The rogue government of Los Angeles

The hinge of American citizenship is the rule of law.  We expect citizens to abide by it, and even more, we expect our governments to abide by it as well.  Governments that rule by whim and ignore the law become tyrannies or “banana republics:, as the owners of Creators Syndicate discovered in their dealings with the city of Los Angeles.  The city ignored its own ruling on a tax issue and demanded back taxes that the company does not owe to them:

From the beginning, we’ve been headquartered in Los Angeles. But 15 years ago we had a dispute with the city over our business tax classification. The city argued that we should be in an “occupations and professions” classification that has an extremely high tax rate, while we fought for a “wholesale and retail” classification with a much lower rate. The city forced us to invest a small fortune in legal fees over two years, but we felt it was worth it in order to establish the correct classification once and for all.

After enduring a series of bureaucratic hearings, we anxiously awaited a ruling to find out what our tax rate would be. Everything was at stake. We had already decided that if we lost, we would move.

You can imagine how relieved we were on July 1, 1994, when the ruling was issued. We won, and firmly planted our roots in the City of Angels and proceeded to build our business.

Everything was fine until the city started running out of money in 2007. Suddenly, the city announced that it was going to ignore its own ruling and reclassify us in the higher tax category. Even more incredible is the fact that the new classification was to be imposed retroactively to 2004 with interest and penalties. No explanation was given for the new classification, or for the city’s decision to ignore its 1994 ruling.

Their official position is that the city is not bound by past rulings — only taxpayers are. This is why we have been forced to file a lawsuit. We will let the courts decide whether it is legal for adverse rulings to apply only to taxpayers and not to the city.

First, one has to wonder why a city that specializes in entertainment — which Creators Syndicate distributes — would choose to impose penalizing taxes on distributors.  Clearly, a media syndicate sells content at either wholesale or retail to other businesses.  They don’t create the content; they sell it, either directly or indirectly, to the public.  Even if it didn’t, though, how does LA justify a significantly higher tax rate to the actual producers of content?  They hardly impact city services, certainly not as much as manufacturing.

However, that’s a matter of public policy and open for debate, while this case has deeper implications.  The decision of LA to ignore its own ruling and penalize CS forrelying on the city’s own decision (through the retroactive application) defies explanation.  That is not the act of a representative government that abides by the law; that is the action of tyrannical bureaucrats deciding that they are the law.  That’s dangerous regardless of whom the city victimizes in any specific case.  It demonstrates a lack of checks and balances, and a mentality that reduces Los Angeles residents to the status of subjects rather than citizens.

Rick Newcombe will leave Los Angeles as a result of this, and no one can blame him or anyone else who leaves a city intent on turning itself into a “banana republic,” as Newcombe accurately observes.   (via Michelle)

This is what happens when identity politics result in people getting in power that have no clue of how to successfully operate within the law successfully. Pile on top of that what the Democrats have done to the court systems. The US version of the Dark Ages is the next step.

Commerce cannot and will not happen when there is a government that isn’t subject to it’s own laws that can grab property (and money is property) on a whim.

Which is why the economies of these hellholes we call urban centers are all in shambles. Our cities have become collections of people on the dole, and insatiable and greedy politicians.

The Obama Regime is taking this sort of thing national.

Ultimately this sort of fascist economic policy will lead to a black market… for common goods!

Only 70 film shoot permits were issued in Los Angeles in 2008, compared to over 300 in 2000. The entertainment industry is going the way of the orange groves.

….and don’t own a business and can afford private schools for your kids

Hey, we’re talkin’ about LA here! The same city that’s out at least 1.4 MILLION for the MJ Canonization and Perpetual Memorial. AEG can sell location rights to the media for over $400K in front of the Staples Center, but don’t ask them to pay for the extra police presence and shutting down a couple of freeways. That’s what taxpayers are for. You want to see a shell game, try and pin down who in the city authorized this expenditure. The mayor is screwing his mistress over in Africa, the Asst mayor is out of town……..and no one appears to know who okay’d all that money being spent.

Suggestion: Stay out of LA, it has become a 3rd world country.

We’re also the portion of the population that is heavily armed…

Sooner or later people are going to have to return to the concept of “if I’m not willing to work for my food, I will starve”, instead of today’s “Obama will feed me, buy my gas, pay my mortgage, etc”.

This is no different than the IRS coming after my son last month for $3000 bucks for a car that got repo’d in 1999, and then got sold by the bank. The IRS is claiming he owes for capitol gains on the sale of the auto.

You have to wonder if this type of thing is done on purpose. The IRS can’t catch everything that happens, but when they do YOU will pay dearly in the form of interest and penalties.

