Sotomayor, Day 1: Hispanics promise lots of scrutiny of GOP

The confirmation hearings of Sonia Sotomayor begin today, in the wake of the reversal of Ricci in which none of Sotomayor’s future colleagues concurred with her reading of the law. Republicans plan a robust attack on Sotomayor’s Ricci reasoning and a slew of statements that she has made over the last twenty years. However, as ABC reports, Hispanic interest groups say they will watch the GOP “like hawks” for any hint of racism:
Latinos will be watching Sonia Sotomayor’s confirmation hearings “like hawks” for evidence that senators on the Judiciary Committee are mistreating the Second Circuit Court of Appeals Judge, or are mischaracterizing her record, leaders of Latino political, professional and advocacy groups tell ABC News.
“We accept tough questions. But what we are going to object to are questions that misrepresent the judge or that distort her record,” says Estuardo V. Rodriguez, director of Hispanics for a Fair Judiciary. The nonpartisan umbrella organization includes the Hispanic National Bar Association, U.S. Hispanic Chamber of Commerce, and the Mexican American Legal Defense and Education Fund.
Judiciary Committee member John Cornyn, R-Texas, said on “Fox News Sunday” that Sotomayor’s nomination won’t be blocked because Republicans don’t have the numbers. But she is expected to explain her 2001 comment that she hoped “a wise Latina” was more likely to reach better conclusions than a white male without comparable experiences.
Fair game, but for many Latino political groups the game is, and has been, on. Earlier this month when Sen. Jeff Sessions, R-Ala., the top GOP lawmaker on the Judiciary Committee, called some of the decisions made by the Puerto Rican Legal Defense and Education Fund (PRLDEF) “extreme,” the Hispanic National Bar Association fired off a letter to this panel’s chair, Sen. Patrick Leahy, D-Vt. The document expresses “deep dismay” and warns that this kind of “mischaracterization” by Sessions or others will not be tolerated. A similar letter was sent to the Alabama Republican.
No one expects otherwise. Well, maybe one man does. Miguel Estrada was nominated to the DC Appellate Court by George Bush in 2001, and got filibustered by Democrats in 2003. The reason for their opposition was explicitly racist, as this memo to Senator Dick Durbin in 2001 shows:
Second, yesterday’s meeting focused on identifying the most controversial and/or vulnerable judicial nominees, and a strategy for targeting them. The group singled out three — Jeffrey Sutton (6th Circuit); Priscilla Owen (5th Circuit); and Caroline Kuhl (9th Circuit) — as a potential nominee for a contentious hearing early next year, with an eye to voting him or her down in Committee. They also identified Miguel Estrada (D.C. Circuit) as especially dangerous, because he has a minimal paper trail, he is Latino, and the White House seems to be grooming him for a Supreme Court appointment. They want to hold off Estrada as long as possible.
Democrats explicitly opposed Estrada because he was Latino. Do you remember the huge outcry this created from these Hispanic interest groups at the time this memo got revealed, and how they protested Democratic racism and bigotry?
Yeah, neither do I, and neither does Miguel Estrada.

Ha, Graham just pointed out Eric Estrada’s “stellar background” that the Democrats rejected.
And Estrada certainly had a hardship background (immigrant at fourteen from deprived circumstances).
Sotomayor never suffered any deprivation as did Estrada. Estrada was not a radical Leftist so the Democrats rejected him.

One thing to remember is that this is just day one of a multi-day process. It’s probably a bad strategy to open fire when first sighting the enemy (and I consider Sotomayor a racist enemy of the Constitution will in all likelihood be confirmed). Opening statements are where everybody pretends to be civil while sharpening the knives for the “fun” to come.
The only thing that can de-rail this is the Ricci testimony but I think it’s so much of a done deal, she’d have to be pretty far out there to get the kind of reaction that would poison her as a nominee.
Wonder if the WP is going to critique her fashion sense the way they attacked Roberts kids and Alito’s wife.

What part was amusing? McCain’s mini-me speaking for Republicans when he is as big a RINO as they come or the idea that Miguel Estrada would have been the right fit for the SCOTUS. Fact of the matter was that GWB backed into two pretty good choices when he didn’t engage in minority politics. He ran afoul of Republicans and Democrats with Meirs and when he was floating Estrada’s name. That’s not to say that there are not competent females/minorities more compatible with GOP ideology of not engaging in judicial activism but I don’t rate Estrada as one of those individuals.

