Did Sotomayor help smear Bork?

Republicans have questioned how hard they should fight against Sonia Sotomayor’s confirmation to the Supreme Court.  After all, they have objected the loudest to the dirty tactics unleashed by Democrats in their successful blocking of Robert Bork and their smearing of Clarence Thomas.  Now, however, the AP reports that the group that Sotomayor helped lead took sides in the political battle against Bork that kept him off the bench in 1987:

A Puerto Rican civil rights organization advised by Supreme Court nominee Sonia Sotomayor campaigned against seating conservative Robert Bork on the high court in the late 1980s, according to new documents that shed light on the group that’s become a key focus of Republicans questioning Sotomayor’s fitness to be a justice.

The Puerto Rican Legal Defense and Education Fund officially opposed Bork, whose nomination by President Ronald Reagan was rejected by the Senate in 1987, “because of the threat he poses to the civil rights of the Latino community,” its president reported in one of several documents from the group that the Senate Judiciary Committee released Wednesday.

Does this change the ground rules for Sotomayor’s confirmation hearing?  After all, apart from the beating Thomas took from Howard Metzenbaum, Ted Kennedy, and Joe Biden, the Democrats, the Bork hearing created the poisonous environment that exists to this day on judicial nominations.  If Sotomayor took part in that effort, she’s a political figure — much more so than Bork at the time, and therefore fair game.

Michael Barone looks at how the Ricci reversal also changes the game in the hearings:

Ricci is also something else: a riveting lesson in political sociology, thanks to the concurring opinion by Justice Samuel Alito. It shows how a combination of vote-hungry politicians and local political agitators — you might call them community organizers — worked with the approval of elite legal professionals like Sotomayor to employ racial quotas and preferences in defiance of the words of the Civil Rights Act. …

This is the sort of thing Justice Ruth Bader Ginsburg described in the text as just the workings of politics. Writing in Slate, Yale Law faculty member Emily Bazelon goes further. She laments that the promotion test rewarded memorization and that it favored “‘fire buffs’ — guys who read fire suppression manuals on their down time.”

She is outraged that a fire department might want to promote firefighters who know more about suppressing fires, rescuing victims and protecting their colleagues rather than simply promote a predetermined number of members of specific racial groups whose self-appointed political spokesmen back the politicians in office.

Bazelon and Sotomayor, who voted to uphold the city’s decertification of the promotion test, are typical of liberal elites who are ready to ratify squalid political deals — and blatant racial discrimination — in return for the political support and the votes that can be rallied by the likes of Kimber. You supply the numbers on Election Day, and we’ll supply the verbiage to put a pretty label on your shenanigans.

None of this will keep Sotomayor off the court, especially since the Democrats support this kind of politicking and see nothing wrong with it.  Most Americans, though, will view it with disgust, a rejection of the color-blind society we’d all like to see.  The more this gets exposed, the more Sotomayor will look like an extremist political hack — and so will the man who appointed her.

You supply the numbers on Election Day, and we’ll supply the verbiage to put a pretty label on your shenanigans.

I see that my theory behind the 5-4 vote is getting independent verification.

Telling the truth does not “expend energy” except in some weak metaphorical sense.

I say, since it’s very likely she’ll be seated on the court, it’s best to send her there in shame so that she can be an example of who does not deserve to be there. By going on record with this woman’s racial superiority beliefs and her association with La Raza, future generations will know that her opinions and decisions lack moral authority. And a tough confirmation process will help future generations understand that, at this time in American history, Leftists used to select people with Supreme Court seats based on no other qualification except the color of their skin.

In other words, she’ll be a living example of what is wrong with liberalism as espoused by the modern-day militant Left.

She will sit on the court though anyone with any sense knows she doesn’t belong there. This is a really tough one. The Democrats excoriated Clarence Thomas and never paid a price for that. Even though he has proven to be an excellent justice, the public at large still thinks he was wrongly approved and is a lousy justice.

My point is that Republicans can throw everything they have at opposing her, but she will be approved and then the MSM will cover for her when her inadequacy is revealed in her performance. And, they will paint Republicans as misogynist and racist for having opposed her.

