Oh my: Obama’s DOJ to defend Defense of Marriage Act in court

DOMA is the federal statute that says state X, which prohibits gay marriage, can’t be forced to recognize a gay marriage performed in state Y. As Tapper reminds us, candidate Obama opposed it in 2007. Two years later, Change has come to America. Question: Why does the president hate gay people?

Justice spokeswoman Tracy Schmaler said that President Obama “has said he wants to see a legislative repeal of the Defense of Marriage Act because it prevents LGBT (lesbian, gay, bisexual, transgender) couples from being granted equal rights and benefits,” she said. “However, until Congress passes legislation repealing the law, the administration will continue to defend the statute when it is challenged in the justice system.”…

The Obama administration cited Catalano v. Catalano (marriage of uncle to niece, “though valid in Italy under its laws, was not valid in Connecticut because it contravened the public policy of th[at] state”); Wilkins v. Zelichowski (marriage of 16-year-old female held invalid in New Jersey, regardless of validity in Indiana where performed, in light of N.J. policy reflected in statute permitting adult female to secure annulment of her underage marriage), and re Mortenson’s Estate, (marriage of first cousins held invalid in Arizona, though lawfully performed in New Mexico, given Arizona policy reflected in statute declaring such marriages “prohibited and void”).

“Holy cow,” wrote [Americablog's John] Aravosis. “Obama invoked incest and people marrying children.”

Consider this another one of those highly nuanced, “pragmatic” reversals that the media — sans Tapper, natch — will helpfully overlook. “But wait,” you say, “isn’t the president duty bound to enforce a federal statute until Congress gets around to repealing it?” Why, er, no. Back in 2000, a little-known law passed in 1968 that purported to override the Warren Court’s “Miranda warnings” was challenged before the Supreme Court. Clinton’s DOJ actually sided with the criminal in arguing that the Miranda case was based on the Fifth Amendment and therefore the statute was unconstitutional; the Supremes had to invite a law professor unconnected to the case to defend the statute at oral arguments. (The DOJ/criminal dynamic duo won.) The charitable view of this is that The One’s thinking strategically, knowing there’d be a backlash against gay marriage if states that prohibit it were suddenly forced to recognize gay unions performed in, say, Iowa. He’s only looking out for the best interests of gays, you see. The uncharitable view is that he’s worried that the backlash would cripple his reelection chances, no matter how much it might please his gay constituents, and therefore he’s better off defending DOMA. You don’t think our Barry would be that cynical, do you?

Just FYI, Americablog lists cases where the DoJ under every president back to Bush Sr. opposed an existing law rather than fight to uphold it. Just to give a little extra flavor to the O hypocrisy.

They may…until “The One” explains to them..in that smooth mellow “Velvet Johnson” voice that..”As I’ve always said…and let me be perfectly clear..its all about giving a fair voice to all sides, and in this case the issue has been fairly debated and there is just not a case to continue the DOM.

I don’t think the American Jewish vote is actually pro Israel..they’re mostly deluded progressives, imo, and reality or the consequences of ones decisions are not as important as the intentions or the “meaning” of it all.

I’m not sure how much downside there is for him on this. The issue will likely be settled in the SCOTUS, and when same-sex marriage is legal everywhere, the DOMA is pointless.

Libertarian friends, stone me if you will, but I support DOMA, in part because I don’t like the idea of a few states being able to define marriage, or anything else, for all the others.

The gay agenda that has been advanced so far has been the pay-off. However if necessary they will be sacrificed (thrown under the bus) in favour of Hispanic migrants who outnumber them by a massive margin. The new non-white majority in America may possibly terminate the gay rights movement completely. It remains to be seen what will happen. Various liberals positions are irreconcilable but there’s never been a massive collision so far as I know.

Obama stiffing the gays is definitely consistent with his “muslim roots”. He’s done that three times now, his opposition to gay “marriage” in the campaign, his support for “don’t ask don’t tell”, and this.

That loud hissing sound is the outrage in San Fran Nan’s home city.

That said, his continual dissing of Israel and his coddling of the Paliwackers and Iran is ALSO consistent with “muslim roots”.

I don’t like Muslim roots… Or Muslim anything to be honest. While I don’t believe gays should be recognized as “married” I do think civil unions should be allowed. I also think that anyone qualified should be able to serve in the military. And I support Israel more than I support my own government as it stands.

Obama will throw everything under the bus, that comes along, except King Saud. The bow to him, says so much more, than average Americans are aware of. Even, Michelle, was not brought to the Kingdom. She’s superfluous, like Mrs King Saud. The homos and the Jews, also fit into this category. Obama’s heart is in Mecca, he’ll never go against the Arabs on the gay issue. I can picture them describing Obama blaming the previous administration for not getting out of Iraq, being against gay marriage, continuing wiretaps and waterboarding only he’ll be referring to himself the entire time. The critical event that defined Obama, that shaped his life more than any other, happened when he was a small child. His absent father died… long before Barack could get to know him.

Some children who feel abandoned lash out at the absent parent, swearing they will be nothing like them… others build them up to mythic proportions, and (unconsciously, perhaps) work to be just like them… awaiting an approving pat on the head that can never come.

The fact that Barack Obama named his book “Dreams of My Father” shows which camp he belongs to.

Once you understand this, Barack’s political philosophy makes sense. Barack’s father was an African socialist, a mid-twentieth century hybrid of Marxism, anti-colonialism, and tribalism. Whenever Obama diverges from the standard Democrat party line, he is doing so to “legitimize” or “redeem” the beliefs of his father.

This explains his general antipathy to gay issues.

This explains why he is so openly rewarding his supporters/punishing his detractors using federal power and money… that is common in his father’s homeland, and must be made legitimate here for that very reason.

This also explains his dislike of all things European.

Also explained is his nomination of Sotomeyer. He is unbothered with the idea of ethnic/racial tribalism being a part of the law, tribal loyalty is considered quite natural throughout large parts of Africa. Tribal membership is oft-times more important than abstracts like “truth” and “the law”.

His father wrote of taxing both outsiders and the rich at rates of 90% to 100%, with the proceeds going to favored tribes… not too far from the experience of Chrysler bondholders.

His use of political thugs like ACORN and the SEIU fit comfortably within the mainstream of politics in his father’s homeland.

Barack Obama built his identity to please a ghost, to resurrect a ghost. to redeem a ghost. He truly thinks the ways of his father, learned from his writings and from family stories, are as legitimate as anything invented here in the West, and he will always try to “normalize” those beliefs.

He is not a communist, a socialist, or a secret muslim. He is an African socialist. And that makes him a little bit of all those things, but not quite any one of them.
