Leahy: No worries, Sotomayor told me she’d follow the law

Small comfort that she’s unwilling to admit outright she’ll be applying The One’s “empathy” standard in close cases. Even those who profess a belief in forms of racial superiority have a limit to what they’ll say publicly, I guess. As for whether The One was correct in insisting that she misspoke when she made her “wise Latina” comment or whether, as anyone who’s thought about it for five seconds would realize, she meant exactly what she said given the nature of the occasion and the fact that she later approved it for publication, Leahy says nothing. At least there’ll be some fun at the confirmation hearing.
Speaking of which, 145 conservative leaders request, nay, demand a filibuster even though the GOP almost certainly won’t have the numbers to pull it off. Productive:
[I]n an interview with POLITICO, Manuel Miranda – who orchestrated the letter – went much farther, saying that Mitch McConnell should “consider resigning” as Senate minority leader if he can’t take a harder line on President Barack Obama’s first Supreme Court nominee.
Miranda accused McConnell of being “limp-wristed” and “a little bit tone deaf” when it comes to judicial nominees…
In arguing for a filibuster — which Senate Republicans have already said is unlikely — Miranda and other conservatives appear to be reversing course: When Democrats were in the minority, they demanded that judicial nominees of George W. Bush get up-or-down votes on the Senate floor.
But in their letter, the conservatives say their plan is different. While Democrats threatened to use a filibuster to block nominees, conservatives say they’re advocating a “traditional” filibuster to ensure that the debate over Sotomayor is “appropriately long and, therefore, suitably catalyzed to the American people.”
The “limp-wrist” remark suggests this is less about accomplishing something useful in the Senate than staking a claim to being the true “true conservatives,” the sine qua non of which is confronting liberals even when it’ll achieve nothing and quite possibly backfire. Does the Senate GOP have the balls to get up in the Democrats’ faces and obstruct a nominee who’s sure to be confirmed anyway, even at the risk of alienating Hispanics and annoying independents? Man up, cowboys!
Judging from Sessions’s genial comments after chatting with her today, I’m sticking with my prediction of 75 votes or so.

Yes, by all means, simply because you might not have the numbers to filibuster, roll over and let them kick the hell out of you. Say nothing. Do nothing. Because they have the numbers, what we have to say means nothing.
It worked so well, in 1930s Germany. Just shut up. Do nothing. Let them have their way. Don’t be an opponent. It’d only be meaningless.

It’s hype, a filibuster won’t happen. However, the GOP isn’t going to attract more votes by saying “you’ve got enough votes, so we’re just gonna shut up now. Carry on!”
Don’t go overboard (“La Raza = KKK!”) but seriously question her positions, put her on the hotseat a few times and see what she says. I don’t think she can come through the fire as cleanly as Roberts & Alito did.
It’s about field position. Try to show the public who/what Obama wants on the bench.

Give me a break. People in those two groups who are annoyed by and alienated from the GOP are going to be annoyed and alienated no matter what they do about Sotomayor. Funny, they didn’t seem to get all that annoyed and alienated over Estrada.
It might be better for the GOP to take something that seems like a defining stand, ya know?

If you have to ask the question, the answer is No. Which is why the GOP wont take back more than a small handful of seats next year: No Balls, just a lot of ball handlers.
And there is a critical and so-far underappreciated difference between “obstructing” Soto and giving her a tough fair and probing series of questions that unmistakably say “We of the GOP Senate cant stop you because Teleprompter Jesus holds all the cards for now. But we think you were an atrocious choice and we dont want you on the court for reasons 1 through 100,000 spelled out by us in your confirmation hearings.”

Senator Depends, me thinks me not believe you! Especially when you consider she had the chance in the past 17 years to follow the law, and has not necessarily followed the law during that time. The entire EPA case and the recent Richi case demonstrates this, not to mention her 2nd Amendment issues.
Of course, I am also NOT a wise Latina, and so not capable of forming any opinion whatsoever. Although, I am a woman. Do I get half of my opinion qualified?

I just want to see a list of all the wise Latina women and the great decisions they’ve made, which Sotomayor used as evidence to back up her idiotic claim. Then I want her to show how much better they all were than the average white male who created and built this nation.
She makes a claim in a published paper, then, as a judge, she ought to have the reasoning at hand supporting her claim. Otherwise, she is totally unqualified.
To the chase, anyone who publishes in the La Raza Law Journal should be thrown off the bench, immediately. There is no excuse for that, at all. None.

The Senate GOP couldn’t be trusted to take a hard line Conservative tack even when they were in the majority. Even during the Bush years the more staunchly conservative chamber was on the other side of the building. If you’re counting on a bunch of senators to take an “outside the beltway” principled approach, get ready for a heart ache.

No one believes Leahy or Sotomayor, not even their supporters. They just like what they hear.
From what I understand, Miranda and McConnell both want a filibuster, just different approaches, styles and effects.
But I’ve got to read Miranda’s letter, and research just what this Demo-memo-no-no happened under Frist. Given the DeLay shaft, or something different?

When are these people going to take a stand for “America” and stop this “what is politically correct” nonsense. The problem is that none of them actually stand for anything. It is always about keeping their jobs. None of them weigh the issues on the merits. Still don’t know why none of these reps can challenge these policies and programs on constitutional grounds. That is if any of them know what the document says.

Often people remember others by one or two events. For me, I recall when Leahy was grilling Robert Bork at the Senate Judiciary Committee confirmation hearings. Sen. Leahy demanded to know why Judge Bork hadn’t done much pro bono work (without compensation for the public good). The Judge calmly responded he had been preoccupied caring for his wife who was ill with cancer.
I anticipate Leahy will again treat us with another golden moment of thoughtful inquiry.
