FBI probing obstruction of justice in related Walpin case; Update: Walpin breaks out the Obamateurism defense

posted at 12:55 pm on June 17, 2009 by Ed Morrissey

Did the Obama administration rush to close a probe into fraud committed by a political ally before discovering obstruction of justice?  The Sacramento Bee reports that a former official at St. HOPE alleges that now-Mayor Kevin Johnson’s emails relating to the fraudulent use of money were deleted from the servers in order to obstruct the investigation that Gerald Walpin conducted:

The FBI’s Sacramento division is investigating a former St. HOPE executive’s allegations of obstruction of justice, Acting U.S. Attorney Lawrence G. Brown confirmed Tuesday.

The news fuels the controversy that has followed Mayor Kevin Johnson since 2008, when his brainchild St. HOPE Academy first was investigated for misuse of public funds.

That investigation appeared to end in April when Brown’s office announced a settlement with Johnson, St. HOPE and former executive director Dana Gonzalez.

The settlement, hotly contested by the office of the inspector general for the federal Corporation for National and Community Service, required the repayment of more than $400,000 in misused grants for AmeriCorps volunteers.

However, Rick Maya, who officially left his position as executive director with St. HOPE last week, alleged in an April resignation letter that a member of the charter schools’ board deleted Johnson’s e-mails during the federal investigation. Those claims, uncovered by a public records request by The Bee, caught the interest of Brown’s office, who asked the FBI’s Sacramento division to look into it.

Gerald Walpin ran afoul of the Obama administration when he balked at the settlement talks, angry that Johnson didn’t have to return all the money he admitted to gaining from the government through fraud — and that he would once again be allowed to manage federal funds at all.  He reported on his dissent to Congress, after which the White House attempted to bully him into resigning.  When that didn’t work, the White House then announced that Walpin was incompetent and strongly suggested that he was senile as well.

Now, it looks like the White House is the one with a cognitive problem.  It seems that they rushed a conclusion to the investigation without checking on the cooperation of the accused or even determining whether they had seen all of the evidence.  And when the independent Inspector General tried to make that very point, the White House attacked him instead of the person who defrauded the government and may have obstructed justice on top of it.

Democrats screeched about the politicization of the Department of Justice when Bush asked for the resignations of political appointees who worked completely at his pleasure.  They assumed that Bush wanted the US Attorneys out of the way for political reasons.  Here we have a White House attacking an IG, authorized by both Congress and the White House and supposedly independent, for objecting to a political payoff for a high-profile Obama supporter.  When do we hear that same outrage over politicization of law enforcement?

Update: No matter which way you go on the Walpin case, you have to admire the man’s huevos grandes:

In the letter, White House Special Counsel Norman Eisen wrote that Walpin was “confused” and “disoriented” at a May board meeting, was “unduly disruptive,” and exhibited a “lack of candor” in providing information to decision makers.

“That’s a total lie,” Walpin said of the latter charge. And he said the accusation that he was dazed and confused at one meeting out of many was not only false, but poor rationale for his ouster.

“It appears to suggest that I was removed because I was disabled — based on one occasion out of hundreds,” he said.

“I would never say President Obama doesn’t have the capacity to continue to serve because of his (statement) that there are 56 states,” Walpin said, adding that the same holds for Vice President Biden and his “many express confusions that have been highlighted by the media.” Obama mistakenly said once on the campaign trail that he had traveled to 57 states.

Come on, Inspector Walpin.  Can’t a man just eat his waffle?

I don’t really know anything about Walpin, but I’d bet $5 he voted for obama.

JiangxiDad on June 17, 2009 at 1:21 PM

On his interview on Beck, he said that he had been talking to the White House several times that same week, helping them because he was supporting Sotomayor. (I think he said he was a Republican.) But the point was that the phone call from the White House was not unusual. He don’t recall him stating his vote, but he was a “friend” of the White House, until …

As soon as Laura Ingraham, Levin and Beck check this guy out completly, I am ready to donate to his legal fund.

If he’s talking about the 56-57 states thing, it’s doubtful.

baldilocks on June 17, 2009 at 1:28 PM

At least now I understand why Obama is pro-charter school. It’s a good revenue source from the government for his friends.

MayBee on June 17, 2009 at 1:29 PM

I believe Obama to be both an anti-semite and anti-Israel. I assume Walpin is Jewish, and if so, I assume that part of the reason for his ouster was to prevent a jew from exposing illegality on the part of a black mayor.

JiangxiDad on June 17, 2009 at 1:20 PM

makes sense, cause many of us beleive him to be a closet muslim,

SHARPTOOTH on June 17, 2009 at 1:29 PM

I am all for getting Obama. But doesn’t Walpin serve at the pleasure of the president? Marbury vs Madison resolved this issue long ago. Even though the Media and Liberals ginned up a controversy during the Bush years because he fired those lawyers.

