Glenn Beck: Cash For Clunkers may be a government scheme to take over your computer

posted at 7:46 pm on July 31, 2009 by Allahpundit

Why the feds would target something this supposedly nefarious at a tiny niche of people who want to trade in their gas-guzzlers is as unclear to me as why they’d tell you they’re doing it instead of doing it surreptitiously, as would be the case if GB’s allusion to Nazism near the beginning were accurate. I’m looking forward to hearing more on Monday, though, especially from Guilfoyle about how agreeing to the website’s terms of use grants the state a perfectly legal license to do whatever it wants with your computer. I’m reasonably sure there would be Fourth Amendment and Fourteenth Amendment complications there, but we’ll see. As for the terms of use themselves, any techies willing and able to enlighten about how unorthodox this sort of thing is? I’m guessing that some moron government lawyer somewhere was trying to deter hacking and either drafted the language overbroadly or adapted it from some private site without thinking how it would read coming from a .gov domain. Given that the cost in bad press will grossly outweigh whatever benefit they’ll get from checking out your digital porn collection, it’s almost impossible to believe that this is what it looks like. But like I say, we’ll see.

On a more serious note, C4C is getting a new fuel injection of $2 billion assuming that the Senate okays it next week. Minor footnotes: The program really won’t do that much to help carmakers; the carmarkers it does help are more likely to be foreign than American; and the many, many market inefficiencies it might cause makes it practically a textbook illustration of what’s wrong with Obamanomics. But other than that, it handles like a dream.

Update: Reader Skywise offers a possible explanation for the C4C terms of use. He’s probably right, although the website should have been a lot clearer about the purpose.

Look Obama is a disaster, and he’s wrecking this country. But the comparisons to Hitler are stupid.

therightwinger on August 1, 2009 at 12:05 AM

People have got to wake up about this administration. Their policies aren’t “failing”, they’re working exactly as planned (remains to be seen if they get Obamacare and Cap and tax. People need to realize what evil SOBs these people are.

I’m reasonably sure there would be Fourth Amendment and Fourteenth Amendment complications there, but we’ll see.

Oh yeah, because Obama is just so concerned about the constitution. Have you been paying attention?

Actually, a lot of people do just that. They run linux from a DVD or run a virtual machine.

BTW – There is technology available that will let the govt turn on onstar or let anyone who compromises your phone to listen to you even if your phone is off. The onstar thing was how they busted Gotti I believe.

You must be a techno god, DaveS, because 99% of the users I encounter in my daily environment (a Midwestern university) still manage to get infected with multiple layers of security (I myself have 6 not including NoScript and ABP).

Wolftech on July 31, 2009 at 9:47 PM

I’ve found one thing that works with XP is to run as a limited user. I hardly ever see users who do that get infected.

The “federal” government’s “Cash for Clunkers” program is constitutionally through the looking glass, no matter what the terms of use for the website. Allahpundit, you don’t have to do the Bill-of-Rights grunt work; you have people to do that for you. But the enumerated powers of the Congress have become like an unexplored continent. You would doing the Republic, what’s left of it, a real service if you learned your way around the enumerated powers and then gave your readers a tour.

Ideally that would be perfect, but you have faculty (and staff) that insist on being administrators and they just HAVE to be able to install that new game or neat software (you would be surprised how many hours faculty waste on solitaire, too. We can track usage of it through BigFix :D ) Such is life of the IT guy in academia.

I applauded him on this site when he did the FEMA debunking. All I’m saying is, if you’re going to toss out an especially outlandish accusation, it’s best to have your ducks in a row before making it.

“Cash for Clunkers” is not a new program:

The original program was the bill we call “Porkulus”…
the “Clunkers” (aka “Tax Guzzlers”) are the Congressweasels who voted for it.

We’re trading ours in at the first opportunity.

Just answered my own question about whether it’s consumers or dealers who would be at risk: dealers’ computers.

Ordinary consumers wouldn’t encounter this warning, but the information contained in the dealer’s computers might include theirs.

