Obama: Hey, let’s bypass the Senate on treaty ratifications

After listening to the Democrats screech for the last two years about the rule of law, this Jake Tapper report should be surprising …. but it’s not.  Apparently, Barack Obama finds treaty ratification a little too complicated, and so he figures he can just commit the US to nuclear disarmament and bypass Congressional oversight:

With the clock running out on a new US-Russian arms treaty before the previous Strategic Arms Reduction Treaty, or START, expires on December 5, a senior White House official said Sunday said that the difficulty of the task might mean temporarily bypassing the Senate’s constitutional role in ratifying treaties by enforcing certain aspects of a new deal on an executive levels and a “provisional basis” until the Senate ratifies the treaty.

“The most ideal situation would be to finish it in time that it could be submitted to the Senate so that it can be ratified,” said White House Coordinator for Weapons of Mass Destruction, Security and Arms Control Gary Samore. “If we’re not able to do that, we’ll have to look at arrangements to continue some of the inspection provisions, keep them enforced in a provisional basis, while the Senate considers the treaty.”

Samore said administration lawyers are exploring the “different options that are available. One option is that both sides could agree to continue the inspections by executive agreement; that would work on our side. On the Russian side, as I understand it, that would require Duma approval.”

The fact that the administration is preparing for such an extraordinary measure shows just how much pressure the two administrations are under to arrive at an agreement before the 18-year-old treaty expires.

Uh, pardon me, but how many seats in the Senate does Obama’s party hold?  Isn’t it 60?  If Obama is simply moving forward with a straightforward, supportable treaty with Russia to reduce nuclear stockpiles in an effective verification system, why couldn’t he get a quick ratification?  The GOP gave George H. W. Bush enough support in 1991 to pass the original START treaty, so it’s not as if ratification would be impossibly complicated.

Well, that is, if the deal actually does put in place an effective verification system and doesn’t amount to a de facto unilateral disarmament.  With exactly five months to win Senate approval, the effort by the Obama White House in floating this idea now makes it sound like Obama wants to give away the store in order to score some points with his 1980s no-nukes agenda.  And as much as the Democrats howled over the supposed devotion of George Bush to a “unitary executive,” Obama seems to have no trouble bypassing the check on executive power for treaty negotiation written explicitly into the Constitution, in Article II, Section 2:

He shall have Power, by and with the Advice and Consent of the Senate, to make Treaties, provided two thirds of the Senators present concur;

Words.  Just words.

I’m pretty sure there are laws about allowing foreign powers to get intelligence about us… I think its called spying.

So, with no treaty in place to Allow that “observation” or spying… how can Obama then break the Laws about espianage?

That I agree with – as stated in a prior post on this subject. What’s bizarre and even troubling is that particular language.

Yes. It’s a totally unforced error … unless they plan on doing something. I assume they plan on doing something, and seeing how they don’t mind shredding the COnstitution, anyway, it must be pretty bad for them to be saying stuff like “bypassing the Senate’s Constitutional role” already. If not, then they are just too stupid for words.

What’s not bizarre or troubling yet is anything that, as far as we know, the President actually has agreed to order. All that’s mentioned specifically is continuing START-mandated (trust, but verify!) inspections during the period betweent the lapse of the old treaty and the completion of any new treaty. There’s nothing prima facie unconstitutional about that.

Well, you know, CK, it’s no secret what The Precedent wants to do. He wants the US to unilaterally disarm and throw our nukes away.

To be honest, I’m surprised he hasn’t taken our strategic nuclear arsenal to court to get it ruled that it’s in violation of the Geneva Conventions (which it is – though everyone violates Geneva, which is why it is not a serious treaty and never has been) and then say he was forced to strip the US of our defenses.

New update from Honduras Abandoned:

Just got off phone from Hunter. He was in a building at the airport with other Press types. They heard Mel was arriving. Commotion started outside and they were told to get to other end of airport. They went running outside and saw people running towards an area. He went there just as an ambulance was pulling out. Saw very large pool of blood. Told 2 to 3 dead.