I’m afraid Walpin is senile. Obambi claimed there were 57 states. **sigh**

I see what you are saying.
I’m not sure if Walpin is a Jew, but this is from his official bio at American Inns of Court:

“He [Walpin] is also a trustee of the Parker Jewish Institute for Health Care and Rehabilitation, of which he was formerly Chairman of the Board. For four years, he served as Co-Chairman of the Lawyers Division in New York of the Anti-Defamation League.”

ExcessivelyDiverted on June 17, 2009 at 1:29 PM

Yes, Gerald Walpin is Jewish, and Kevin Johnson is a former NBA player. Does anyone see a pattern here?

It’s as plain as day.

baldilocks on June 17, 2009 at 1:30 PM

But doesn’t Walpin serve at the pleasure of the president?

No. He is not a US atty. There is a law, sponsored by Obama himself, that explains the methodology for firing an Inspector General. Obama violated the law.

JiangxiDad on June 17, 2009 at 1:30 PM

Skandia Recluse, I was told by the US Attorney’s office in my state that they can’t investigate something that hasn’t been referred to them by some other agency – namely, the FBI. This was right after the FBI told me 3 times, angrily, that the FBI doesn’t investigate document fraud. A lie easily exposed when I went online to file a report of document fraud, which was then forwarded to the FBI.

Why did the FBI guy lie to me three times?

I’ve heard stories and never knew how to take them. When this happened to me personally things began to look very, very scary to me in this country.

I 3-mailed my local sheriff’s office asking questions about interstate cooperation in investigations of document fraud – and gave him specific evidence of document fraud. Said I’d appreciate hearing back ASAP. That was last week. I haven’t heard anything back yet.

I honestly don’t know how deep this crap goes. Do we even have any law enforcement left in this country? I honestly can’t say, and that by itself is a scary thought.

The FBI’s Sacramento division is investigating a former St. HOPE executive’s allegations of obstruction of justice, Acting U.S. Attorney Lawrence G. Brown confirmed Tuesday.

Sacramento Bee, June 18, 2009: Attorney General Eric Holder announced today that Lawrence G. Brown has been relieved of his functions as Acting U.S. Attorney, pending psychiatric evaluation and treatment, after suffering from paranoid delusions that Sacramento Mayor Kevin Johnson had misused public funds. Mr. Holder added that Mr. Brown may be returned to his functions after undergoing a frontal lobotomy.

I’m betting this story is a lot bigger than Obama protecting his buddy and mayor of Sacramento… that allowing the Johnson investigation to proceed would likely lead to a broader investigation of AmeriCorps, showing coordinated misuse of public funds and systemic corruption. Shades of ACORN.

petefrt on June 17, 2009 at 1:26 PM

Correct. Take a look see at who runs AmeriCorps and who runs the organizations where the money goes to. THEY ARE ALL COMMUNITY ORGANIZERS. With Walpin gone, there IS NO OVERSIGHT. It’s a huge crooked story that won’t be told.

Congress will never take Obama out. In the 90’s Congress had both the Cox Report and the Thompson Report which showed that the Clinton administration was deeply involved in treason but Janet Reno just refused to investigate and that was that.

Then the whole nation heard all the sordid details of How Clinton committed perjury and obstruction of justice – only to have the senators giggle that it was only about – tee-hee – sex. Guilty as sin, free as a bird.

georgeofthedesert on June 17, 2009 at 3:30 PM

All this stuff going on in Washington is unbelievable. There has to be some way to get some of these crooks out of there and punished for their crimes. If Bush and his administration had of done any of these things, they would have already impeached him.

Can’t the Republicans or someone take this to the Supreme Court or something? How do we get around a Democrat Congress that won’t uphold the law and Justice Dept that won’t enforce it? There has to be something we can do! Screaming at our senators and legislators doesn’t seem to get anything done, and three and a half more years of this will totally destroy this Country! I am beginning to feel like I live in Mexico, where everyone in the Government is corrupt and you cannot trust anyone.

Susanboo on June 17, 2009 at 3:34 PM

However, Rick Maya, who officially left his position as executive director with St. HOPE last week, alleged in an April resignation letter that a member of the charter schools’ board deleted Johnson’s e-mails during the federal investigation. Those claims, uncovered by a public records request by The Bee, caught the interest of Brown’s office, who asked the FBI’s Sacramento division to look into it.

Oh, The SacBee uncovered that detail? Heh.

Funny, I learned about it Monday when Walpin dropped that bomb in his interview on The Laura Ingraham Show (audio here). But she’s not a jourrrrnalist, so it doesn’t count.

using fifty-SIX instead of “57″, just so that in order to correct HIM the press would have to point out that Obama ACTUALLY said “57″!!

Brilliant!!!!

Justrand on June 17, 2009 at 1:53 PM

Actually it was 60…
He stated he had been to 57 with one more to go, and his handlers would not let him go to Hawaii or Alaska.
So he was thinking there were 60 states…

Aren’t you the goober who was making anti military statements a while back? Think that may be why you have no credibility?

Can the Administration and Congress be prosecuted in a RICO action?

