Obama: Hey, let’s bypass the Senate on treaty ratifications

After listening to the Democrats screech for the last two years about the rule of law, this Jake Tapper report should be surprising …. but it’s not. Apparently, Barack Obama finds treaty ratification a little too complicated, and so he figures he can just commit the US to nuclear disarmament and bypass Congressional oversight:
With the clock running out on a new US-Russian arms treaty before the previous Strategic Arms Reduction Treaty, or START, expires on December 5, a senior White House official said Sunday said that the difficulty of the task might mean temporarily bypassing the Senate’s constitutional role in ratifying treaties by enforcing certain aspects of a new deal on an executive levels and a “provisional basis” until the Senate ratifies the treaty.
“The most ideal situation would be to finish it in time that it could be submitted to the Senate so that it can be ratified,” said White House Coordinator for Weapons of Mass Destruction, Security and Arms Control Gary Samore. “If we’re not able to do that, we’ll have to look at arrangements to continue some of the inspection provisions, keep them enforced in a provisional basis, while the Senate considers the treaty.”
Samore said administration lawyers are exploring the “different options that are available. One option is that both sides could agree to continue the inspections by executive agreement; that would work on our side. On the Russian side, as I understand it, that would require Duma approval.”
The fact that the administration is preparing for such an extraordinary measure shows just how much pressure the two administrations are under to arrive at an agreement before the 18-year-old treaty expires.
Uh, pardon me, but how many seats in the Senate does Obama’s party hold? Isn’t it 60? If Obama is simply moving forward with a straightforward, supportable treaty with Russia to reduce nuclear stockpiles in an effective verification system, why couldn’t he get a quick ratification? The GOP gave George H. W. Bush enough support in 1991 to pass the original START treaty, so it’s not as if ratification would be impossibly complicated.
Well, that is, if the deal actually does put in place an effective verification system and doesn’t amount to a de facto unilateral disarmament. With exactly five months to win Senate approval, the effort by the Obama White House in floating this idea now makes it sound like Obama wants to give away the store in order to score some points with his 1980s no-nukes agenda. And as much as the Democrats howled over the supposed devotion of George Bush to a “unitary executive,” Obama seems to have no trouble bypassing the check on executive power for treaty negotiation written explicitly into the Constitution, in Article II, Section 2:
He shall have Power, by and with the Advice and Consent of the Senate, to make Treaties, provided two thirds of the Senators present concur;
Words. Just words.

A few weeks before the conventions last summer Rush had a clip of Obama talking on a radio station in the early 2000′s about the Constitution. He was fluent and did not stumble around for words and thoughts. He was quite clear(didn’t even have to say it) and forceful about his subject. The subject was about how the Constitution told him what he could not do to the citizens. He wanted to have another parallel constitution that enumerated what he could do to the citizens. A chilling clip.

I’m totally on Obama’s side here. Rules, laws, and the Constitution are in the way of our better ‘good’. So, despite Fed regulations to the contrary, I’m going to call Moscow to see about becoming the first on my block to have a nuclear deterrent. I’m also informing Ted K that, since his bodyguards carry Uzis and the law says I can’t have one, I’m going downtown to talk to a few of the right people if I can find them.

Well, I certainly agree with the thrust of your argument. Especially given the fact that only 3.2% of American high school students could pass a 10-question test which is administered to naturalization candidates (6 out of 10 gets you over the bar.)
On the other hand, what percentage of households own guns? Those are the people who know their Constitution.

The social implications of impeaching the first black POTUS would be frightening, IMHO.
So I htink we’re sort of stuck with him, unless the Black voters gets pissed at him to…then he’s a legit target. But I don’t see that happening.

Modern Impeachment Procedure:
Impeachment resolutions made by members of the House of Representatives are turned over to the House Judiciary Committee which decides whether the resolution and its allegations of wrongdoing by the President merits a referral to the full House for a vote on launching a formal impeachment inquiry.
The entire House of Representatives votes for or against a formal impeachment inquiry, needing only a simple majority (a single vote) for approval.
If approved, the House Judiciary Committee conducts an investigation to determine (similar to a grand jury) if there is enough evidence to warrant articles of impeachment (indictments) against the President. The Committee then drafts articles of impeachment pertaining to specific charges supported by the evidence. The Committee votes on each article of impeachment, deciding whether to refer each article to the full House for a vote.
If the House Judiciary Committee refers one or more articles of impeachment, the entire House of Representatives votes on whether the article(s) merit a trial in the Senate, needing only a simple majority for approval.
If the full House approves at least one article of impeachment, the President is technically impeached and the matter is referred to the U.S. Senate. The House then appoints members of Congress to act as managers (prosecutors).
The trial of the President is held in the Senate with the Chief Justice of the U.S. Supreme Court presiding. The President can be represented by anyone he chooses. He may appear personally or leave his defense in the hands of his lawyers.
The entire Senate may conduct the trial or it or it may be delegated to a special committee which would report all the evidence to the full Senate.
The actual trial is conducted in a courtroom-like proceeding including examination and cross-examination of witnesses. During questioning, Senators remain silent, directing all questions in writing to the Chief Justice.
After hearing all of the evidence and closing arguments, the Senate deliberates behind closed doors then votes in open session on whether to convict or acquit the President. The vote to convict must be by a two thirds majority, or 67 Senators. If this occurs, the President is removed from office and is succeeded by the Vice President. The Senate’s verdict is final and there is no right of appeal.
