Another deadline missed: Obama’s Gitmo task force won’t report on time tomorrow; Update: Delayed six months

They “misread” how bad the economy was, they “misread” how recalcitrant Iran would be, and now evidently they’ve “misread” how complex the legal situation is at Gitmo and how difficult it is to persuade other countries to take detainees. I’m tempted to accuse them of not having misread anything but rather of having lied brazenly on the trail to raise voters’ expectations unrealistically of how easy governance by Hopenchange would be. But quite frankly, I like their explanation better. Good work, rookie.
The one thing they do seem to have settled on: Indefinite detention without trial is a go.
The task force, set up on Obama’s second day in office, was charged with preparing a report to the president by Tuesday, July 21 outlining a long term detention plan for detainees captured in counter terrorism operations after Sept. 11. But continued debate within the task force over the legal basis for holding detainees who are not charged with any crimes—and where to house them once they are moved from Guantanamo—has forced the task force to postpone its report by a “few months,” a senior administration official told Newsweek.
A separate task force report on interrogations—also due this week—is being put off as well, said the official, who, like others quoted in this article, asked not to be named talking about private deliberations…
Three administration officials familiar with the process said the detention task force, which is jointly run by aieds to Attorney General Eric Holder and Defense Secretary Robert Gates, did agree that the Obama administration should continue to claim the right to hold some Guantanamo inmates indefinitely as “combatants” under the “laws of war,” without charging them either in criminal courts or in military commissions. That proposal is sure to prove controversial among human rights groups, which say any such “indefinite detention” violates civil liberties and is virtually indistinguishable from legal claims made by President Bush.
The One can credibly blame Bush for the legal problems with detainees for years into the future, which should help cushion the blow for the left when he inevitably announces he won’t be able to close Gitmo in January like he promised. (As of this writing, they’re, ahem, still on track.) Plus, look on the bright side — at least this report is being delayed because it deals with difficult issues and not, as with the overdue budget report, because The One is cowering at the repercussions once it’s released and voters see how badly he’s failed. If only he were as cautious and diligent about, oh, say, the future of American health care.
Update: As for that task force on interrogations, don’t forget about the “classified loophole.” I sure haven’t!

Six months after President Barack Obama signed the closure order, fewer than 20 of about 245 inmates have been transferred out of the U.S. military base in Cuba. Currently, there are 229 detainees at Guantanamo, and the administration, by its own clock, has six months more to remove them.
Gitmo’s supposed to close in six months. They’re delaying the report on what to do with the prisoners until … the current prison closes?

I’m not surprised. On a strictly business-like model, why should the Obama Admin be on time with anything? He and most of his Kommissars have never run a business – Obama’s never run so much as a lemonade stand. Why should they be prompt with reports – they’ve never had to be while grazing in the groves of academe.
They’re in the business of taking and redistributing other people’s momey – not earning it and spending it wisely. It shows in their amateur-hour OJT across the administrative spectrum. Obama thought that being President would be like a big Annenberg Project and he treats his Presidential role as the same. That they couldn’t profitably run an ice dispensing machine in Death Valley fazes them not in the least.

229 detainees in 5 months, roughly 50 per month, more than one per day must be moved to meet his artificial deadline.
It’s not going to happen. I can’t wait to hear his explanation, but by then he may just let Gibbs read a release to the WH press corps.

Let us suppose that this report is likely to say that Gitmo is a well run professional operation and there is no abuse of prisoners. Such a positive report will provide support for the argument that Gitmo should remain open. If one releases it now the report can be used to argue that Gitmo should remain open. If it is released after Gitmo is closed then the issue is moot.

On the other hand, let’s suppose that this report will likely harshly criticize the way that Gitmo is run and report that there is abuse of prisoners. Such a negative report will provide support for the argument that Gitmo should be closed immediately. If one releases it now the report can be used to argue that Gitmo should closed immediately. If it is released after Gitmo is closed then that issue is moot.

So what would an unprincipled manipulative politician do if:
1)- He wanted Gitmo closed,
and
2) – The report on Gitmo is likely to be rather positive?

It’s been very similar. Barry has once again been placed in a role for which he had no qualifications, where he has once again squandered an enormous amount of other people’s money, and once again has absolutely nothing to show for it.
It’s almost been amusing to watch all his failures, especially since he was boasting just a few months ago about how he likes being president and how “it turns out that I’m very good at it.” Hahahaha, Barry. You’re only good at it in some alternate universe where up is down and utter and complete failure is smashing success.

The detention facilities at the Guantanamo Naval Station will close only after the threat of stateless Islamic jihad against Americans overseas is completely and totally finished, and those who are not likely to be paroled will find their Geneva “rights” fully and completely applied.
All the other alternatives:
– releasing them to their home countries…will not work. They merely go back to their former careers as terrorists or they find the welcoming arms of their home nation to be a six by four cell or worse. Or their home countries don’t want them…period.
– Bringing them to US prisons on US soil…habeas corpus applies, and they will be released by the federal courts for lack of evidence or jurisdiction.
– holding trials on US soil…habeas corpus applies.
– holding them in US prisons without access to their “rights” as landed immigrants on US soil would be a gross violation o the Constitution, and set a precedent that would have unforeseen consequences in later years…perhaps for American citizens.
Johnson v. Eisntrager (USSC 1950) still applies. US courts have no jurisdiction for armed hostile foreign nationals who have engaged in stateless military actions against US persons while not on US soil.
