Did Sotomayor cause the sub-prime meltdown?

I’m no great fan of Sonia Sotomayor, but John Carney over at Business Insider stretches to make a case against the Supreme Court nominee on the basis of the sub-prime meltdown. Sotomayor sat on the board of New York’s state agency on mortgages from 1987 to 1992, and used her position to push for greater lending to low-income families:
Sonia Sotomayor, Barack Obama’s nominee for a seat on the Supreme Court, served on the board of a New York State agency charged with providing discounted mortgages to middle and low income homebuyers from 1987 to 1992. During the time, she was a consistent advocate of pushing the agency to provide more mortgages to low-income home buyers. In short, she advocated the kind of aggressive lending practices that helped create the mortgage meltdown.
Sotomayor’s tenure on the State of New York Mortgage Agency preceeded the current mortgage crisis by close to two decades, so she can’t be held directly responsible for our current problems. But in many ways, her approach to home ownership mirrored–or perhaps foreshadowed–the policies that led to the housing boom and bust.
The agency, which is called SONYMA, is a local version of Fannie Mae and Freddie Mac. It initially provided mortgage insurance to first time homebuyers, mostly on middle-income housing. It expanded into lower-income homebuyers and then into directly buying mortgages in an attempt to push down mortgage rates. During her time on the agency’s board, Sotomayor was a consistent critic of its activities, according to this story in the New York Times. And her critique was always the same: not enough loans were being insured on homes for lower-income and minority buyers.
The New York Times gives this inappropriately positive spin for Sotomayor, though:
Time and again, Sonia Sotomayor challenged her fellow board members at the State of New York Mortgage Agency, asking pointed questions about its work: What of the poor? As we help build new neighborhoods upon the rubble of the old, are we abandoning those with the lowest incomes? …
“Ms. Sotomayor voiced her continuing objection to the rehabilitation of projects in low-income areas without providing for a higher component of low-income families,” according to agency minutes from March 1990. “She repeated her request for an analysis of the various economic groups in the neighborhood affected by the project.”
She ended up voting for most of those projects. But in voicing her concerns, Ms. Sotomayor offered a window into her tough and skeptical style, and into her consistent focus on the poorest of the poor, hundreds of pages of agency records show.
Eh. This has little to do with how she would act as a justice, or in fact little to do with how she’s acted as an appellate jurist. Neither Carney nor the Times draws any lines between Sotomayor’s actions on SONYMA’s board and rulings from the bench. In the absence of such connections, it shows that Sotomayor used her position to argue for looser lending terms, but didn’t abuse her power in that regard.
As it is, though, the main problem with subprime lending started years later, in 1998, when the government mandated that Fannie Mae and Freddie Mac create artificial demand for subprime lending through the issuance of securities on bad loans. SONYMA didn’t do that, and neither did Sotomayor. That blame falls squarely on Congress and the Clinton administration.
Had President Obama appointed her to run HUD, this would be relevant. Since Obama appointed her to the Supreme Court, we should focus on what she did after SONYMA, when Sotomayor took her seat on the federal appellate bench. (via King Banaian)

Oh, I think this bears directly on the prospect of Sotomayor as a SCOTUS justice.
1. She demonstrates here that she will ACT in favor of an entrenched political cabal with a left-wing agenda that, not incidentally, gives that cabal leverage with the business world, and a means of distributing largesse to its constituencies.
2. In any kind of case that comes before the court in which the plaintiff can demonstrate — however speciously — that there has been a “disparate impact” on “victim” groups — is there much doubt how Sotomayor will rule? No matter what the constitutional concerns, if the other justices don’t protect the issue by some means from politically-motivated decision, we can probably expect Sotomayor to rule in despite of obligations to the constitution.

A: She, like all the other liberals who pushed for NINJA, is indeed responsible. Obama, Franks, Waters, Sotomayor, LLC, destroyers of the nation’s economy.
It’s indeed abuse of power when you take someone’s money and give it to someone else. When the government artificially inflated the price of real estate, it prevented the children of the middle class (who are not eligible for the sweetheart NINJA terms) access to the real estate market.
The market is now adjusting itself to the laws of supply and demand — and will continue to do so until the government’s attempts to provide loans for the NINJAs begin to cause yet another bubble in the market.

Ah, but she encouraged bad loans, so she must think it’s okay. The idea of giving bad loans had to have some roots in order to escalate to the point it was when the melt down occurred. Her involvement in the 90’s fiasco may not have been as detrimental as Obama’s involvement, (lawyer and advisor for ACORN’s bullying banks to make bad loans, but she certainly appears to be made of the same cloth. That’s why Obama nominated her.

Yes and no.
It is somewhat of a stretch but I want to know what she said during this period about liberal “rights” like home ownership for people who have no business being qualified for mortgages. That along with her racist comments, affiliation with racist organizations, her refusal to let white firefighters have a fair shot at promotion and a pattern begins to emerge. It probably isn’t enough to keep her off the bench (I’m neutral though I don’t think she’s all that wise a Latina) but she should be fully vetted. Part of that vetting includes some discussion as to how she views these liberal rights because it is in this area that the activist jurists are killing America.
P.S. What I’ve seen of her record has me thinking that she will get the seat and then decide that “social justice” means all sorts of crap from the liberal agenda of rewarding the unproductive at the expense of the producers.