From:

http://newsbusters.org/blogs/jeff-poor/2009/07/31/beck-exposes-cash-clunkers-language-giving-feds-authority-take-control-co

I didn’t listen to/read that last night…jumped the gun (as is my MO) and apologize. Still creepy though…

I keep thinking, these are mini bailouts. These car companies and even individuals are accepting federal help. There would necessarily be strings attached.

Wolftech – You have TONS of sympathy from me. I used to run an IT department for a college. We had some users I called “Propellor Heads” who were exactly as you described.

We dealt with a lot of little people with big egos in little jobs. I was always wondering why my female boss would always support this one arrogant pain in the butt professor. It was clear when I walked in on him banging her in my computer room.

Anyway, keep a diary and write a book later on.

Skywise on July 31, 2009 at 8:02 PM,

I call BS on your supposition. The govt trades information with third parties all the time. Examples –

* IRS providing the most private of information, your 1040 data, to debt collectors.
* The entire Medicare system is a trade of data between the hospital(s) and the govt and other third parties.
* Hell the entire NSA surveillance system breaks your proposal. NSA, 4 Telcos, private data mining firms all in one ball of wax.

The government is prohibited from TRADING INFORMATION WITHIN ITSELF. Which blows the primary thrust of your proposal. For declaring your computer a govt computer means they can’t trade data with other departments. The whole deal with the screen is a poorly written piece of text by some harried lawyer who was full of themselves.

Mommypundit on August 1, 2009 at 10:09 AM

This is scary, however, if most people read the terms of use of web based services they’d find other disturbing invasions of privacy. For example, what percentage of Gmail users know that Google reads/scans the BODY of each email you send and receive through Gmail to push advertising/sponsored links to you when you use ANY Google service. The terms of service for Google-Yahoo-MSN-Twitter-Facebook are written in a manner that gives very broad use of info that most people would consider private.

Except for the fact that congress has already established a law for two of your examples. IE, The IRS is legally approved to share such data as part of its job, same with Medicare they have explicit congressional approval.

You’re right about the NSA though. It’s military and can’t share its data with the civilian side of the government.
But I’d point out that this is NOT a military app nor run by the military.

Every other way they ran the government is being copied by Obama and the radical lefts in congress. If you don’t like the analogy of the Nazis, Fascist Italy works just as well.

I do not have the time at the moment to read all five pages on this, but I did read what everyone said on the first and last page. I for one will be tuning in on Monday to see what Beck has to say. Which is probably why Beck did not go further on the story. Ratings AP, it is all about ratings in the end. Leave a cliffhanger, and folks will tune in.

Beck can be a loon, but so far most of the lunatic stuff he has gone off on, well it for the most part has been right. I am going to give him the benefit of the doubt on this one, and wait to see the rest of what he has found out. It certainly is not going to harm anyone to pay attention to this mess just in case he is correct.

As to whether of not there is any validity to this, I look at the types of people he has appointed to be czars, what all is in the Crap & Tax as far as government telling me what my thermostat is on, what type of light bulbs I can use, etc. And then there is the entire Death Care Bill which will tell me how long I can live, whether or not I can receive certain medical treatments, etc.

Recently, in preparation to send off the yutes to college this fall, we discovered info in a House bill which clearly indicates Obama is taking over ALL student loan entities. And I mean ALL. Heritage has info which says, next year college bound yutes will be screened by the federal government as to whether or not they should be allowed to attend college. One factor which would allow you to attend college would be if you joined Ameri-Corp. Seems like this control thing has a bit of merit to me.

To be fair to President Chutes&Ladders, Bush and the Patriot Act also took things a bit to far when it comes to the rights of the American people; there is some very scary stuff in the Patriot Act. But Obama is one dude who appears to have an ax to grind against certain Americans, and I for one would not put it past him, or his gang of Chicago thugs, to do just what Beck says regarding taking over our private info on our computers.

Sleeping with one eye open with this current government is a really good idea!

