Glenn Beck: Cash For Clunkers may be a government scheme to take over your computer

Why the feds would target something this supposedly nefarious at a tiny niche of people who want to trade in their gas-guzzlers is as unclear to me as why they’d tell you they’re doing it instead of doing it surreptitiously, as would be the case if GB’s allusion to Nazism near the beginning were accurate. I’m looking forward to hearing more on Monday, though, especially from Guilfoyle about how agreeing to the website’s terms of use grants the state a perfectly legal license to do whatever it wants with your computer. I’m reasonably sure there would be Fourth Amendment and Fourteenth Amendment complications there, but we’ll see. As for the terms of use themselves, any techies willing and able to enlighten about how unorthodox this sort of thing is? I’m guessing that some moron government lawyer somewhere was trying to deter hacking and either drafted the language overbroadly or adapted it from some private site without thinking how it would read coming from a .gov domain. Given that the cost in bad press will grossly outweigh whatever benefit they’ll get from checking out your digital porn collection, it’s almost impossible to believe that this is what it looks like. But like I say, we’ll see.

On a more serious note, C4C is getting a new fuel injection of $2 billion assuming that the Senate okays it next week. Minor footnotes: The program really won’t do that much to help carmakers; the carmarkers it does help are more likely to be foreign than American; and the many, many market inefficiencies it might cause makes it practically a textbook illustration of what’s wrong with Obamanomics. But other than that, it handles like a dream.

Update: Reader Skywise offers a possible explanation for the C4C terms of use. He’s probably right, although the website should have been a lot clearer about the purpose.

That isn’t even necessarily true. Unless you have your browser security set to the most permissive settings, the government would almost have to do something illegal to install something on your machine without your knowledge.

Skywise on you make a good point. But, things like this happen all the time in big gov’t. They pass laws that conflict with other laws. Such as the 16th Amendment conflicting with Art 1 sect 8/9. This does not make it right. It does make it unconstitutional.

We have next-to-no knowledge on the situation Beck is talking about. All we know is that one of the very concerned people he spoke with has a JD and long experience in the legal system. The other person offering an explanation is an anonymous blog commenter. I’m not going to dismiss or diminish what Beck’s saying because the latter disagrees with the former.

Don’t get me wrong… I don’t disagree with Beck’s fears or basic reasoning for bringing this up… I just wish he’d say “they will” or “they can now” do violations of the constitution to search your computer for pr0n and password files instead of “they HAVE”.

Also, IANAL… I’m just making a common sense logical guess as to why the government would have to treat your computer as one of its own. Obama doesn’t HAVE to sneak into your computer… he’s doing just fine stealing our liberties right in front of us… like taking control of Wall Street salaries.

One more thing: The intent at the moment doesn’t matter. It’s what can be done with the power.

There was one episode of The West Wing that I loved. The WH was helping Belarus write its constitution, and the Belarusian delegates were trying to give their beloved leader a whole bunch of power because he’s a great man who would never abuse it.

They had to explain to the delegation that it’s not a matter of what the one individual would do. The Constitution isn’t based on what one individual would or wouldn’t do. It’s based on what the next 10 or 20 unknown individuals might do.

You don’t give government the power it can abuse so easily and secretly.

There’s an excellent 2 DVD series from the BBC titled “The Nazis.” It is available from Netflix so I am sure it will be available in most places you can rent movies. I highly recommend you rent it and watch it. I have read many, many books and bio on the Nazis and WWII in general but that series gave a perspective on several important factors that I have never read elsewhere and/or they found a way to communicate it better so that became clear for me. You might find it very educational.

You can’t teach a person something they think they already know.

If you want to learn, never assume you know all you need to know or that what you know is 100% correct.

A government that would demand the forced destruction of good running cars is certainly capable of thinking your PC now belongs to the state.
Why?? Some dwit trades a perfectly good BMW and the law says it must be destroyed. Destroyed!?

Trust me… I’m from Indiana… about 30 years ago they built a domed stadium to lure the Colts away from Baltimore. To finance it, they enacted a 1% entertainment tax inside the city. Pissed EVERYBODY off. So they changed the law and said to read “As soon as the stadium paid off, the tax will be sunsetted”. This calmed everyone down and it passed.

