can do as a nation? Isn’t there someone who can refrain from ruling us by judicial fiat? Why vote to confirm someone who obviously (despite her damned lies) has a fundamental disagreement over the role of a judge?

Yeah but lets face it. Who here or anywhere for that matter thought she wouldn’t get confirmed? I’m just surprised that so few Republicans voted for her. In my opinion it was a great moment forever lost because every republican could have and should have voted no for no other reason then to solidly and forever cement her appointment to the democrats and BO. It would also have energized the base a bit given the republicans a semblance of balls.

Your quip fails. She is qualified to sit on the Supreme Court.
You will get reversals over the course of a long career. Particularly when you sit on a generally liberal circuit and the court leans toward Consructionism.

17 years as a federal judge might be a qualification, if they came up for annual review.
But they don’t.
The part where the committee rules require at least one minority member to vote to pass the nomination to the whole Senate.

I wish the newest Associate Justice the best and hope she stays close to the Founders’ intent and abides by her testimony to the Senate Judiciary Committee where she rejected the very empathy-standard upon which she was nominated.

Her judicial track record and public staements indicate she has no such affinity for the Founders’ intent. And her testimony before the committee was nothing more than a dog and pony show where she said all the right things. The Constitution is not held in high regard by this justice.

I think sometimes we forget who the real villain in this piece is…
It’s the guy who used a rare opportunity to make an impact on the future of jurisprudence in this country… to pander for votes and support for himself. He didn’t pick the most brilliant legal mind available to him. He made his selection based on race and gender. And stuck us with a mediocre judge in the process. He didn’t serve you and me. He didn’t even serve Sonia Sotomayor. He served HIMSELF.
La Raza will celebrate and they’ll bring him their votes. And afterall, in the Age of Obama what’s BEST for America isn’t the point. It’s what’s BEST for Obama first, and for the Socialist Democrat Party next.