Everyone seems to be missing the dumbest part of Sotomayor’s “wise Latina” statement. The biggest problem is that coming to better decisions is what would qualify someone as being “wiser”. Sotomayor doesn’t seem to understand what the word “wise” means as she uses it and THEN talks about coming to better decisions. If one judge comes to better decisions than another, then the one is wiser than the other. Period. That is the measure.
Sotomayor seems kind of stupid, to me, but I really don’t understand why no one has jumped on the true idiocy of the “wise Latina” statement. Let me give a different a different version as a clear example of what I’m saying:
“I would think that a strong Latina would generally be able to lift more weight than a white male.”
The lifting of weight is the measure of strength, so the statement is just meaningless and confused. Sotomayor made this same mistake with “wise” … and made it over and over and over. At least, now I can see why she thought that there were no adjectives in Spanish. She is not a wise person. Not one bit.

One of my close friends was an orphan in Mexico. He snuck across the border at 15 and entered the army at 16 so he could get citizenship. He was went o Korea at 17 and was on the front lines for two years in combat. All his life he worked hard at manual labor. He has had one wife for 40 years and one daughter who got a masters at a local college. Her thesis was on how “immigrants” get depressed and need more(state funded) psychiatric care. My friend never voted Republican in his life, nor will he ever. He hated Bush because hew was a Republican and represented the “uncaring” upper crust in his mind. Pandering to Hispanics is an endless loser for Republicans.Instead, they should stick to principles. If those principles are effective, they will help Hispanics as well as everybody else. Eventually self interest will bring them over. Buying votes has not helped Republicans. Soto should be revealed for what she is, an astute political pick with no creative spirit who always votes present. A hack, like her master.

The statement by Cornyn was found in an emailed newsletter that I’ve since read and deleted, sorry.
But it was his recent statement about Sotomayor, which he framed in a very generally “caving in” perspective by “reminding” readers that his state “has a Hispanic population of” (then he quoted a percentage), making it appear that there’s One Giant Hispanic Mind making it impossible for him to reason without endorsing ethnic supremacy or some such perspective in supporting Sotomayor (as swayed by this percentage of Hispanics in Texas).
I MAINTAIN that though there are high percentages of Hispanics in some areas, that simply opting to go with Sotomayor (or any nominee who may be Hispanic/Latino by that criteria alone) is endorsing ethnic-supremacy evaluation and process.
Same would apply if someone was, say, advising ” because my state has 55% (whatever) White people, then I have to support Mr. Whitey in the process…”

They had a discussion about this on FNC last night. The general concensus was that she could have gotten away with saying that a wise Latina would bring a different perspective to the bench (hardly controversial) it was that she said a Latina would make better decisions. Which is another way of saying that she doesn’t think whites capable of making the right decisions.
The other thing that I learned last night was that this wasn’t a one-time deal as the filthy liar’s people were playing it off. They have her at 5-6 different occassions making the same claim that a Latina would make better decisions than whites would. That’s racism no matter who you are. This is all a done deal but I hope they grill her up one side and down the other over her racist tendencies and comments with the Ricci case.

I agree with that take on that statement, I, too, think it was and is a very stupid thing for anyone to have said, and Sotomayor not only said it but has repeated it — what — seven times in seven distinct appearances she’s made.
So the line is meaningful to HER while it is also quite stupid, illiterate even, intellectually, to say.
She says it for emotional crowd appeal, she courts racists at racist meetings among racists and then throws that line out to them inorder to get that laugh and snide agreement thing going, to prove she’s got some racist-cred before her racist audience. THAT’s the ONLY reason she repeats it.
And it IS very significant to her state of mind and character and quite meaningful to how she arrives at decisions (badly, in my view, and it has nothing to do with her DNA but with her racism and sexism among other offensive characteristics she displays).
A woman (attorney) wrote a great article in, of all places, Mother Jones, analyzing Sotomayor’s written decisions and it was an excellent expose on how badly (poorly, terribly) Sotomayor formulates written content.

P.S.: it’s even an illiterate statement because “Latina” MEANS FEMALE in Spanish. So saying “Latina woman” is like saying, in English, “woman woman”.

Right, but that is just saying that Latinas are “wiser” than white males. The way she framed her statement shows that she has no idea what the heck she’s talking about. She meant to say, simply, “Latinas are generally wiser than white males,” since that is the sum total of what she actually said.
Something like 5 speeches that are well-known, along with a few others. And she let people lie for her about this when the story first broke, very publicly and very often, without setting the record straight, which should certainly be enough evidence of her underhanded character to not let her near the SCOTUS and try to get her removed from her appellate seat.

I found Orrin Hatch’s opening statement to be truly inspired, which isn’t to say that Sessions’ or Kyl’s were not — but Hatch made a very clear, supported case (using Barack Obama’s voting history and statements made in relationship with him refusing to support specific previous judicial nominees, among them a black female from CA’s Supreme Court) as to why Sotomayor’s entire statements are necessary and germaine, immediately applicable, to this nomination (not limited to just her juducial decisions but her “off the bench” statements, also).
Hatch’s points were excellent in greatly specific terms. Sessions, though, he’s truly a gift from God, that guy is super.