Person there told him that rocks had been thrown at soldiers and one (soldier/police)walked up to the fence and started shooting. People were showing Hunter the brass and it appeared to be 5.56. He did not see any on the ground and does not know if this was from the shooter. Said everyone was scrambling around trying to find some.

Protest organizers are trying to send people home. They do not want any more blood shed. Crowd has calmed down but it was very tense when Hunter first arrived. police/army had pulled back from fence. Few people are leaving and he said the crowd is a lot better now. He got pictures of the blood. He did not hear the shots personally.

He did see an older man in a white shirt reach down into the blood pool and cover his hands. He then wiped them on his shirt to make it look like his blood or that he had been involved. Hunter saw what he thought was an AP photographer take the man’s picture. Hunter said if you see it on the web, don’t believe it. It was faked.

He is heading back into the crowd and will update if anything warrants further coverage. Plans on posting pics and his write up when he gets back to hotel. It will be better than mine. Doing this from hastily scratched notes while confirming his safety.

I worry about them, now. If our military brass think that Iranian retaliation for losing their nukes could psosibly be more dangerous than Iran with nukes, then I don’t know what good they are or what they are thinking.

Zelaya increasingly spoke of the two nations of Honduras, one hopelessly poor, the other wealthy and uncaring. He began to argue for “people power,” a kind of direct popular democracy.

Thousands tried to reach the airport as Mr Zelaya’s plane flew in from the US while the interim authorities insisted it would not be allowed to land.

They are seeking to re-route the plane to El Salvador instead.

But speaking from the plane, Mr Zelaya appealed to the military to let him land “in the name of God”.

Because we had already been pulling the same junk in Bosnia, so it was nothing new. The damage was mostly done by the time we weighed in on Kosovo. And there was one upside to Kosovo in that Clinton told the UN to get stuffed on it.

I didn’t see many strategic problems from Kosovo. Just idiotic tactics. But I also felt that most Americans still don’t understand that there is no such thing as goodwill in the arab/persian/muslim world, so I chalked up fighting for the muslims in Bosnia and Kosovo to be a lesson to Americans that you cannot get on muslims’ good side by doing them favors.

I was very surprised that no one used the asinine plan in Kosovo against Wesley Clark when he opened his mouth in public on other issues. While we got lucky that the Serbs eventually caved in, the plan was a real loser right from the beginning, as we all watched a million refugees streaming out of the country and everyone responsible said that they had no idea that would happen, even though we had watched that exact same thing happen in Bosnia for years.

Two dead say police

Soldiers shot dead two people and at least two others were injured in clashes at the Honduran capital’s airport ahead of the expected arrival of ousted President Manuel Zelaya, police said Sunday.

“We have two dead and two wounded. The police didn’t fire. It was the army because the demonstrators were trying to get on the runway,” police commissioner Mendoza told AFP.

Among those killed was a young boy, according to an Al-Jazeera television cameraman on the scene.

Protesters said the other was a teenage girl.

We don’t need a treaty to allow anyone to view anything we feel like letting them view. The president has wide latitude when it comes to secrecy. I believe that, if he was really cruising for a bruising, he could de-classify the vast majority of “secret” material, for instance, without consulting congress. He might even be able to de-classify ALL of it, and then dare someone to prove that it didn’t fall under his constitutional CinC prerogatives.

Not saying it would be a good idea. Not saying he would even survive such a decision politically or otherwise.

Obama is bad enough without scrounging around for pretexts. Come to think of W, especially near the end with TARP and related dealings, got kind of OOC, too. I’m just saying I think we should keep our eye on the ball.

To an untrusting listener, the “bypassing the Senate” language sounds ominous. Obama’s given us no reason to trust him. If a Bushie had said it – even if he was just giving directions to a pedestrian – there’d probably be hearings and possibly a special prosecutor.
