Aw: Graham forgives Sotomayor for the “wise Latina” crap

In case any further proof was needed that he’s going to hold his nose and vote yes, here you go. He accepts her argument that her life’s work belies the apparent intent of the “wise Latina” comment. But does it?
The reason Sotomayor’s work at PRLDEF is important, Republicans say, is that it shows a period in her career in which she put into action the ideas she expressed in her “wise Latina” and other speeches. At PRLDEF, Sotomayor was a liberal activist, not the careful, conservative, law-bound judge she has portrayed herself to be at her hearing. Her PRLDEF years — she left the group when she became a federal judge in 1992 — show a different Sonia Sotomayor than the one sitting before the committee.
Why didn’t Republicans explore the PRLDEF connection more thoroughly? No one seems to know. There are seven GOP senators on the committee. Each is experienced, and each has his own areas of interest. They do not coordinate their questioning with one another. So several of them spent a great deal of time discussing the “wise Latina” speech without spending much time on how Sotomayor’s world view translated into action in her career. In some ways, Sotomayor’s time at PRLDEF is the link between her personal views and her legal work. A close exploration of her PRLDEF years could help explain, for example, why she gave such short shrift to the Ricci case, in which she summarily denied the rights of a group of white firefighters who had earned promotions in a testing situation reminiscent of the ones PRLDEF and Sotomayor had challenged in the past.
Republicans had a chance to explore these issues with Sotomayor in the early, high-profile moments of her hearing. They missed it.
Well, it’s nice to know at least that he’s no longer taking a hard line on shutting “bigots” up. Exit question: A federal appellate judge/Supreme Court nominee thinks NLRB stands for “National Labor Relationships Board”?

Actually, not true, not specifically. Sotomayor was the one dissenting vote (cast to make a difference in how Heller was interpreted) as to the D.C. gun ban and this will soon be heard by the Supreme Court (because it remains a question as to incorporated areas having the right to ban guns vs. unincorporated areas)…and IF she’s on the S.C., she’ll be likely as anything to again vote as she already has (against individual gun ownership if any state decides they don’t want individuals have the right in their state to do so).

Sotomayor, like many Liberals, has a view of gun-bans, governments overriding individual rights (or, rather, deeming there not to be any individual rights under state laws) to own guns. This is essentially saying she recognizes the 2nd Amendment “rights” but then rendering it ineffective (as long as states can eradicate those rights, then there’s nothing ‘there’ on a federal level once the right to determine the exercise of the rights is assigned to states, and that’s what Sotomayor’s already deemed to be).

The Dems have the votes to guarantee that she’s going to get confirmed regardless, and taking on a hyper-aggressive stance is just going to make him look like a Racist Republican Meanie in the eyes of many.
About all that can be done is to cast doubt on Obama’s judgement by making her look bad, and Graham has done a fairly decent job of that, at least for a squish.

Everyone knows what Sotomayor is. If a senator votes to confirm her, that senator needs to be held personally responsible for her future decisions. The “I had no idea” excuse won’t fly.

I understand that they may not have wanted to draw their powder on a latina nomination where she would not necessarily affect the balance of power, but dems are never concerned about such things and always go for the jugular whether or not it will today affect the balance, because tomorrow, today’s pick may have serious consequences.
Today is a sad day because we are one step closer to the United States of Amexida with the appointment of this unqualified judge to our High Court.

The Reps are rather sad that they couldn’t expose one who had such obviously unconventional views towards the law. They should have asked, by extension, if she is misinterpreting the law as a judge in the same way that she couldn’t “intend” the “true” meaning in a speech she gave nine times. A phrase that could not be taken any other way unless you were lying about it. If she can’t properly express her own thoughts, how is she going to interpret the law?

I agree with you, and it appears we’re in the majority. Although I’m not a fan of Sen Graham’s, I don’t live in SC so it’s not my choice who they elect as Senators. SC is a very conservative place, and I will trust the judgement of her citizenry that they see something in him that appeals to them. I DO wish there had been more references to how Estrada was treated. Am I correct in recollecting that he didn’t receive an up or down vote?

Oh, the ‘wise Latina’ thing is way overblown and it’s senseless to focus on it. And her time at PRNDL or whatever it’s called, she could argue that she was just representing her client.
I haven’t followed, though, whether they got a coherent answer out of her on how the Didden and Ricci decisions got slipped under the door like a hotel bill with sixteen hours of Buttman’s Greatest Hits video-on-demand on it.
