Live stream from Sotomayor hearings

Today at 9:30 am ET, Sonia Sotomayor returns to the Senate Judiciary Committee to continue the confirmation hearings for her nomination to the Supreme Court. So far, Sotomayor has avoided any missteps — mainly because the Senators on the committee have hardly allowed Sotomayor a word in edgewise. That will change at least somewhat today, as the Republicans will press harder for answers about Sotomayor’s past statements, and Democrats spend their time asking hardball questions like, “Just how did you get so awesomely awesome?”


Andrew Malcolm and his partners at Top of the Ticket have done a great job in live-blogging the hearings. Keep up with the transcripts at ToT. Kerry Picket, meanwhile, points out the double standards at play in the hearing when compared to the ordeal of Miguel Estrada:

What sets them apart is how they were treated by Democratic senators. In 2003, Senate Judiciary Chairman Patrick J. Leahy, Vermont Democrat, said: “The White House continues to obstruct any progress toward resolving this matter by its unprecedented refusal to turn over documents requested to determine whether or not Miguel Estrada should sit on the second highest court in the land, for life. Mr. Estrada’s nomination is apparently being sacrificed by the administration for its own partisan, political purposes.”

The Democrats were requesting confidential memorandums drafted by Mr. Estrada while at the Office of the Solicitor General. This request was unprecedented. All seven living former solicitors general, Republican and Democrat alike, agreed with Mr. Estrada.

Democrats were forthright in their opposition to Mr. Estrada precisely because he is Hispanic. A staff memo to Illinois Democratic Sen. Richard J. Durbin on Nov. 7, 2001, referred to liberal concern that Mr. Estrada was “especially dangerous, because he has a minimal paper trail, he is Latino, and the White House seems to be grooming him for a Supreme Court appointment.”

Then-Rep. Robert Menendez, a New Jersey Democrat who now represents the Garden State as a cigar-chomping U.S. senator, said he did not consider Mr. Estrada to be the right kind of Latino. “Being Hispanic for us means much more than having a surname,” Mr. Menendez said in February 2003. It means being a predictable liberal.

Skip the bullshat hearings and just confirm Soto, why waste all this time on a foregone conclusion? She’s Hispanic, and unless there is video evidence of her pooping on Davie Crockett’s grave, Soto is going to get her appointment.

When you allow someone as spastic and dopey as Franken to actually sit on such a committee, the pretense of Senate professionalism not only flew out the window, it was blown to bits with a magnum load of #8 shot.

Sorry Ed, I just can’t watch this circus act called a Supreme Court Nominee Hearing. It will only drive my blood pressure higher listening to these senators either applaud her as the consummate jurist or grill her as an untrustworthy racist, as though the final decision hasn’t been made already to approve Sotomayer’s confirmation.

It’s not a hearing, it’s a performance for the cameras.

It’s over. Graham said so and we know it is.

Not to sound too Clintonian but it depends on what your definition of best is. Personally, I’d want to find an able jurist who had written extensively on the role of the Constitution in the rule of law. Obama wanted a style over substance minority female with a great personal story. Sotomayor’s career and lack of any real depth was never an issue.

Ditto the doctor he just nominitated for Surgeon General-She’s a small town doctor in rural Alabama but she’s a big black woman with a great story even if she has zero national public policy making experience on healthcare issues.

Federal appellate judges rarely get questioned like this. What I’m more fascinated with is that she isn’t even coming off as a Latina of average intelligence. It’s all meaningless but fun to watch.

It is not difficult at all to identify when Sotomayor is lying and when she is telling the truth.

Run yesterday’s testimony back and you’ll see that she is either a very poor liar or is so sure she will get through this that she isn’t even trying to hide it.

When she’s telling the truth, she speaks very casually and openly, almost like the lady across the backyard fence. When she’s lying (about things like “fidelity to law”) she slows down and her voice becomes very strained.

This happens over and over again throughout her appearance yesterday. It is quite obvious.

Indeed, and Sotomayor didn’t correct him, instead answering him as if his incorrect phrasing was what she’d actually said.

I listened through Sessions’ questioning, and was glad to hear him point out that Leahy also misrepresented the circumstances around the Ricci case.

After listening to Sessions and her responses to him, I can only conclude that she’s either a liar or an idiot who can’t communicate clearly either orally or in writing. Not a good choice, and certainly not supreme court caliber.

Senator Hatch, in his questioning of Sotomayer on her decision after Heller on incorporation of the fundamental right to arms against the states under the 14th Amendment, raised a very serious point that he did not explain very well (IMHO).

Judge Sotomayer decided that the 2nd amendment did not apply to the states under the doctrine of the 14th Amendment allowing the states to regulate the right to non existence if they had a logical case to do so.

Hatch tried to note, not very clearly, that there is a body of law and legal thinking that has developed over the last 110 or so years concerning incorporating a right against the states as a result of the 14th Amendment. Sotomayer, in her decision, did not use this body of law, as its use would have required her to find for inclusion of the right, but instead, went back far further to a period when the precedent did not reference the 14th and used other law in discussing the Bill of Rights to NOT incorporate any of those rights against the states. Using this precedence, she was able to rule against inclusion.

Think about that, if she wanted to come to one conclusion, she uses one batch of case law. If she wants another decision, she uses an older and largely changed bit of precedence ignoring case law from the last century.

She had a conclusion in mind and used law no longer relevant to make it.

That IS Judicial Activism.

Using this legal standard, she could have made a case that no right in the Bill of Rights appled to the states as her referenceing Presser relied on this line:

“We think it clear that the sections under consideration, which only forbid bodies of men to associate together as military organizations, or to drill or parade with arms in cities [116 U.S. 252, 265] and towns unless authorized by law, do not infringe the right of the people to keep and bear arms. But a conclusive answer to the contention that this amendment prohibits the legislation in question lies in the fact that the amendment is a limitation only upon the power of congress and the national government, and not upon that of the state. It was so held by this court in the case of U. S. v. Cruikshank, 92 U.S. 542 , 553, in which the chief justice, in delivering the judgment of the court, said that the right of the people to keep and bear arms ‘is not a right granted by the constitution. Neither is it in any manner dependent upon that instrument for its existence. The second amendment declares that it shall not be infringed, but this, as has been seen, means no more than that it shall not be infringed by congress. This is one of the amendments that has no other effect than to restrict the powers of the national government, leaving the people to look for their protection against any violation by their fellow-citizens of the rights it recognizes to what is called in City of New York v. Miln, 11 Pet. [116 U.S. 252, 102] 139, the ‘powers which relate to merely municipal legislation, or what was perhaps more properly called internal police,’ ‘not surrendered or restrained’ by the constitution of the United States.”