30 years later, they tore down the Hoosier/RCA dome to make way for the new stadium. To do this they needed to enact ANOTHER 1% entertainment tax above and beyond the existing 1% tax to pay for the new stadium.

Why were we still paying the first tax? Well, turns out the government kept refinancing the Hoosier Dome. It’s still not paid off.

And it doesn’t exist anymore…

Nope, because you have already agreed to it. Say you agree to it, then later the government puts a script on its pages that if you have this cookie or what have you that says you agreed to the boilerplate from before, then they can install anything they want. I write install scripts all the time that are silent and require no conformation so I can push updates and programs at work so I dont have to interrupt someones work just to install a new version of quicktime or whatever.

But regardless of whose computer it is, there are only so many ways to install software via a browser. So long as a person has sane security settings on their browser (which most do), all of those ways will either require explicit user consent to install (as in “The website foo wants to install ActiveX Control “Bar” on your computer. Accept?”) or will require subversive means which are almost certainly illegal when done by the federal government even on their own computers.

I don’t KNOW that it is illegal, but it almost certainly is.

In either case, Beck should have toned down his rhetoric, and the government website should have spend an extra couple of sentences explaining themselves.

More seriously, the part of the site that Glenn was on appears to only be for car dealers, not the general public. I assume that the Feds consider the dealers as federal sub-contractor, since they are doing business on behalf of the federal govt in respects to the C4C program. I wonder, do other federal contractors, or sub-contractors, have to deal with the same sort of language and requirements when accessing government websites to transact business? Is this standard, or just funky language that applies only to the C4C program?

Some of you desperately need to read Liberal Fascism, and other books of that nature (on the history of progressivism). Beck’s comparisons of Leftists like Obama to Fascism stems directly from that insight. And every time I’ve seen him, any time he makes the (accurate) parallels he substantiates them to the extreme. Don’t compare him to a smear merchant like Olbermann, that’s just ignorant and pathetic.

Who’s the crazy one, someone like Beck who warns us about what’s (at the very least potentially) going on, or those who refuse to acknowledge it as our country is destroyed from within?

His basic sentiments were anarchist, but he recognized that anarchism doesn’t work very well. I have been a tech for 14 years now. I know how this works, and you can easily bypass the standard settings without any notifications. 99% of people leave their browser settings to default. How do you think things spread so quickly?

No doubt they’re planning on cap-and-trade and Obamacare having a significant web piece where most Americans will need to log on and accept those conditions. Assuming you have reasonable, normal security settings, the government can’t get IN to your computer unless you give them permission or do something very silly or click on crap you shouldn’t be clicking on (which is why most people get viruses, etc.). Simply clicking on a consent form doesn’t make them magically able to access your computer.

Browser security settings would have to be WAY “below” default for a flash mouseover to give you something. WAAAAAY below, and I’m assuming that’s even possible. Do you actually know of that happening? I don’t think flash is able to access the client without permission.

Which ID are we talking about? Your IP address provided by your internet provider? The MAC address of your computer’s network card? The product ID of your copy of Windows?

By the way, if you format your computer to reinstall the operating system, that’s not government secure. You would want to get hold of a program that will write random 1s and 0s to your hard drive during a low-level format, to corrupt any lingering information that could be recovered. Such a thing is included in many multi-part utility programs like Norton Utilities.

Or, buy a new hard drive, and take your pick with the old one:

1. Shotgun
2. Train tracks
3. Thermite
4. Hydraulic press
5. Drill a hole, pour in sand, plug in

Baring stuff like stealth rootkits, a clean install usually works. If you are extremely paranoid, you can use your drive manufactures utility disk to zero out your drive (7 times should prevent anyone from recovering any data, if that is your desire). The problem with a stealth rootkit is they hide in the MBR and can still be there if you just reformat the partition.

I drive a so called “cluncker” a ’91 Honda Accord. If this program crushes all clunckers – the program specifies that no parts are to be salvaged (except the motor that is shipped to China) What will I do for parts when mine need to be replaced? What if the multiple attempts, site crashing was simply allowing access to your information and address books and recording of such?

I prefer to error on the side of caution with Obama and Co. Everything Pinnochio has done seems to be to the detriment of society as we know it. From dissing our allies to cozying up to our enemies from private sector takeovers to a HealthScare Bill that would nationalize medical care.
