Four Uighurs released to Bermuda – with travel restrictions; Update: Germany declines, Brits furious

posted at 1:35 pm on June 11, 2009 by Ed Morrissey

Yesterday, Salon’s Glenn Greenwald accused me of being fear-gripped for noting that I’d not likely spend a fortune to vacation on an island with released Islamic militants running free.  Oddly, the Obama administration seems to be gripped by the same fear.  Today they announced the release of four Uighurs to the Bermuda, but imposed travel restrictions that blocks them from entering the US:

The Obama administration put out some seemingly mixed messages on the Uighur transfer, saying that their release to Bermuda would make the US safer, while insisting the government would guard against their travel to the US.

An Obama administration source told ABC News that “the Uighurs will not be able to travel to the United States unless the U.S. government consents in advance.”

The official said by using biometric identification “in our consulates and ports of entry, advance passenger screening systems, and watch lists, we are confident that the United States has the measures in place to assure against such travel.”

Wow!  Is Obama another “war-supporting tough guy” who let himself get gripped by fear over a few harmless Uighurs?

The Obama administration has good reason to block their entry to the US, and in fact had good reason to hold the Uighers all along.  Thomas Joscelyn explains:

For example, all four of the Uighurs admitted during their combatant status review tribunals (CSRTs) at Gitmo that they received training in the Taliban’s Afghanistan. And all four of them received this training at an ETIM/TIP terrorist training facility in Tora Bora, a key area once controlled by the Taliban and al Qaeda.

Three of the four Uighurs transferred to Bermuda also admitted that they had firsthand ties to senior terrorists such as Hassan Mahsum and Abdul Haq – the leaders of the ETIM/TIP. Haq was recently designated an al Qaeda terrorist by the Obama administration’s Treasury Department, which noted that he is also a member of al Qaeda’s elite Shura council. Mahsum was killed in a Taliban and al Qaeda stronghold in northern Pakistan in 2003.

In other words, they allied themselves with al-Qaeda and the Taliban willingly, at the very least.  That’s enough to get disqualified for entry into the US on its own, as well as internal release, which is why the Obama administration eventually fought a judge’s order that would have forced the US to release them in a Washington DC court.

Both Thomas and Jake Tapper note the problem in attaching these conditions.  The Europeans have insisted that the US has to allow any Gitmo detainees they take to have the right to travel to the US.  That’s understandable for political reasons; after all, why would a German want to take people the US considers to unsafe to admit in our own nation?  The travel restrictions on the Uighers, considered the least problematic of the Gitmo detainees, make it pretty clear that the Obama administration doesn’t consider them safe at all — nor should they, considering their history of terrorist training in Tora Bora with AQ and the Taliban.

Update: I guess Germany is fear-gripped, too:

A German government spokesman says the U.S. asked Berlin to consider taking two prisoners from Guantanamo Bay but Germany turned down the request.

The spokesman says the request in late May was not backed up by enough information to prove that the men would pose no threat in Germany. He spoke on condition of anonymity because the U.S. had not made the request public.

If we can’t satisfy that standard, maybe we shouldn’t be releasing them at all.  At the risk of being, y’know … fear-gripped, and all.

Update II: Remember how Obama was supposed to right our standing with America’s allies?  Ace notes that he’s flopping badly in the UK:

The British Government responded with ill-disguised fury tonight to the news that four Chinese Uighurs freed from Guantanamo Bay had been flown for resettlement on the Atlantic tourist paradise of Bermuda.

The four arrived on Bermuda in the early hours, celebrating the end of seven years of detention after learning that they were to be accepted as guest workers.

But it appears that the Government of Bermuda failed to consult with the Foreign and Commonwealth Office on the decision to take in the Uighurs – whose return is demanded by Beijing – and it could now be forced to send them back to Cuba or risk a grave diplomatic crisis.

Bermuda, Britain’s oldest remaining dependency, is one of 14 overseas territories that come under the sovereignty of the United Kingdom, which retains direct responsibility for such matters as foreign policy and security.

So Obama never bothered to consult the British on this release?  How incredibly stupid is that?

International Law is based on agreements and reciprocity, nothing else. Thus, once the Obama Administration starts to wing it, there can be an awesome potential for a major breakdown in many accepted agreements and that reciprocity thing may soon backfire on us.

Abrogating Geneva opened up one Pandora’s Box.

Sneaking off Gitmo detainees, such as the Uighurs to Bermuda, has potential as well to have unforeseen consequences far beyond the mere matter of emptying out the confinement facilities at Guantanamo.

