Shocker: New Obama appointee has a tax problem

Barack Obama plans to make sure his administration finds everyone who’s not paying their taxes — and apparently hire them to work in government.  The latest appointment to make an emergency call to H&R Block is Capricia Marshall, who worked for Hillary Clinton’s Senate and presidential campaigns until now.  And while tax evader Tim Geithner’s appointment to run Treasury and the IRS still wins the irony competition, Marshall may come a close second:

President Obama’s choice as chief of protocol for the State Department, a position that carries the status of an ambassadorship, did not file tax returns for 2005 and 2006, errors she corrected last November.

The nominee, Capricia Penavic Marshall, has placed blame for the problem on the Postal Service and on miscommunication between her husband and their accountant.

No — please tell me she didn’t just blame the Post Office for losing her returns two years in a row.  Yes, she did:

In her written answers and in accounts she gave to government officials, Ms. Marshall has said the errors were unintentional. She has said that her husband failed to recognize that the couple’s accountant had included the tax returns for 2005 in a binder he provided with copies of the returns, and that the actual paperwork was never mailed.

The couple learned something was awry, Ms. Marshall has said, when the Internal Revenue Service notified them last fall that their 2006 return had never arrived. She wrote that an agent “advised us that there were a large number of tax returns misplaced by the D.C. post office for the 2006 tax year.”

That call led the couple to the discovery that the authorities had no record of their returns for 2005 and 2006. No late fees or penalties were assessed when they later submitted the returns.

Does the dog eat her homework, too?

It seems awfully convenient that the one post office that lost “a large number of tax returns” was the one that would handle returns for most federal officeholders and their staffs, too.  Isn’t it a little remarkable that the IRS didn’t penalize the Marshalls for late returns?  Those of us who don’t work on Hillary Clinton’s staff would not get treated so kindly.  Besides, If the DC post office lost “a large number of tax returns” in 2006, why did that let them off the hook for 2005?

Unless the Marshalls somehow managed to pull off the remarkable feat of getting exactly the right amount of tax withheld two years in a row, they would either have had to write a check to the IRS or get one back as a refund.  Does Marshall mean to tell us that these two successful people and their accountant never noticed that the check didn’t clear or that they didn’t get the refund?  How have they balanced their checkbook since 2005?  Of course, given the way this administration spends money, a balanced checkbook might be a disqualifier.

And what will Marshall do once she takes her job?

The protocol chief customarily helps plan events for visiting leaders and helps oversee protocol matters for the president and vice president abroad.

Well, she’s certainly proven adept at planning and process, hasn’t she?

No one doubts that the president who gave Region 1 DVDs to the British Prime Minister as an official gift and an iPod to the Queen with his own speeches preloaded needs a Chief of Protocol — and needs one very badly.  However, can this administration pick someone — anyone — who has paid their taxes properly?

Not only Obama, but Hillary is on the tax evasion bandwagon. So if she’s holding her breath waiting for Obama’s Impeachment, her hands are as dirty as his.

In the 45+ plus years I spent trying to earn a living most,if not all,of those years relied heavily on the US Postal service. While it is easy to blame the USPS when you didn’t receive(or your customer didn’t receive)a piece of mail, the truth is that very seldom if ever was something lost in the mails. Late? Hell yes. Lost nah!
For this woman to claim that in two successive years the same piece of mail to the same recipient was lost by the postal service, strains credulity. To put it in diplomatic terms

btw, one year the post office did lose my return. I received a postcard from the IRS asking me to send them a copy of my return as they had never received it, which I did, and that ended that. I wonder why Ms. Fraud didn’t get a postcard. I think her mailman ought to be fired.

Isn’t it a little remarkable that the IRS didn’t penalize the Marshalls for late returns? Those of us who don’t work on Hillary Clinton’s staff would not get treated so kindly.

Actually, as someone who works in that business, I can say it is pretty standard procedure for the IRS. There usually isn’t a penalty for a late return, as long as you have had enough withheld to cover your tax liability.

Think about it … if the IRS owes you, are they really going to care if you decide not to file for your refund??? It just means they get to keep your money.

Come on Mr. Morrissey, in spite of what anyone thinks of the Obama administration, that statement is unfair and much too general of an assessment.

While the Obama administration may be guilty of not researching their appointees very well, to imply that being a tax dodger is a requirement for consideration is actually quite dubious.
The administration wants as many taxpayers as it can get.

After all, it’s spending money it hasn’t got.

Time out. I’ve been in a similar circumstance of getting way behind in filing.

You can’t get away with it and the IRS will be more than happy to place you behind bars and clamp down on your assets should the deliquency not be resolved.

It would mean that besides filing late, she paid a hefty penalty plus interest.

This is not the same as not reporting income on a filed return.

Am I right or wrong?

This may well be true of Ogabe’s appointments, but remember that 52% of the electorate proved easy to manipulate and control and I don’t think they all lack integrity. Common sense maybe. The question is how many of that 52% are starting to acquire some. As usual, an honest and responsible media would help. Wish we had one.

She didn’t get penalized because she was owed significant refunds. There is generally no penalty for filing a late return when owed a refund (except potential to lose your refund eventually). Still lame to blame USPS AND accountant.

