Good news: U.S. reportedly reading terrorists their Miranda rights now

posted at 6:22 pm on June 10, 2009 by Allahpundit
Share on Facebook | printer-friendly

Say, weren’t we warned during the campaign that this might happen if Obama won? Take it away, Sarahcuda:

Terrorist states are seeking nuclear weapons without delay … he wants to meet them without preconditions.

Al-Qaida terrorists still plot to inflict catastrophic harm on America … he’s worried that someone won’t read them their rights?

As I recall, she ate no small amount of crap for accusing him of that given his silence on the matter before the election. But then, this is the same woman who said enormous tax hikes were inevitable under The One in order to pay for his catastrophic expansion of government, notwithstanding his campaign promises not to raise taxes on the middle class. How’s that prediction working out so far? Crazy Sarah and her nutty theories.

Anyway, yeah. Miranda warnings:

If Tenet is right, it’s a good thing KSM was captured before Barack Obama became president. For, the Obama Justice Department has quietly ordered FBI agents to read Miranda rights to high value detainees captured and held at U.S. detention facilities in Afghanistan, according a senior Republican on the House Intelligence Committee. “The administration has decided to change the focus to law enforcement. Here’s the problem. You have foreign fighters who are targeting US troops today – foreign fighters who go to another country to kill Americans. We capture them…and they’re reading them their rights – Mirandizing these foreign fighters,” says Representative Mike Rogers, who recently met with military, intelligence and law enforcement officials on a fact-finding trip to Afghanistan.

Rogers, a former FBI special agent and U.S. Army officer, says the Obama administration has not briefed Congress on the new policy. “I was a little surprised to find it taking place when I showed up because we hadn’t been briefed on it, I didn’t know about it. We’re still trying to get to the bottom of it, but it is clearly a part of this new global justice initiative.”

It was thoughtful of the most transparent administration evah to force Rogers to find out about this on the battlefield. There’s a certain perverse logic to it, though: If you’re unwilling to use any form of enhanced interrogation to save lives, you might as well go the whole nine yards and affirmatively warn detainees that they don’t have to talk to you. That’s what a law-enforcement approach to terrorism means — accepting a heightened risk of an attack by eschewing certain preventative measures in order to heighten the risk of conviction in court later by following criminal procedure. How this squares with The One’s willingness to send drones into Pakistan and torpedo houses packed with people on the say-so of informants is beyond me, but I’m sure we’ll get a speech on it at some point down the line. Exit question: Why institute a Miranda policy for terrorists captured abroad before the Supreme Court’s even heard the issue? They might find a wrinkle distinguishing classic criminal cases from prisoners of war — especially if Sotomayor’s half as tough on crime as the White House spin team keeps assuring us she is.

We tried treating terrorism as a law enforcement issue once already. The result was several large holes in NY City, Washington and Shanksville, and about 3,000 innocent American lives lost.

Terrye on June 10, 2009 at 6:28 PM

They can read the terrorists anything they want. Terrorists off of US soil have no Miranda rights.

Besides that, the Miranda rights paragraphs are about the most famous bits of English, as they appear in so many movies and TV shows that even people who don’t speak English can recite them by rote memory.

I consider the act of forcing US personnel to Mirandize foreigners on foreign soil to be an impeachable offense.

This fits the pattern with Obama. Mock, ridicule, deny, then quietly, after some time has passed, do the very thing that you’ve said you wouldn’t do.

Or as a shortcut, just flat out lie.

As much as we heard “Bush lied” I’ve seen far more lying coming out of Obama in his first few months than Bush’s full eight years.

MightyConservative on June 10, 2009 at 6:30 PM

Maybe it’s just me….. Dunno….. I’m just a ’somewhat normal’ American.

I thought you had to be an American Citizen to be afforded those rights.

Hey….. What’s that noise ?

Clack, clack, clack……….clack……………..clack……………………………… clack……………………………………………..

Sounds like a roller coaster going up the biggest hill I’ve ever seen…… and getting closer to the top.

