Video: Sotomayor explains how men subconsciously discriminate
posted at 4:05 pm on June 19, 2009 by Ed Morrissey
Greg Hengler has this interesting but relatively unsurprising clip of Sonia Sotomayor explaining in 1986 the difficulties women face in male-dominated professions, such as the law, as Sotomayor claimed on Good Morning America. The clip comes from a round-table discussion by successful women on the hurdles they faced in succeeding in a man’s world. Mostly, it’s standard boilerplate, except curiously for Sotomayor’s complaint about dating:
Honestly, I don’t find her description of the mechanism of bias all that surprising or objectionable. Certainly, people internalize their own experiences and rely on them when making subjective decisions on hiring and promotion; in a more positive context, it’s called instinct, and any good hiring manager has to rely on it. In 1986, I’d agree that the women’s movement had yet to overcome that built-in bias in hiring and promotions, but that’s changed in the last 23 years as women moved upwards. “Images of success” are as female as male now, and as ethnically diverse, too.
But the complaint about dating I find strange. If a woman tells a man she’s too busy to see him three times, should she be surprised when he stops calling? If he kept calling, some would define that as stalking. Sotomayor endorses a remarkably passive role in this instance, because the solution to this problem would have been to suggest another day on the schedule when declining an invite.

I’m sorry was she talking? I couldn’t get past the rose colored glasses.
Did libs in the 80′s wear rose colored glasses because they were so angry all the time that if they didn’t they would go insane with how unhappy they were on the inside?

What guy is going to call the 1986 Sotomayor three times?
lowandslow on June 19, 2009 at 4:12 PM
So, I discriminate sub-conciously because I’m male.
Hmmmmm…I guess that means it’s not a choice, because I was born that way. It’s not my fault.
I feel as if a great weight has been lifted, now that I can finally come out of the closet and discriminate freely against women.
Liberation is cool, man!

She’s not totally out of line since the first stalking laws were implemented around 1990 in California.
Persistence was still considered persistence, not stalking.

Bullshit. I graduated from law school in ’83. In my first year, ’80, women were MORE than half of the student body.
Failures usually have to come up with excuses. Or, those who didn’t deserve to be where they are, in the first place, and know it. Let’s just call it an internalized inferiority complex.

Frankly, unless a man is just interested in a meal ticket, I find it hard to imagine one asking Sotomayor on even one date.
jeanie on June 19, 2009 at 4:17 PM
Perhaps I only state the obvious, but she then clearly believes that every member of the current SCOTUS is ineligible to be Justices on the court solely on the basis of gender.
I find plenty of things wrongfully discriminatory in this statement. With this very broad brush she disqualifies at least half the standing population from being justices and serving on juries, as well as kneecapping that half of the standing population when it comes to holding other important positions (in government, law, or otherwise).

The 80′s was only good for one thing: the solid rock and roll (and that’s in the first half). I forget about Reaganomics but that’s another story.
And if you saw the rock bands, they had NO fashion sense. Granted, I’m a straight Physics student and I’m not a gay fashion manager but man… my cat could’ve dressed better than them.
Heck… my cat could probably dress herself better than Sotomayor in the 80′s.

I’ve never understood the complaint by contemporary American women that “it’s a man’s world,” references to “glass ceilings,” etc.
Women are strong, intelligent, dynamic people. They aren’t mindless, defenseless potted plants.
If it is or was a “man’s world” with a “glass ceiling” reeking of “inequality,” then that’s your fault.
As an American man, I don’t own you, control you, dictate to you, or force you to accept or abide by anything. Nor do I want to.
If you’re a woman and you find yourself lamenting your place in this country, blame yourself. You own it.
To do otherwise only suggests a philosophy of weakness, lack of internal and external strength, and helplessness.
You’re smarter, stronger, and better than that.
Have a day.

What do you mean “used to be?”
TMK on June 19, 2009 at 4:28 PM
I graduated in 1977, and my class was about 50% then, too. If she wanted to be taken seriously, she could have ditched the pink blouses and baby blue suits. Back then, the Dress for Success navy suit, white shirt, floppy bowtie was the Woman Lawyer Who Wants to Be Taken Seriously uniform.
By the way, those pink-tinged lenses were popular in the late 1970s and early 1980s. Supposed to be more flattering somehow than clear glass, but women who wore them also got the unflattering giant frames with them.
Sonia, did you never hear of Dorothy Parker’s comment about women who wear glasses?

progressoverpeace on June 19, 2009 at 4:29 PM
From Sotomayor’s quotes, if she meant to apply her principles consistently, she’d be castigating David Letterman.
Though I’d enjoy Letterman’s ass whoopin’, her giving it to him wouldn’t alter her horrible anti-Constitutional revisions she has planned for the SCOTUS.

The difference is that she supports government intervention, and sees the Constitution as no bar to that. Thomas Jefferson noted that taking away someone’s choice was not a good response. If you don’t like what someone chooses to do, explain to them a better way. That’s the difference between liberals and conservatives. Liberals want to be in control; conservatives want to be free.

I had a guy call me three times in high school. I really didn’t want to hurt his feelings by telling him no (not sure why I thought constantly being busy was a kinder way to let him down, but, I was young). Anyhow, he called three times and it drove me crazy because I felt that he should have had the message the first time. After all, if someone says, “Are you busy on Friday.” and you say, “Yep. Sorry.” instead of “Yes, but I’m free next Friday and I’d love to go out with you!” they are basically saying, “I’m not interested.”
If she somehow thinks that a guy should just keep calling until he magically hits on a day that the girl is available, he’s crazy.
Furthermore, did it ever occur to her that a guy might want a girl that’s interested in him enough to make time to go out with him? So, even if she really was that busy each time he called, the guy might have figured out that he wouldn’t be a priority for her and decided to go a different way. Is it such a bad thing for guys to have their own preferences and priorities? Or, should they be slaves to whatever women desire?
JadeNYU on June 19, 2009 at 4:34 PM
Sotomayor as a smart Latina woman, with her experiences, will bring about better decisions, than a white man, about building Tacos and washing clothes by a stream with a rock, should the Supreme Court ever have case involving those things.

Like Ed, I’m don’t find her descriptions of the functions of bias surprising or objectionable – we all know how it worked in the past, and has improved since.
What is appalling to me is the ready assumption by everyone on the set to instantly believe (and not question or scrtutinize) that a ‘wise latina woman’ with such ‘rich experience’ (what she said elsewhere) would never be guilty of similar biases?
…and she never would have even gotten that first (not to mention third) phone call from me… yes, the 80s were not kind to her.