Yes, but as France is part of the EU, does this mean that French Guiana and its residents have all the rights that one in the actual “Eurozone” would? Are they in the “Eurozone?”

Just curious.

It’s incredibly stupid, to the point of being incredibly intentional by Obama. It’s a classic moment of a “f/y” move by Obama.

I was wondering what Obama’s hand signal was all about at Normandy, now I think I know (for those who didn’t watch Obama during the Normandy Beach speeches/the event commemorating D-Day, Obama sat thru the speeches of others (Brown, Sarkozy) with his right index finger held straight upright in front of his face, pressed up against his extensively pursed lips, the finger pressing against his pursed lips and up into the front of his nose).

That followed the omission of the Queen at that event, which was a truly reprehensible thing by both Obama AND Sarkozy (O blamed Sarkozy for that, but Obama didn’t appear to have tried to invite the Queen, either), and I think what we have here with the Uighers is a genuinely brutal “f/y” moment by Obama to the British Monarchy.

My sympathies with the Queen, in all sincerity. Obama has obvious serious antagonisms toward Britain. This doesn’t represent the United States, however.

Here’s some local reporting from Bermuda. The Brits aren’t happy with Bermuda’s Premier either:

The four men —aged 25 to 35— are Chinese Muslims called Uighurs and arrived by air last night. They will be given the opportunity to get Bermudian status.

[Premier] Dr. Brown said: “These men are landed in Bermuda in the short term provided with the opportunity to become naturalised citizens and therefore afforded the right to travel and leave Bermuda potentially settling elsewhere.”…

However this morning it emerged the decision had been taken without the permission of Government House.

Governor Sir Richard Gozney said: “Yes it was done without permission and the Government of Bermuda should have consulted with us because it carries with it foreign policy ground areas and security issues.

“We will now need to assess these four individuals. We were only told this morning.

“We are working with the Government of Bermuda to address these issues. There are two parts to it – the assessing of the individuals and the other is assessing the implications.

“I am not going to pass judgement on it. We are talking to the Premier.”

I chalk it up to prejudice. When he was told about Uighurs, Obama thought everyone was saying “wiggers.”

Agricultural issues, subsidies for products, waiving of import fees, that sort of thing, as well as setting wages, while workable in Europe, can often not be workable in the overseas Departments, hence each can opt out on some key issues without screwing the pouch in the process.

The matter of overseas departments, colonies and overseas administrative areas is still a big issue in the Euro Parliament and among the Euro regulation overseers in Strasbourg.

Worked from home yesterday and listened to Kirsten Powers say she had no problem with these guys living in her neighborhood because they were found innocent. The other “expert” called them terrorists and said they weren’t innocent – they just didn’t have enough evidence on them. KP exploded that they were not terrorists and plenty of innocent people have been swept up in the paranoia (paraphrasing here). So what exactly were they doing in a terrorist training camp? Laundry? She said they only had a beef with China. Right… and my Aunt Tooney is the warm up act for Beyonce!

For six or seven years the old Europe countries were claiming under Bush that everyone in GITMO were innocents and must be immediately released, now that Obama’s in office and wants to immediately release these innocents Old Europe wants one hundred percent guarantees of their harmlessness or no go. Yet who can guarantee anyone else’s ‘harmlessness’ at any time? It’s an impossible standard, especially from these ‘most enlightened’ most ‘human rights conscious’ countries like France and Germany.

Bermuda is one of the most expensive places to live on the planet. I suspect a rich someone bribed the Bermuda government to have the 4 terrorists freed there. It will be a piece of cake to smuggle them into the US on a private plane, and boom! (so to speak).

Or maybe releasing them was part of a secret deal made with Iran or Saudi Arabia or China, and they really won’t be a problem. Maybe they won’t even exist before long.

I suspect a rich someone bribed the Bermuda government to have the 4 terrorists freed there.
–More likely our vaunted Premier Ewart Brown enjoys seeing his name in the paper and getting “accolades” from another (half-)black leader. There are almost 65,000 people on the island. Most residents are not happy about this “deal” at all.

What probably hurts the most is that the current government’s tendency of denying Bermudian status to all kinds of deserving people who have literally built the country is reversed in this unprecedented situation. The Premier’s handed over, “Scot” free, Bermudian status to a pack of – at best – infamous militants without so much as consulting London.

The Royal Gazette has a brief on the topic…

I thought a Weegur was something that fell out of your nose by mistake.

Could this be the real reason BO keeps sticking it to the Brits:

So Obama never bothered to consult the British on this release? How incredibly stupid is that?