As it’s getting closer to the top, it’s getting slower before that extremely fast downhill fall.

Just a wildly random thought totally disconnected from anything else……. How long before all of us in dissent of tyranny and Fascism are arrested and NOT read our rights ?

Once we Mirandize someone on foreign soil, then they have good case to make that our powers of law enforcement don’t extend outside of sovereign US territory. Case closed on that.

What cereal box did The Precedent get his law degree from? Holder must have been sharing breakfast with that day.

I hear that the terrorists suspects at Guantanamo are also complaining that tea is not being served at the correct temperature, and that skim milk would be preferred so that they can stay in better shape. I’m sure Obama will apologize for this in his next world-wide tour policy trip.

Cicero43 on June 10, 2009 at 6:37 PM

Whats wrong with that?

First of all, they’re enemy combatants and not criminals. Second, the first thing you’re doing is telling them they have the right to not tell you anything.

We do not care if they are terrorists.

YOU don’t care if they’re terrorists. Most of America thinks torture can be justified for the simple reason that they are terrorists. Even the Obama Administration is talking about continuing military tribunals because evidence obtained wouldn’t be permissible in courts and they want a conviction.

America is a nation of LAWS. We are not lawless like those people. History is not on the side of people who follow the rule of law when convenient

History isn’t on the side of people who follow laws to the extent that they put their very existence at stake to protect the lawless.

What color are the skies in your world? We’ve followed laws and morals when they’re convenient all through our history. The internment of the Japanese, the Constitutional violations that were the Alien and Sedition Acts, etc. Our very Founding Fathers ignored laws when convenient.

In fairness to Clinton, we’re talking about an entirely different period of terrorism and an entirely different mindset. There were terror attacks, yes, but nothing on the scale of 9/11 and the global attacks that followed. There were many conservatives, including myself, who viewed them more as criminals than enemy combatants back in the 90s.

The country I grew up in, where personal responsibility, social decorum, patriotic feelings and good morals used to be abundant, are sadly disappearing. The ignorance and stupidity of our current culture surely mocks our founding principles. When Benjamin Franklin was asked what the framers came up with, he replied “a Republic, if you can keep it”. My understanding was that these rights are read to ensure that a person understands what protections they have under the fifth amendment.

Does this mean that the U.S. Constitution applies to our foreign enemies? If not, why are we telling them about what rights they would have if it did?

This really makes no sense to me. Please somebody let me know if I am being naive.

“Good news: U.S. reportedly reading terrorists miscreants militants their Miranda rights now”

We tried treating terrorism as a law enforcement issue once already. The result was several large holes in NY City, Washington and Shanksville, and about 3,000 innocent American lives lost.

Don’t forget the aircraft flying out of New York that was shot down with an enhanced Chinese shoulder fired missile, and afterwards only those who story supported the discredited goverment story were allowed to be interviewed or have their statements taken, leaving out hundreds who saw the missile going up.

Apparently the screwed up ones little brain doesn’t understand the difference between robbing a 7-Eleven and Muslim terrorists blowing up thousands of people. For the uninformed it’s called WAR.

Well.. the one good thing is the law of unintended consequences, and I’m pretty sure there will be more islamic hair and brains spread on the sands and more soldiers high fiveing for not having to bother with the camel crap also know as jihadis.

For the life of me,,, I just cannot believe that many Americans at all can be behind this guy.
If he isn’t sucking up to terrorists he’s bankrupting our nation. If he isn’t dissing our allies he seizing American business. Every freaking day it’s another crisis, another Fascist edict, another stupid, moronic proposal or another freaking Czar!! All while he is wining and dining on expensive steaks and jetting to Paris so Michelle can shop!
What in the world does he do other than give speeches???
Is America really this stupid???

As I understand it, the military isn’t administering the warnings. Instead, in a power grab, Obama has FBI (an arm of the DOJ–Holder) yanking detainees from the CIA.

God love the FBI, but Obama’s trying to get this detainee issue all ounder Holder’s roof so they can treat this as a police action.

Talk about weak.