Their champions — Kimber and DeStefano, Bazelon and Sotomayor — are telling them that their way up in life should not be determined by the content of their character or by mastery of their worthy craft, but by the color of their skin. Thanks to Justice Alito, for pulling back the curtain and showing the ugly reality of racial discrimination in America today.

I simply meant the overkill approach trying to stir up controversy? Why bother?

Unless there is something truly huge, 62% of people polled think she should be confirmed. All it will do is make the GOP look as though they are stupid and exaggerating problems due to partisanship.

That’s what I see as “lose-lose.” There is virtue in respectful disagreement with the administration rather than a bunch of “gotcha” type moves from the politicians.

Sarah Palin won my personal respect by pointing out that people are sick of that type of politics. I happen to agree with her on that 100%. We’ve squandered tax money enough on “gotcha” politics. Go play Yahtzee instead, I say. It’s nothing more than pure entertainment.

They are elected to do a job. So do it.

Press her hard, but carefully, is my stance.

Try to stay away from “she’s racist!!” type of hyperbole, say only what’s backed up with her record, and try to get some good hard questions out there. Why was she overturned on Ricci? What was her role in this organization which opposed Bork?

Don’t be dirty about the process, but press for answers. That’s what the confirmation process is for. If she has too many alarm bells ringing, she gets pulled. If she gets confirmed but closely, there are solid grounds to look closely at future decisions.

If you sit down and say “Dems have the votes, why even try?” you don’t deserve to be in leadership in a minority party.

Whenever people see blacks in positions of authority now, can they help but wonder if they were given an easier exam? Can they help but wonder if they were given their promotion because they are black and not because they are qualified?

I will give a more aggressive reply since nobody seems to have read the first.

Because, my friend, America is not confined to your generation, or to the people who are alive to enjoy her benefits today.

And the meaning of conservatism not exhausted by the needs and desires of libertarians and moderates who weigh only their immediate tactical requirements in making their ersatz moral judgments.

America has a future. And we owe it to the future to put on record what the militant Leftists (and apparently now the myopic libertarians and moderates too) tried to do to this country circa 2009.

That’s why we should not curl up like kittens.

Yes, I’ll use the dreaded word, the word libertarians hate: we owe future generations out of our God given sense of altruism. The universe is bigger than any one generation.

The ACORN link is indirect, but her connection to the Puerto Rican Legal Defense Fund (PRLDEF) is very substantive indeed, and coincidentally many of the positions they took echo the Ricci case. To whit:

In 1981, the PRLDEF supported a lawsuit that contended an entry-level government test, known as Professional Administrative Careers Examination, had an adverse impact on the African and Hispanic Americans who failed the exam. The lawsuit argued the test, therefore, violated the 1964 Civil Rights Act …

and -

In 1988, the PRLDEF engaged in a battle with the New York City Police Department over its “racist” promotion exam, ultimately presiding over a radical redesign to allow more minorities to achieve a passing grade. According to The New York Times: “The new test, a four-part exam prepared with the help of an expert designated by the Puerto Rican Legal Defense Fund … involved changes in format, including the addition of open-book questions and a video portion.”

And the FALN terrorists were ‘freedom fighters’ dontcha know.

Vindication should never be a means to promote or disqualify anything in Congress. We should rise above that and present the facts. If people remain focused on these (Americans don’t approve of her, her voting record, etc.), the public perception of the party will grow positively.
However, there is nothing wrong about pointing out historical facts, but when the discussions begin, stick with the facts and concerns.
People should realize that when the chips are down, Americans (regardless of political ideologies) will stand together as a nation. We have seen this after 9/11, on amnesty and oil drilling.

How come then, if a black calls another black the n word, it isn’t racism—only if a non-black does. These rules have got to be consistent or they are meaningless. As a member of Soto’s gender, I feel it only fair that I should be excused from the sexism label if I deem her a member of the extremely ugly woman bloc.

I’m not, by any shakes, a Christian fundamentalist type, but I am very spiritually-oriented.

I don’t mean to sound prissy, but gosh…this type of bashing is offensive to me on a moral ground.

Not everyone is born with symmetrical features. That surely doesn’t mean they can’t be contributers, does it?

Can you not see that that position is not only mentally inconsistent, but also outside the bounds of reality? You are basically saying you want something for nothing, and are willing to trade your freedom for it.