Walpin soon to equal Vince Foster?

SouthernGent on June 17, 2009 at 4:01 PM

Correct. Take a look see at who runs AmeriCorps and who runs the organizations where the money goes to. THEY ARE ALL COMMUNITY ORGANIZERS. With Walpin gone, there IS NO OVERSIGHT. It’s a huge crooked story that won’t be told.

marklmail on June 17, 2009 at 1:44 PM

This is the real story. This firing is not about Kevin Johnson, it’s about all the other Obama cronies and crooked community organizers waiting to get their goodies from the $6 billion CNCS slush fund. Putting Michelle’s COS in there, installing a big donor as the agency director, and now firing the Inspector General. Isn’t it obvious? It isn’t a coverup, more like a preemptive strike to protect future corruption from discovery.

And I think it is obvious that Walpin is a Republican and a Jew. That makes him practically radioactive in this Administration.

rockmom on June 17, 2009 at 4:02 PM

Walpin soon to equal Vince Foster?

SouthernGent on June 17, 2009 at 4:01 PM

That’s just too awful to even contemplate!

More likely he’ll end up receiving a dead fish in the mail.

tru2tx on June 17, 2009 at 4:05 PM

It’s not good to piss off old people, Obama. They have seen punk kids before and this time they will do something about it!
Set up your legal defense fund and I’ll contribute!

“What did the President know and when did he know it?”

Remember that Watergate wasn’t Watergate when the story broke – it was just a bungled burglary. Didn’t seem like much at the time.

I have been convinced for a very long time that this man and his associates are crooked as any Mafia organization (with apologies to all of the honest, hardworking Mafiosi out there that may be insulted by being compared to Obama).

And don’t be afraid of a President Biden. He doesn’t harbor any of the deliberate malfeasance of Obama.

Let me get this straight. The one thing we can prove Obama accomplished as a Senator. That one thing, he didn’t remember and violated.

Really?? For reals??

He helped make it law, then didn’t abide by that law?

Seriously! One day, is all I ask! One day where /facepalm isn’t necessary! Why is this too much?

Pomme143 on June 17, 2009 at 5:09 PM

Here we have a White House attacking an IG

This is a disturbing pattern from Obama’s administration.

Attacked Wall Street
Attacked Rush
Attacked GM Bond Holders
Attacks Fox News

TN Mom on June 17, 2009 at 5:12 PM

Rather than slink quietly into the night, Mr. Walpin turned on his attacker and showed his fangs. God bless him and keep him safe. He may not know the size of the target he’s pasted on his own back by simply defending himself.
On the plus side, it appears that Ogabe expected Mr. Walpin to die quietly and is not prepared for a push-back. Is this the crack in the dam we’ve been waiting for? A real journalist could run far with this story. Wish we had one.

SKYFOX on June 17, 2009 at 5:15 PM

Praying for both Mr. Walpin and Mr. Maya.

This meeting where the WH accuses Mr. Walpin of being “disoriented” would have minutes, no? Surely this is easily disproven.

No, you stinking liar, fake GI and fake Christian, I’m not. I’ve been blogging under my real name for six years and am a USAF/USAFR retiree, DD Form 214 available upon polite request.

Think that may be why you have no credibility?

TTheoLogan on June 17, 2009 at 1:52 PM

I think maybe you don’t know what you’re talking about–again, you senile serial fabricator.

baldilocks on June 17, 2009 at 6:14 PM

Hey liberals…

If Bush firing some Attorneys was such a “crime” then why don’t you have a problem with your child king BREAKING A FEDERAL LAW he helped write?

Oh I forgot… It’s ONLY a “crime” when you SAY it is…

babydoll4you on June 17, 2009 at 6:18 PM

This has been a fascinating saga, replete with croneyism, political payback, attempted firing by proxy, and a protracted smear campaign – it’s a friggin’ Hollywood movie!

Transparency and ethics be damned – Hope and Change Baby!

Harpoon on June 17, 2009 at 2:59 PM

Right on. It’s pathetically obvious that the whole “disoriented and confused” allegations are completely fabricated.

karlant on June 17, 2009 at 7:07 PM

For some people, living according to high principles of personal integrity trumps everything else. Sarah Palin is one of those people. Gerald Walpin is one of those people.

As far as Palin, you don’t ever mess with a woman’s family. It only makes her tougher and harder than ever to beat.

For Walpin: you don’t EVER mess with old guys! They have been through it all, seen it all, nothing like this kind of crap is going to beat Walpin. According to his interview on Beck today, Walpin came out of retirement to do this job when GWB asked him two years ago. He has a few good years left. He is not going to waste them wimping out and going down without a fight.

This is gonna be good. GO WALPIN! You’ve got “We the People” with you all the way.

winfield on June 17, 2009 at 7:35 PM

Saw him on Beck. He’s been around since Watergate, an investigative servant of even-handed justice. Obama’s treatment of him is despicable.

Walpin is obviously confused about what his role is in this new administration. He’s supposed to do anything Obama wants.
