Czar Watch: The Pay Czar

That line from Fiddler on the Roof applies more and more to the Obama administration. The White House has announced yet another czar to exert power without Congressional oversight, and this one should get everyone’s attention. Kenneth Feinberg will enforce administration policy on executive compensation for TARP recipients:
The Obama administration plans to appoint a “Special Master for Compensation” to ensure that companies receiving federal bailout funds are abiding by executive-pay guidelines, according to people familiar with the matter.
The administration is expected to name Kenneth Feinberg, who oversaw the federal government’s compensation fund for victims of the Sept. 11, 2001, terrorist attacks, to act as a pay czar for the Treasury Department, these people said.
Mr. Feinberg’s appointment could be announced as early as next week, when the administration is expected to release executive-compensation guidelines for firms receiving aid from the $700 billion Troubled Asset Relief Program. Those companies, which include banks, insurers and auto makers, are subject to a host of compensation restrictions imposed by the Bush and Obama administrations and by Congress.
Wall Street has been anxiously awaiting more details on how the rules will be applied. “The law is confusing and a bit ambiguous, and so we’re looking for certainty as to how to structure pay incentives,” said Scott Talbott, senior vice president of government affairs for the Financial Services Roundtable, a trade association.
And how will Feinberg’s power be defined? As broadly as possible:
Mr. Feinberg will report to Treasury Secretary Timothy Geithner, but he is expected to have wide discretion on how the rules should be interpreted. Firms likely won’t be able to appeal decisions that Mr. Feinberg makes to Mr. Geithner, according to people familiar with the matter.
No right to appeal? Pick any other area of law enforcement where defendants have no right to appeal, let alone get a fair hearing of their grievances. The IRS allows appeals, for instance. Hell, even the detainees at Guantanamo Bay have the right to appeal decisions by military tribunals to the federal appellate court. The appointment of czars means an unconstitutional application of power almost by definition, as the positions deliberately bypass Congressional oversight, and now apparently the judiciary as well.
This demonstrates why I’ve been warning about the czar culture at the White House. It puts power into the hands of one man, Barack Obama, and eliminates any accountability for his actions. In order for Congress to stop the actions of any czar, they would have to impeach Obama first, a highly unlikely scenario while Democrats control Congress, and hope that Joe Biden would get the message. Otherwise, the branch that represents the people have no control over the law-enforcement actions of their government, and the courts would have no clear entry point to check executive power.
We’re now getting a czar a day. How many days until Congress figures out that they’ve been stripped of their power?

I see the beleaguered Gordon Brown has now followed the Obama path and introduced to British government the concept of “czars” – or, as he spells it (presumably to avoid confusion at the first G7 czar summit) “tsars”. Mr Brown has made Alan Sugar Britain’s “Enterprise Tsar” – or, as Jonah would say, the head of the Tsar Ship Enterprise.

Great points. And utterly frightening.
How much of this is even still merely trial balloons. He is obviously NOT going to stop. This is only FOUR FREAKING MONTHS, guys. FOUR. Like he is going to give up this power. FOUR MONTHS. I can’t say that enough. This is unprecedented. Even if there were a lawsuit, like the DoJ would even comply and the media would cover it up. What is going to happen?

Some brave company or person should refuse to follow a czar’s order. Then see what the enforcement mechanism is. It would likely end up in court, at which time the person or entity could challenge the czar’s authority. This would be the entry point.

This really isn’t funny. The good old US of A is being taken over by an Affirmative Action, Harvard educated, Black Muslim with a chip on his shoulder the size of Texas, and a grudge against all things American the size of the continent.
And while this goes on the Public watches American Idle the Congress and Senate Scum find new creative ways to spend our paychecks and the Republican Party wimpers and grovels in the corner begging for some crumbs.

Exactly right. I continue to see conservatives giggling about how he’s going to do so bad that he’ll get voted out in 2012. They don’t seem to grasp the reality that elections will be meaningless after ACORN gets through rigging the system.

Business Insider is reporting the Second Circuit denied the bondholder’s petition to stop the sale of Chrysler to Fiat. I had hoped this would be otherwise, and an indication that Obama’s powergrabs could be stopped. I doubt SCOTUS will stop it.
I still think the bondholders can challenge the final overall bankruptcy plan.

Bishop is right on point with this. When something goes right, Obama can stand up there and say, “My team worked long hours to pull this off!” giving himself legitimacy.
When something goes wrong (and there will be a lot more of those) He can say, “Well, they tried, but their best efforts were not enough, so I have accepted their resignations.”
This is the same old pattern of Leftism. The Soviet Commissars of Agriculture who failed year after year to extract more food from the Ukrainians and so were taken out and shot, only to be replaced with a new Commissars. No one ever thinks to free the people, or enforce property rights.
As each of these commissars fail, the free market alternative will be ignored. GM will fail, but the CAFE standards will be maintained, no matter who dies because of it.
Because we are serving the greater good, don’cha know. Always the greater good.

The executive branch has been usurping legislative branch authority for years and the judicial branch has been legislating from the bench for years. Ogabe has just taken it to the next level. Why do we need a congress anymore? Because the constitution says so? Hell, that old piece of parchment is nothing but words, just words. Ogabe has shown that there is no downside to ignoring the very foundation of our republic. Most of us didn’t know it at the time but his election was a national suicide pact.

I heard this morning on Rush Limbaugh that Steny Hoyer is starting to make noise about this additional new czar that Obama is creating. That, along with Senator Byrd’s protests a couple of months ago may cause this to come to a head soon. Hopefully, the rest of the movers and shakers in Congress will realize that Obama is stepping on their toes, and they will do something about it. Apparently, there have already been over 200 appointments made by POTUS that are just his staff, (czars, assistants etc.), so many that he is going to have to find them an office building outside the White House. Talk about a power grab!