OK, a few observations:
1) If the photo on the front page is to be believed, she’s hot. OK, that’s out of the way.
2) She didn’t inconvenience the taxpayers; rather, she did us all a favor. She was owed $37,000 across the two years, so she gave us a low-interest loan for a while.
3) She corrected this problem BEFORE she was up for this appointment, presumably well before her name was being tossed around for it. She corrected the problem last November.
4) Accountants and the post office do foul up all the time, no offense to either. I wouldn’t want either job, that’s for sure. We all foul up a bit at all of our jobs; to err is human.
5) People with weak, embarrassing stories such as this one generally are telling the truth, I’ve found. It’s the clever stories we have to probe (think Geithner and Daschle).
Based on my bias of #1, the favorability of #2 and #3, and my experience with #5, I’m inclined to believe her on #4.

So that you don’t think I’m a troll…
6) For heaven’s sake, unless you’re Buffett, Gates, or a Walton heir, how do you not notice that your check for $37,000 didn’t come in the mail or show up as a direct deposit on your bank statement? Man, I could do awesome things with that kind of windfall.
7) I’m starting to think that an audit of your home finances ought to be required as a prerequisite for any government appointment. If she’s this careless in her own house, how much careful will she be with matters in OUR house?
8) What kind of dunce is this Obama guy anyway, not asking people about their taxes even now before he gets their names out?

Many people fail to file. I suspect there is very little truth in her claim. I also know there are shocking numbers out there of people that do NOT comply with the census. It must be worse this times since sane people do not want ACORN’s nose in their information. It is of course to leak out census. info. But we have records that indicate laws are for dummies. \One reason some do not file is because they lied big time and by signing and submitting a false report, they think they can be in a big legal mess. They can.

My grandmother did once, and I guarantee you she was no Dem lackey. The envelope fell behind her dresser and didn’t get seen for eight months. She found it inadvertently and called the IRS immediately. They told her, “No problem, send it in, thanks for being honest.”

I’m assuming that with a name like Capricia Penavic Marshall and the position Obama wants her to fill, Chief of Protocol for the State Department, this is not a woman who would be eligible to use the 1040 EZ form. Which means in 2006 and 2007 whoever her tax lawyers were probably were already familiar with the IRS’s e-file program. Though I suppose her preparers may have some sort of phobia about the interweb thingy and preferred to do things the old-fashioned way, or they might have been told by Tim Geithner about how tough that TurboTax system could be.

I hate to play Devil’s Advocate here, but if she was due a refund, don’t you think she might just be telling the truth? She’s not trying to actually evade anything, unlike Geithner and other appointees.

Actually, I have to think Marshall’s are pretty shrewd to make up lots of numbers so as to show a refund and escape both interest and penalties, not to mention being put in the tax evader category by this public revelation.

Of course it could be shown I am wrong in my opinion about their shrewdness and wrong about my conjecture that they made up numbers, if the Marshall’s also got mega-refunds in both 2004 and 2007. But how likely is that?

Also, her husband is a cardiologist. I know a bunch of doctors, none of whom are very sharp when it comes to managing their money – which is why their paychecks go directly into brokerage accounts.

It could be that their brokerage account is so large that they didn’t notice the return wasn’t there. Remember that cardiologists make a LOT of money.

Again, I’m just playing devil’s advocate here.

What really chaps my ass on all of the tax cheats is the fact that they don’t have to pay penalties or interests.

A few years ago it was discovered that the DoD finance office had made an error in reporting withholdings from retirees pay. I got slapped for not only the back taxes but interest as well on something that was not not my fault and I was not aware of. You don’t make enough money on an enlisted mans retirement pay to afford an accountant like these folks do.

She has said that her husband failed to recognize that the couple’s accountant had included the tax returns for 2005 in a binder he provided with copies of the returns, and that the actual paperwork was never mailed.

First thing I would have done is fire my accountant for gross malpractice.

It’s hard to pay a penalty if you don’t owe any money.

I think at the very least they should fire their accountant and find someone more competent. But, I’m not convinced that she acted maliciously since she didn’t owe any money.

Hmmm. Last year we purposely filed extensions due to our own lack of getting our records completed, and then our accountant’s son-in-law DIED – delaying our filing longer.

We received a refund, but six weeks later, we received a bill from the IRS for late fees for filing two extensions. Of course, like good little citizens (who are more afraid of the IRS than an intruder in our home), we paid it.

She blames the USPS and her accountant and no penalties?

Sounds fair to me.

Unless something was calculated wrong on your original return (i.e., you got more of a refund than you should have), I don’t see how that was possible. Penalties are based on amount of tax owed and the length of time that it is late. If you recieved a refund, there was zero due – thus 5% penalty on zero due, is zero. Sounds like the IRS screwed up to me. Your accountant could/should have taken care of it for you.

You know, Dear Leader could have avoided all of this by following his own precedent, and naming her the, what 85th czar. No hearings, no oversight, no fuss. And historically, the Czars were well known for their fabulous gift giving and social protocol – seems like a win to me.

Update: At the end of the TOTUS first and hopefully only term, while plans for a presidential library have been scrapped, plans for a presidential penitentiary are moving along swimingly.
