Moron VP to cops: Don’t worry, Sotomayor “has your back”

No, in case you’re wondering, it’s not standard protocol to hint to interested parties that a judge is on their side. But in fairness to Biden, he is a moron.
“I think what Biden said was foolish,” said Stephen Gillers, a law professor at New York University who is a prominent legal ethicist. “She’s not there to ‘have their back.’ She’s there to interpret the law as she sees fit. . .
“It’ll be embarrassing to her when she learns of it,” Gillers said. “Biden crosses the line when he starts representing to interest groups that she would be voting in their favor.”…
The president of the National Association of Criminal Defense Lawyers, John Wesley Hall, complained that Biden’s comment made it sound like she would overlook police misconduct.
“To say that a judge ‘has your back’ is an activist judge,” Hall said. “They’re raising doubts for everybody who’s concerned about the Bill of Rights. . . .‘She’s got your back’ is just the worst possible thing he could have said.”
But another legal ethics specialist, Stephen Lubet of Northwestern, said he was not troubled by Biden’s remarks. “If Judge Sotomayor had said that, perhaps [it would be problematic], but the fact that her supporters think she’s more disposed toward law enforcement does not suggest bias. Everybody’s in favor of law enforcement, no one’s opposed to law enforcement,” Lubet said. “This lacks the sort of specificity that would suggest bias.”
Most conservatives aren’t going to pitch a fit at the thought of a Supreme Court appointee giving cops the benefit of the doubt, especially when they’re terrified of The One building Warren Court II. But the principle remains: Imagine if Greasy Joe had told a group of public defenders that Sotomayor “has your back.” Sweet bloggy content for the next week, baby!
Oh, speaking of our wise Latina justice, a wise Latino senator evidently agrees that “the richness of her experience” gives her a leg up jurisprudentially on those who are less “rich.” And no, he’s not a Democrat.

I’d have much preferred Larry Tribe, myself. If you are going to have a leftwinger on the Court, why not one of the best Constitutional lawyers in the nation?
Sotomayor will bring her rich Latina experience to the Court. Well, whoop de doo.
I’d like someone who has not only read the Constitution regularly, but has also had real experience in deciding Constitutional issues based on that same Constitution, rather than going with feelings and penumbras, or whether it is Día del Descubrimiento de Puerto Rico or Día de la Abolición de la Esclavitud or if the Arroz con habichuelas was served cold or not.

I can sure see why the regulars groan every time open registration occurs. I enrolled about a year ago and am very impressed w/most of the posters—and a few not so much. I would be honored to meet some of the more thoughtful posters.
The upside of open reg. is new entertainment–well not really new as it will be the same talking points phrased a little differently.

Not as I remember it…from the get-go from the primaries right up to Election night, it was bash Bush, and from the Florida Supreme Court case and the decision to hold Florida to the rule of law, it became more pronounced and vitriolic…Bush was a target of the left, by design, not by accident, with AlGore leading the charge.
Frankly, this “hating” on Obama is not hating on Obama. Most of us are going after his policies…not the man.
He might be a wonderful person, but as the top executive in the nation, he has a lot of learning to do and soon.
Alternatively, there are also many who are more than willing to offer the Obama Administration the same deference that was routinely offered to Bush.

Funny comments on the TOTUS site. The other night on our local Chicago news they had a teaser on a story about how there was trouble in paradise with the Obama marriage. I thought they would bring up Vera Baker. Of course they didn’t but they related an interview Michelle Obama gave years ago on how their marriage was on the rocks when he ran for state senator and how Michelle was very unhappy with his career choice for one year which strained their marriage and there wasn’t any “bedroom romance” for a long time. Dear God, that’s too much information.

Um, no we wouldn’t. First of all, if he cut taxes, we’d be flabbergasted. Secondly we’d be happy as could be that we’d have to eat crow for all of the negative things we’d have said about him. He would save the economy and we’d look like fools. We wouldn’t like it, but we’re Americans first. The pro-life thing would be nice, but you know that would never happen so why even mention it? George Washington has a better chance of rising from the dead than Obama turning pro-life.
How did you get here from Bizarro world? I mean, if you have some kind of dimensional-hopping machine, let us use it to get to where you came from. Since you aren’t from this dimension, let me inform you that after the fiasco in Florida in 2000 (I was living in Tallahassee at the time, btw), the left could not stop screaming about how Bush was illegitimate and how the election was stolen…ad nauseum. The sign on the bridge of the Lincoln was a traditional navy banner often used when a ship returns from deployment or combat.
That got purposely translated to the dhims of somehow being a general statement as to the toal war effort. Not so.

Long story short, michelle mcphee is very close to the Boston and NY police departments. She was a crime reporter in both cities and she’s a “true crime” author. She asked the cops why they were backing Obama even though he was close to the leader of a cop-killing group and they told her it was because of Biden. He was chosen to swing them over to his side, or so she says.

I’m so sick of these idiots making the court a political issues. Idiot Joe basically say- ‘look, she understands you guys. She’s got your back, so you need to make sure you have her back and support her.’ Who cares which law enforcement organizations back her? Does that matter one iota? No. And it shouldn’t matter.
What should matter is her record and her public statements on the law and her legal philosophy. If she upholds the Constitution, as it was written at the time, then she’s okay. If not, if she thinks the document is a living breathing document that changes, or if she looks to international courts to decide these issues, she’s a bad choice and isn’t fit. Simple as that.
This is why people hate politicians. They turn EVERYTHING into a political matter, and they forget our lives are our only lives- they’re not political.

Am I reading between the lines, or did Biden say that Sotomayer was willing to go above the sentencing law? (see 2:10). Does that imply that she exhibits common sense, or disregard for the law?
The only argument he made with any substance was that she will bring a great deal of experience to the court.
What’s helpful about “experience”? It wasn’t a qualification for our president. And years of experience hasn’t seemed to make our V.P. any wiser, either.

Between Grahamnesty, McLame, Martinez, Spector, Snowe, Collins, and Crist my ability to laugh about these things has disappeared entirely. The good thing about this is that I’ve stopped donating to the problem (RNC) and started donating only to worthy individual candidates.

Let’s say that instead of Bush nominating Justice Roberts he nominated a white guy who said that the richness of his experiences makes him a better judge than Black or Hispanic judges who haven’t had those experiences. And then let’s say that Cheney gave a speech to a law enforcement interest group in which he said that this judge “has their backs”. Would they even have a hearing?

Well said. I do not want a judge to “have my back”. I want a judge who will enforce the law as the law says.
While they are in the minority, there are cops out there who screw up or sometimes do bad things, we need judges who are willing to look at everything and make their decision. Biden is such an idiot.
The local police organizations in my neck of the woods backed McCain more for the gun control issue than anything else, if you can believe that.
Democrats know as much about law enforcement as they do “fiscal responsibility”.

I believe Thomas Sowell made the point that if a judge makes decisions based on “empathy” as opposed to that silly piece of paper (the Constitution, I think it’s called), that just makes it more difficult for the rest of us to figure out how they will rule. That applies to us officers also. What we do legally today may be considered “fruits of the poisonous tree” next month….