Blaming Sotomayor for the sub-prime meltdown is a huge mistake. The blame belongs on the Democratic Party politicians who regulated banking on the bogus premise that racism comes before profit for bankers and those politicians who worked so that regulation got enforced and wasn’t repealed. What a stupid statement.
First off, popularity in general polling is not the same thing as vetting a potential supreme court justice. Just because she has an interesting “life story” does not mean that she was indeed a wise Latina on the bench or that she really is qualified for the job. The only polls that matter in this case are the votes at the Senate Judiciary Committee and the floor vote in the Senate if she passes muster in committee. All other polls are meaningless because it only how the public “feels” about this nominee and that doesn’t come into play unless there really is a smoking gun that proves her a racist.
Secondly, why don’t you like dissenting opinions? The GOP should be out there making sure that the candiate is properly vetted. It is not a war for the GOP Senators to take their jobs seriously instead of rubber stamping the nomination the way Durbin, Schumer, et. al. would do.

Obama’s over-reach on Sotomayor and Healthcare have really shaken off his fairy dust spell, people are seeing his unicorn promises to be nothing more than dressed up pit-bulls.
The long term reality of the SCOTUS really woke up a few “casual” Obama voters I work with. Too late for ‘08 but not for ‘10. Healthcare is waking up the rest – even the zombies. The educated won’t stay stupefied by persona much longer.
So the more we know about Sotomayor and her history – the better. No she is not responsible for the sub-prime crisis but she does support irresponsible class-based preference – is that the judgement we want on our highest court?

Ok, just so that everyone on this board understands: I am a mortgage banker. I am an approved SONYMA lender. Trust me when I say this: SONYMA is one of the strictest state bond programs in the country. Credit, assets, income verfication are all tough. 3 year history required, the debt to income ratio (how much you borrow versus how much you can pay monthly)is very strict. Fannie Mae, Freddie Mac, FHA, and sub-prime lenders played a role in this (and I have sold loans for all of those programs) but a place like SONYMA is actually a fantastic program for a 1st time buyer.
Let’s direct our ire at those who deserve it…

Sure it does. As the Times writes it, Sonia was chiefly concerned about the plight of the poor, rather than the plight of the not-so-poor. More units of the lowest-end housing means fewer units that are better, fewer opportunities for someone to work a little harder and get a better place.
In short, it shows favoritism for one group over another, instead of applying the rules as they exist. A notably non-judicial temperment.

All govt programs do the same thing: allow people who can’t qualify for a mortgage the old fashioned way (save for a down payment, have goo credit, have a job) to get a mortgage. If someone can qualify at Bank of America they don’t need SONYMA. If they can’t they go to SONYMA and get a loan they can’t otherwise get on the open market.
Think about it. Why would SONYMA exist if not to give the rejects a second shot? It is the lender of last resort for deadbeats. And we – taxpayers – are left holding the bag when they eventually foreclose.

That’s an old canard. We lose Latinos for the same reason we lose lots of people- the GOPs loss of identity. Once we reconnect to our core principles, Latinos will start to notice how closely our morals resemble theirs.
Anyway, why should the GOP fear losing Latino voters? The Dems practically pinned horns and a tail on Alberto Gonzalez, and it didn’t hurt them…

I respectfully disagree. SONYMA is actually a lender of first resort, and if people don’t qualify, then we go to other programs. Please, if you are not a licensed mortgage banker in the state of New York, do not assume to know anything about it. If you were, you’d understand that SONYMA was not, and is not, at the core of the issues.
Again, direct your anger to programs which caused the problem, but if you look at the default rates of SONYMA loans versus the FHA loans, or FNMA/FHLMC loans, you’d understand the mistake in your ‘knowledge’.

Jeff, I understand that, and don’t expect anything less than a total scrutiny of what is said. That being said, I’m not here defending mortgage folks, we’ve got a lot of blood on our hands right now (even the good ones, where I consider myself to be). And I’m not accusing you of being a knuckle dragging toglodyte, although I like the term…
My intention is to point out the misdirection here. This program in specific, is NOT the cause of a lot of the problems in the way things like CRA or FHA and the sub-prime loans were. That’s all I’m saying.

Seriously, though, blaming the sub-prime meltdown on Sotomayor is not only a stretch, but it shifts the focus from the real culprits – Franklin Raines, Chris Dodd, Barney Frank, George Soros and Maxine Waters – and dilutes the valid reasons why she should not be confirmed.
She’s got more than enough baggage to tank her ascension, but it will not matter because every honest person knows that anyone who questions her qualifications will be branded an anti-Hispanic, anti-woman,

No kidding. I have a SONYMA mortgage and the amount of paperwork I had to submit was incredible (seven-times the amount required for a conventional mortgage, according to the broker). But it was worth it. You get a low rate, fixed mortgage with excellent terms.
It is not a program for subprime borrowers and kudos to the board members for ignoring Sotomayor’s complaints.

You don’t govern by following polls. You start out with well thought out core values, speak to the people of those core values and that way you don’t need a teleprompter to lie to the people. Judges should follow the law, not make the law, like she openly admits to doing. She should run for congress, not be a judge. Liberals think they have the first original idea, they don’t study history. Socialism and Communism are failed ideas. Keynesian economics is a failed idea, given up by most governments. The founding fathers were very intelligent and came up with a great system. To bad we are not following it.