Using my best Palin analysis skills, I think Dodomayor did pretty good, for a wise Latina. She didn’t talk, which she doesn’t do very well. She didn’t write, which she dones’t do very well. And thinking and indepth judical analysis, well that’s just not her strong suit.
A racial bigot is a racial bigot no matter who says it.
All in all, I think every Supreme Court ought to have their wise Latina racial bigot.

All of which, is of course, racist because we are supposed to be nominating the most qualified to the bench and without bias towards race or gender. Sotomayor is not the most blatant case of affirmative action trumping ability out there but what bothers me is that she’s the one making it clear that everybody knows she’s Hispanic and thinks that she’s somehow a martyr here because there haven’t been any Hispanics on the court until now. And that is the more offensive act of racism in this situation.

That Mother Jones article was scathing. Even the article had to go a long way to try to defend the idea that a great thinker might be an awful writer. Frankly, that’s a bit of a stretch for me. Clear thinkers are clear writers, almost without exception.
I liked this part:
This went back to her “we don’t have adjectives in Spanish” [my paraphrase, by memory]. And this idea that “she clearly had other talents” is quite baffling, especially as it is given without any support, at all. I can’t even begin to guess what those other talents might be.
If she gets on the SCOTUS, she’ll have a lasting influence, even though she’ll write her opinions at a 5th grade level. That’s the beauty of being a SCOTUS justice; one doesn’t have to be eloquent to screw things up beyond repair.

Oh! The polls won’t show it but the number is, in reality much higher than that. Part of the reason you have the racist WaPo style editor trashing Roberts’ kids as too white is that these hearings are deadly dull and have to do with an awful lot of legal philosophy about the role of the justice system, the latitude in interpreting the laws, and all sorts of other stuff that just doesn’t make good viewing. They’ve dumbed it down but, in reality, few people have done the kind of in-depth research into Sotomayor’s rulings and statements to have anything other than an impression that (for most) is nothing more but a poor Hispanic makes it to the SCOTUS despite the GOP being mean to her by calling her a racist.

No because, in theory, the fact that the Wise Latina is a radical liberal who hates whites shouldn’t matter. The Scotus isn’t hearing the case, it is hearing the appeal from the lower court rulings. So, in theory, the only thing that matters is if the trial was procedurally correct and correctly interpreted the applicable laws.

This nomination was decided by the Hart-Cellar Immigration Reform Act of 1965, which was championed by Teddy Kennedy.
You have to give it to the Dems – they saw even then that white, middle class voters would shut them out on the national level, so they pushed through a bill that has imported tens of millions of minority – mostly Hispanic – voters.
Republicans, as usual, acquiesced, because they feared the “racist” label. Even the blind could see the end game, but guys like GW Bush kept insisting that Hispanic family values and work ethic made them natural conservatives.

She appears to be a true leftist and will eliminate all opposition once she is seated on the bench. As for her diversity she has none. She was raised in one life and thats how she wants all of the USA and the world for that matter to follow. This is the message that the GOP needs to be pounding at every opportunity. The Democrats got memos to filibuster Estrada specifically because they wanted to stop a Republican Hispanic from getting on the Court. You then go back and say that 1 of the firefighters who got screwed in Ricci was Hispanic!

Leftists NEVER pay a price for their comments. Sotomayor will be appointed baring some major blowout irrespective of her racism. Heck, the Dems went after Estrada on explicitly racial grounds…
Without a media to go after them for their racist, fascist, etc comments, the statements disappear before they ever really enter the consciousness of the voting public.

Yeah, BUT, Ginsberg’s were in reference to genocide, sympathetic to, the use of to justify Roe v. Wade and her support of that (so, therefore, both).
Especially since Ginsberg’s of Jewish ethnicity, one would expect just a tad more outcry among others of her relationship on that, particularly, outrageous, disgusting perspective (as voiced by Ginsberg).
When I wrote earlier (up in the comments here ^^) that the statement suggests Ginsberg’s mentally incompetent to remain on the Bench, I meant it.
That statement was so far beyond anything reasonable, conscientious or responsible as to indicate that her mind is badly affected. Something is gravely wrong with her.

You miss the objective by those who engage in this self-labelling (they’re African Americans, they’re Black Americans, they’re Hispanic, etc.):
their objective is to get “white people” to adopt the “Anglo” term for ourselves. They WANT “white people” to become a marginalized subset of the U.S.A. and a step in accomplishing that is to get “White people” to start declaring we’re “White Americans” or “Anglo Americans” or some such nonsense.

So call me an Aborigine or Native American, in that sense, as Native as just about anyone.