This is what Obama means by “smart diplomacy.” If this is smart, I shudder to think what Obama thinks is stupid diplomacy.

BottomLine5 on June 11, 2009 at 10:11 PM

Hmmm, maybe Bermuda will be the 51st state…
I am sure Obama is telling his brothers how colonial Britian is….
Then Palau will be the 52nd state – only 5 more to go….

izoneguy on June 11, 2009 at 10:26 PM

TOTUS didn’t read the Presidents for Dummies manual, did he?

Wow.

Close. Open.
Their out. Their In.
Burmuda wants them. UK wasn’t asked.
Germany says YES. Germany says No.
No Miranda Rights…

Mr. TelePrompter,

Please read the chapter on Foreign Relations; there will be a test!

Update II: Remember how Obama was supposed to right our standing with America’s allies? Ace notes that he’s flopping badly in the UK:

Obama doesn’t have an issue with pissing off the Brits, he’s only interested in righting our standing with allies that have gleefully pissed on us and especially those allies that pissed on us when we asked for help to enforce 17 UN resolutions on Iraq.

Obama beach

Obama b!tch!

Bye bye Gordon!

Frankly I was really excited that a Scot finally got to 10 Downing, but honestly Gordon, Blair was a sheepdog, YOU are the POODLE.

Texas Gal on June 11, 2009 at 11:11 PM

Why the hell can’t they all just stay in Gitmo? It’s working fine, ok maybe nicer than these pukes deserve but does he need to whip up chaos every hour?

fenja on June 11, 2009 at 11:29 PM

What’s wrong with Hawaii? It’s a blue state. They voted for this.

Ronnie on June 11, 2009 at 11:34 PM

After the years of Europe’s sanctimonious b*tching and moaning about Gitmo, I think all the detainees should be put in 3 commercial airliners and let loose in Paris, Berlin and London.

Hawaii didn’t get the promised stimulus funds to connect Oahu’s newly-built Interstate H-3 to California’s Interstate 1? :-)

Hawaii is part of the US, thus US soil, which is the major hurdle no one in the White House is willing to talk about. Once the detainees get to US soil, they are landed immigrants under our immigration laws, thus are afforded all the judicial rights of US citizens and US persons.

coldwarrior on June 11, 2009 at 11:41 PM

Why are we so squeamish about sending them back to China? Training in Al Qaeda camps alone should be offense enough to declare them terrorists and menaces to society. Send them back to the ChiComs and let’s move on.

The Principal Chair on June 11, 2009 at 11:44 PM

LOL… I’d laugh my A$$ off if the Queen had em arrested, and sent em back to the States…
Romeo13 on June 11, 2009 at 3:33 PM

Ha! That would be such sweet revenge, especially after being dissed on D Day in Normandy. They should be deposited on Obama’s doorstep in Chicago so Bill and Bernadine can take them under their wings (the Uighers anti-communist rhetoric notwithstanding).

Buy Danish on June 11, 2009 at 3:41 PM

I am sure the British army has landed in Bermuda for the express purpose of building a GITMO east. They will now send all British detainees down to Burmuda with a platoon of troops. Burmuda is going OOPPPSSS….
They need to do this before the Chinese army kidnaps them.

That is where Obama is from….you don’t shit in your own mess kit.

izoneguy on June 12, 2009 at 12:02 AM

what’s the big fuss about enraging our best ally? all we need to do is send our esteemed SoS clinton with the reset button (were the professional diplomats at state even consulted about this?). me supposes that because we share the same language, we can’t mis-translate anything. but there are always typos.
“reset” in state department english for friends?
“piss-off.”

photoboy74 on June 12, 2009 at 4:02 AM

Amusing to see how Obama’s organizing his own “coalition of the willing” (Bermuda and Palau as charter members) and failing to consult with our traditional allies.

In this case though I’d have to think that it might not have been deliberate. It’s more likely that no one in Obama’s administration actually knew that Great Britain had any say over what went on in Bermuda. So far these folks don’t seem particularly knowledgeable about the world.

Bennett on June 12, 2009 at 9:44 AM

What happened to this “World” that turned against us during the Bush years? The “World” that so criticized us for our moral failings, the “world” we constantly read about in the Letters to the Times & that mattered so much. Odd, but now that same “World” doesn’t come forward to act on their sentiments as expressed in our media. One would think the “World” would be jumping at the chance to take our abused prisoners.
Is it possible that this was all bull—-, foreign and home grown?