Here is my concern…as more and more of this money grab takes place in these states, people will move their businesses out of these states to states with more favorable taxes. AND THEN, once in their new state they will vote themselves the same crap that got them into this mess.

They vote for these politicians that pass all the high taxes. I would prefer they vote these guys out of office and stay put. Please don’t come to my state (TX) and start voting progressive liberals into office.

Then where will they go?

If the rules don’t matter, stop obeying the rules. The City can’t throw them in jail, and pretty soon they won’t even be able to afford the cost of collecting fines. The cost of prosecuting them? That’d be tough, too. And with the furloughs, the CA courts will probably be getting backed up even more than normal.

Lastly, it’s a form of protest. The laws apply to the government FIRST, not last.

I think we all need to avoid LA and anything that originates there. Who knows, the city may decide that visiting or viewing content that originates there is sufficient to place one on its tax rolls. Why take the chance of having to defend yourself?

They are operating under the mistaken belief that the internet was never invented and that businesses still have to be tethered to ‘anchor’ cities like NY and LA if they want to get anything done.

They can locate their business in the lowest-tax city around and have people work remotely from NY, LA, Small Town USA, Somewhere in Europe, etc….

The wonderful weather and great natural landscapes are nice, but, that will only get the LA government so much room to torture citizens…..I’ll take less ‘perfect’ whether and less government dominance any day.

L.A. is a joke. It is the poster child for what you get when unfettered illegal immigration and ultra-liberal politicians meet.

My favorite L.A. story was a few years ago when some Latino activist groups were protesting to increase the pay for the hotel workers at the hotels near the airport. The stupid-ass city council sympathized (of course) and voted in a minimum-wage specifically for the hotels. The next day the hotels fired a bunch of their workers. Great lesson in economics for the city council if they cared to learn it.

If the amount that he owed on the car was more than the bank got from the sale of the car, then your son would still owe that money to the bank.
If the bank then excuses that debt, then your son would owe taxes on the amount of debt excused.

What matters is when did the bank right off the debt. Not when was the car was repossesed.

L.A. has just figured out the tax code is a means of punishing a corporation. When Obama starts using the I.R.S. to punish tax payers he won’t be needing CAMPS for citizens he will need a one way ticket back to Kenya.

First, one has to wonder why a city that specializes in entertainment — which Creators Syndicate distributes — would choose to impose penalizing taxes on distributors.

I think that may be the source of the problem–they are completely un-moored from reality. Just the latest example is that the city spent 1.4 million dollars for a “memorial service” for a drug-addicted pedophile, and they actually believe that the guy’s “millions of fans” are going to pony up donations to cover the expense.

LA’s rulers are used to spending other people’s money any way they want, and if the money runs out, they will just find new ways to take more. Heaven forbid they actually cut back on the spending.

My favorite L.A. story was a few years ago when some Latino activist groups were protesting to increase the pay for the hotel workers at the hotels near the airport. The stupid-ass city council sympathized (of course) and voted in a minimum-wage specifically for the hotels. The next day the hotels fired a bunch of their workers. Great lesson in economics for the city council if they cared to learn it.

Right along those lines was the group who was hired to raise the minimum wage…found they were paying less then minimum wage, their reasoning was they couldn’t afford to be in business if they paid minimum wage, let alone what they were promoting.

Only 70 film shoot permits were issued in Los Angeles in 2008, compared to over 300 in 2000. The entertainment industry is going the way of the orange groves.

The next question is: since Creator’s Syndicate is an office, a website, and a set of contracts, why not keep going and “host” it offshore? Why subject themselves to a lawless regime at the national level when they just saw the effects of same at a local level?

I have no pity for the people of LA or Calf. or any state that has for years elected these Libs. over and over.Just look at Mich. that state has been in down turn for years yet ever 2 or 4 years they send the same old libs to mayors office the state house and to D.C..You would think they would learn from there past vote but no they do the same damm thing.So to all the people of L.A. and ever other Dem. strong hold live with it or change it.

I unfortunately pay LA’s business tax, and I hate it, but some how I suspect we are not getting the city’s side of this story. Did the business misrepresent facts to get the beneficial ruling, which the city has now learned was bogus?

Ah they’ve been saying stuff like that for years. In the article I read the increased swarms of tremors all occurred AFTER not before the big quakes in 2003 and 2004. Being as Kalifornication has long be subject to big ones, the scientists have to continually come out with new observations and predictions so that when the next big one finally does hit again they can say they called it.

It’s been a few months since the last “asteroid will destroy us all” scientific study release, so be looking for that one next.