How about taking the government to task for what they actually say? The web site actually states that your computer “…is property by the U.S. Government [and can do whatever they want with it if you press continue].”, The language is so strong that it can’t possibly be interpreted any other way.

threeCents on August 2, 2009 at 8:39 AM

Hey let’s pretend there is no BIG BROTHER pattern here…..and said pattern would only be considered nefarious if Bussssh were still in office.

Agreeing to the website’s terms of use grants the state a perfectly legal license to do whatever it wants with your computer.

Pg 22 of the HC Bill MANDATES the Government will audit the books of ALL EMPLOYERS that self insure!

Pg 241 Line 6-8 HC Bill – Doctors, it does not matter what specialty you have, you’ll all be paid the same.

Page 280 Sec 1151 The government will penalize hospitals for what government deems preventable readmissions (Incentives for hospital to not treat and release).

Pg 317 L 13-20 PROHIBITION on ownership/investment. Government tells Doctors what/how much they can own.

Pg 354 Sec 1177 – Government will RESTRICT enrollment of special needs people!

Pg 425 Lines 17-19 Government will instruct and consult regarding living wills, durable powers of attorney. Mandatory!

Pg 425 Lines 22-25, 426 Lines 1-3 Government provides approved list of end of life resources, guiding you in death.

Pg 427 Lines 15-24 Government mandates program for orders for end of life. The government has a say in how your life ends.

Pg 429 Lines 10-12 “adv. care consultation” may include an ORDER for end of life plans. AN ORDER from Government.

Pg 429 Lines 13-25 – The government will specify which doctors can write an end of life order. PAGING DR. KEVORKIAN!!! PLEASE ATTEND TO PATIENT IN ROOM 211. STAT!!!

Pg 489 Sec 1308 The government will cover Marriage and Family therapy. They will insert government into your marriage.

Pg 494-498 Government will cover Mental Health Services including defining, creating, rationing those services.

PG 502 Sec 1181 Center for Comparative Effectiveness Research Established. – Hello Big Brother – Literally.

Pg 503 Lines 13-19 Government will build registries and data networks from YOUR electronic medical records.

Pg 503 lines 21-25 Government may secure data directly from any department or agency of the U.S., including your data.

Pg 504 Lines 6-10 The “Center” will collect data both published and unpublished (that means public and your private info).

PG 506 Lines 19-21 The Center will recommend policies that would allow for public access of data.

PG 624 “Quality” measures shall be designed to assess outcomes and functional status of patients.

PG 624 “Quality” measures shall be designed to profile you including race, age, gender, place of residence, etc.

PG 660-671 Doctors in Residency – Government will tell you where your residency will be, thus where you’ll live.

Pg 735 lines 16-25 For law enforcement, proposes the Secretary-HHS will give Attorney General access to ALL data.

Pg 769 3-5 Nurse Home Visit Services – “increasing birth intervals between pregnancies.” Government ABORTIONS anyone?

Pg 770 SEC 1714 Federal Government mandates eligibility for State Family Planning Services. Abortion and State Sovereign.

Pg 789-797 Government will set, mandate drug prices, controlling which drugs brought to market. Bye innovation.

Pg 810 SEC. 1759. Billing Agents, clearinghouses, etc. req. to register. Government takes over private payment system.

Pg 820-824 Sec 1801 Government will identify individuals ineligible for subsidies. Will access all personal financial information.

Pg 838-840 Government will design and implement Home Visitation Program for families with young kids and families expecting kids.

PG 844-845 This Home Visitation Program includes government coming into your house and telling you how to parent!?

PG 993 Government will establish school based health clinics. Your kids won’t have a chance.

PG 994 School Based Health Clinic will be integrated into the school environment. Say government brainwash!

PG 1001 The government will establish a National Medical Device Registry. Will you be tracked?

If space were no problem here is where I could add another 25-30 elements of the cap and tax plan. Yup no evidence of BIG BROTHER spread under this new administration. Besides, a site for dealers isn’t a big deal. Lets wait until the day we wake up and find government requires policies loke this in everything we do. Then there should be at least a hand full of Pavlov’s dog who refuse to take it and raise hell.
