Breaking: Wise Latina now Justice Wise Latina

68-31, with just nine Republicans voting yes. The era of voting based on qualifications is now well and truly dead, having fallen into a coma a few years ago when The One decided he couldn’t vote for Roberts and Alito because they didn’t have big enough hearts or something. The GOP’s going to play his game from now on. Oh well.

All but one of 60 Dems voted for Sotomayor; Sen. Ted Kennedy (D-MA) missed the vote. Ailing Sens. Robert Byrd (D-WV) and Barbara Mikulski (D-MD) appeared on the floor in wheelchairs to vote yes.

Nine GOPers voted for her: Sens. Lamar Alexander (TN), Kit Bond (MO), Susan Collins (ME), Lindsey Graham (SC), Judd Gregg (NH), Dick Lugar (IN), Mel Martínez (FL), Olympia Snowe (ME) and George Voinovich (OH).

The official swearing in is on Saturday. I don’t know what’s left to say at this point after weeks of blather, except maybe that there’s a fair chance of a bona fide Chris Matthews racial leg thrill this afternoon on “Hardball.” He had one just yesterday, in fact, in response to Clinton bringing home those two journalists from North Korea. Can he muster another today or does he need more, er, “recovery time”?

Update: Just to make it a little more painful for conservatives, Stuart Smalley did the honors.

I don’t know how it works, deciding who “does the honors” like that, but Franken HAD to be on purpose fr that very reason.

Anyway, I’m not surprised. From the get-go, I knew she’d be confirmed. Sure…her qualifications are minimal at best. At worst, she’s a racist.

But there are dozens or more farther Left judges whom Obama could have thrown in there. And with the Dem majority, they’d have gotten it.

Still in surprise over McCain and Graham going in opposite votes.

As far as professional qualifications go, hasn’t she been a judge for a long time? I didn’t think her professional qualifications were in question.

What qualifications are those? Oh right. She was a lawyer. Then a politician appointed her a judge, and her local Senator didn’t object (big hurdle). Then as a federal judge she was not arrested for robbing an armored car in broad daylight. When she was named as appellate judge, not enough Senators complained. Since then, she didn’t hijack an airplane. And she was liberal enough for the ABA to love her.

Nothing I have seen or read gives me any reason to believe that she has the grasp of the constitution and the law that is necessary to be anything more than just an “oh yeah…I agree with that group of justices” type of justice.

I’m sure she won’t be the worst justice of all time….but, it’s doubtful she’ll ever rise beyond mediocrity.

I could send a 5-year-old in, tell her which way to vote, and it would be a decision with the same intellectual rigor with which Sotomayor will render all of her decisions. Wise my ass. But what does voting “no” do? One thing it does is allow the MSM to demagogue the GOP as hating Hispanics (even though the “no” vote isn’t legitimate evidence of that). Since we don’t have good connections in the Hispanic media, we’re especially vulnerable to that sort of thing.

The one thing a “no” vote will NOT do is result in the appointment of a more moderate candidate. The only time that a torpedoed Supreme Court nominee was replaced by one with a different ideology was Robert Bork. Obama’s “short list” candidates were all extremely liberal; Sotomayor was, in all candor, probably the least dangerous of the lot. If you sank Sotomayor, you would not get a “squishy” centrist candidate as a replacement. Instead, you’d get a hard-left liberal like Elena Kagan who lacked the track record needed to prove up her liberalism.

There is a solid case to be made that Sotomayor possesses the required objective qualifications to be a Justice. She’s well-educated and has a low reversal rate as a Circuit Judge in a well-respected judicial circuit. The two big “strikes” against her were Ricci and her intemperate extra-judicial comments. Yes, she’s very liberal, but elections have consequences.

I tend to agree. I think it’s hilarious to listen to the punditry on both sides hash and rehash liberal or conservative talking points on cases, findings, rulings, etc. Every mind is not a legal mind. Most people simply regurgitate what they’ve heard or read about a small number of cases.

SCOTUS Justices were not always cut from the best cloth. There is no tradition being broken here.

Yeah, I can see where that fits in hear. Honestly, I haven’t been following this too closely — I haven’t actually gone and looked at her record, and I don’t really have the skills to determine for myself her level of experience or how competent she has been as a judge. I have heard both that she is a lazy writer and a solid writer, that she has been frequently overturned and that she has been overturned less than average.

She’s going to look like crap in that long, black robe they wear. She looks like a cleaning lady in her finest garbs. Hope she learns to comb her hair better. She could stand to lose a few pounds too. Hey, if they’re stupid at least they could be restful on the eyes. She’s a train wreck.
