Wise Latina wise enough for three GOP yes votes so far

McConnell, Bunning, Inhofe, and Roberts say no but Snowe, Lugar, and Martinez say yes oh yes. I predicted 75 yays; how’s that shaping up so far? Kennedy and Byrd are out sick, so with every other Democrat plus the three committed Republicans voting yes, we’re at 61. Graham is almost certainly a yes, so that’s 62. Maverick and Kay Bailey Hutchison are both running in states with huge Latino populations next year and Cornyn, as head of the NRSC, is now a party spokesman and can’t risk being seen as, ahem, “intolerant,” so there’s 65. Grassley, Collins, and Voinovich are reliable RINOs, which makes 68. Ensign might be eager to extend an olive branch to the Democrats given his troubles of late, so he’s, er, 69. Gregg, Hatch, and Kyl will probably hold true to their “statesmen” personas and give the new president the benefit of the doubt, which gets us to 72. Toss in a few wild cards — Murkowski, maybe, and possibly even Jeff Sessions to position himself as a “reasonable” minority leader on the Judiciary Committee ahead of The One’s next nomination — and we’re right there. In fact, when I made this prediction, I’d forgotten that Teddy and the Kleagle aren’t voting these days and assumed Sotomayor already had 60 votes banked. If that were true, we’d already be past 75.
Elsewhere, Byron York calls the GOP’s efforts during the hearing a failure. Eh. I think it was a victory strategically, for reasons DrewM explains:
First, they got Obama’s own nominee to disagree with his ‘empathy’ standard. No, she doesn’t mean it but it will make for some nice issue adds in the future.
Second, the nominee of the most liberal President ever, in a Senate with 60 Democrats still felt compelled to parrot the conservative view of judicial philosophy. That shows the power of the issue and how deeply unpopular the liberals know they are in this area. Yeah, that’s dangerously close to a useless moral victory but it shows the impact 20+ years of harping on this issue has had. It’s a long game and we are winning with the voters.
Control of the language is important and dispiriting the liberal legal community is simply delicious.
It’s more than a moral victory. Throwing a tantrum over Sotomayor would have been pointless, not only because she’s a lock given the current make-up of the Senate but because she’s never been known as a liberal firebrand from the bench. The smart way to play it was they played it: Not crying wolf over someone who’s never been a bombthrower but getting her to pay lip service over and over again to a Roberts-esque form of judicial conservatism, which they can use as a bludgeon if the next nominee is, in fact, a firebrand. It’s none too persuasive to tell a Democratic nominee that they’re out of the mainstream vis-a-vis Scalia, but if they’re out of the mainstream compared to The One’s own first pick for the Court? Rhetorical gold.

I see her 250 word rulings put up against a heavily argued, robust ruling from either of those three. She will look like the lightweight we all know her to be. Why are Latinos and Asians entitled to Affirmative Action? Did I miss their slavery and discrimination history? And where did I hear about this?
I read about it in a Dartmouth letter where it crowed that 40% of the entering class was minority (correct me if I am wrong.). Then they commenced (excuse the pun) to ask us oppressors for donations. I tossed it so fast that I could be wrong.

I think they probably figured there was no way to stop it, so just get it over with. No doubt if they did manage to stop her, the next one would probably be even worse.
The interesting thing is that back when Ginsburg was nominated she got strong bipartisan support in spite of her background. Maybe I just was not paying as much attention back then, but it does not seem like it was all that unusual for the vote to go that way back then.

She served on the board of a legal defense fund that compared abortions not subsidized by the federal government to slavery. She’s Obama’s girl all the way. I agree that it is a plus that they were able to get her to renounce empathy, “explain” her statements so unconvincingly etc. I also agree there’s not a lot to gain by a petulant “No!” battle at this point.
Would’ve been nice if several of the GOP senators hadn’t put down their weapons before the battle was even engaged, though. It appears that the wise Latina is an intellectual lightweight at this league, but still a liberal demagogue and still dangerous for the rule of law. FWIW.

Republican Senators from states with large Latino populations didn’t want to get labeled as being anti-Hispanic, but they did ask pointed questions about whether Sotomayor could apply the law equally regardless of ethnicity. Her answers were evasive and in contradiction to her previous statements, but she didn’t say anything in the hearings to disqualify herself, so some Senators could take her at her (new) word.
Another point that the Republican questioners might have scored is that if a Democrat President will nominate someone whose commitment to judicial fairness is questionable, the voters might want to replace the President and some of the Senators needed to confirm the next nominee with Republicans.

And there’s the major difference between Dems and Repubs. Dem senators with large Latino populations had no problem voting against Miguel Estrada for the Appellate Court–in fact they filibustered him seven times. Emails/memos even turned up saying they had to stop his nomination because he was Hispanic and probably headed to the Supreme Court!
This difference is a key to why they run the government.

The dems have a majority so the repubs should have voted no just so we could be entertained with the dems scrambling to make sure they had the votes. At the very least it may have shown that there are two parties that think differently and support their base. Right now I don’t see a difference worth mentioning. Yeah I know some of the repubs claim conservative principles but when the rubber meets the road they travel the same path as the dems.

Uh, you’re question begging. A vote is not something made to accomplish something. You vote to express your will in a matter. In other words, all no votes are “protest” votes.
You don’t vote yes for something because it’s inevitable. And you don’t refrain from voting no for that reason, either. You vote yea or nay because you either think something should be done or shouldn’t. Anything else is dishonest.

This vote will be very revealing of the continuing putrid state of the Republican Party by showing that they are incapable of standing on principles even after losing power. Maybe this will lay to rest once and for all the mistaken notion that the opposite of Democrat is Republican. Two sides of the same coin is more like it.
The problem is that our two parties have become like a shop selling 29 flavors of ice cream – all vanilla. In the absence of any real philosophical differences or intellectual choice, perhaps it would be best to euthanize the senescent members of weaker party at the ballot box – in this case the Republicans – in the hope that clearing the current cast of zombies and their staffs from the halls of Congress would clear the way for some vigorous and revitalized challengers to the dominant,and dangerous collectivist Democrats.

The GOP has none, nor will it any time soon. Our senators are fixated on their own personal fortunes, our congressmen are scattered and leaderless, and our governors are busy getting shtupped by wise Latinas.

I think that Sotomayor is now aware, if she wasn’t before, of her limitations. AA at Harvard may not have done her any favors.
There are too many things in her personal life that she really can’t have publicly discussed (the PRLDEF cases are probably a goldmine), and she seems to have difficulty debating equals. She didn’t handle the “wise latina” question well, and her English is either not up to judicial standards, or falls apart when she’s stressed. I doubt she will want any of her opinions published.
I think that Sotomayor might retire, due to health reasons, in about a year. Who will replace her?
2010 looks very important.

I don’t want to argue about this. The way I see it, she’s the best we could have hoped for from Obama and to vote against her doesn’t help anything.
And I find it odd that people are disagreeing with me that small victories or moral victories are worth anything while also saying that Republicans should vote against her even though they know she’ll be confirmed.
It won’t help anything and will only be used by Democrats to paint us as racists, with the Ricky Ricardo quote played in every attack ad. The cost isn’t worth the benefit.
