Smear: L.A. Times Lies About Cornyn’s Comments on Sotomayor (Update: Quote Sent Down the Memory Hole)

posted at 6:20 pm on May 31, 2009 by Patterico

Today the Los Angeles Times lies to its readers about Sen. John Cornyn’s statements on “This Week with George Stephanopoulos.” Here’s what the L.A. Times says:

Only days earlier, Cornyn said in a radio interview that it was “terrible” for conservatives to be attacking Sotomayor as a “racist.” But today, the senator did not reiterate those sentiments and pledged that he and other Republican lawmakers would probe deeply into Sotomayor’s past comments and rulings to see if her heritage colors her ability to make fair decisions.

The hell he did. Yes, he said Republicans would closely examine her record. But he never said that Republicans would seek to learn whether her “heritage” would affect her ability to be a fair judge. In essence, the paper is saying, Republicans are concerned that Sotomayor might be a poor judge because she is a Latina. That is an outrageous distortion of Cornyn’s comments.

Rather than focusing on Sotomayor’s ethnicity, Cornyn focused on Sotomayor’s statements and rulings. Cornyn said Republicans were concerned by Sotomayor’s ruling in the New Haven firefighters case, and her comments about how she would be a better judge because of her Latina heritage. The focus was on her actions and words, not on her “heritage.”

The transcript of Cornyn’s appearance is here. On a separate page, I have included every single comment that Cornyn made in this morning’s appearance, so you can see with your own eyes how this newspaper is lying about Cornyn’s comments.

Indeed, Sotomayor herself is the one who has claimed that her ethnicity and heritage might be relevant to her judging:

“I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn’t lived that life,” said Judge Sotomayor . . . . “Whether born from experience or inherent physiological or cultural differences,” she said, for jurists who are women and nonwhite, “our gender and national origins may and will make a difference in our judging.”

Today, Cornyn actually said the exact opposite, telling George Stephanopoulos that it “shouldn’t make any difference what your ethnicity is.”

For the L.A. Times to claim that Cornyn pledged to examine whether “her heritage” would make her a bad judge is an outright fabrication by the newspaper, and they should be deeply ashamed.

The L.A. Times owes Cornyn an apology. Do you think he’ll get one?

Yes, that was a rhetorical question.

UPDATE: Looks like the paper got embarrassed by this quote and decided to send it down the memory hole. Now, when you click on the link above, the passage I quoted is missing. Luckily, I saved a copy and a screenshot. Details here.

I lived in L.A. ( Santa Monica ) for a while. In the Good Old Days, Santa Monica was a nice little town full of retired Republicans, with a nice Repub lady like Clo Hoover as mayor

Then and now, the L.A. Times was and is a dishonest worthless rag fit only for what many people do in Third World countries do: cut newspaper up into squares to use as toilet paper

or wrap fish, put under paint cans, etc

Some things never change………

Janos Hunyadi on May 31, 2009 at 8:57 PM

The person benefiting the most from this new headline news is Nancy Pelosi.

This is by design. Note some on the left are being allowed to say negative things about Sotomayor. (Clue)

KyserS on May 31, 2009 at 9:01 PM

Yeah, the ones who disapprove of her or who are unsure of her confirmation outnumber her fans at this point.

Says who?

She’s going to get appointed. The majority who you say have had an epiphany, will see to that.

I’m never surprised at this crap anymore….

and btw, o/t, Greenbama has apparently already saved the planet from “global warming”… As we cross over from May to June tonight, our overnight high will be 37F here in VT. Right now it’s 44 with 36 windchill. Bravo Barry! Must be all of those trips flying your wife on date night to Chicago and NYC, or taking media trips in SUVs to get a burger when you can get anything you want at the WH. Crisis averted!!!

RightWinged on May 31, 2009 at 9:02 PM

If I can figure it out and write about it, and you can figure it out and write about it, why can’t people in the news media also figure it out and write about it? They can’t all be ideologues or sheep or egomaniacs seeking popularity and money.

I hope.

Loxodonta on May 31, 2009 at 8:50 PM

Oh trust me, they most assuredly have figured it out. Dan Rather was thrown to the wolves to create the false impression the some members of the MFMSM (Mother E’ffing Mainstream Media) are still journalist rather than the socialist propaganda officers that they really are.

It isn’t just the LASlimes or the NYSlimes that are lying to the American people, it’s the entire MFMSM (Mother E’ffing Mainstream Media)…

tomas on May 31, 2009 at 9:06 PM

“While their “journalism” descends further into the pits.

Loxodonta on May 31, 2009 at 8:18 PM”

It’s not “journalism”, it hasn’t been since Walter Cronkite declared the Vietnam War “Lost”, it’s propaganda……. sound familiar?

By the time we got to Bill Clinton and he got away with

“It depends on the definition of “is”…… is.”,

you could see the MSM’s agenda.

Then there was Al Gore in 2000……..

“Bush stole the election….”,

what did Hitler say about repeating a lie often enough?

You throw in the political ideology of the Left as you pointed out earlier, in everything from academics, Hollywood, and the MSM to walk “goose step” with the Democrats, we then have our “Free and Independent” press of today.

You are right, they are playing for keeps and want to turn us into dust……..

……. I am afraid it is not going to end until Obama gets his second term and introduces

“Slavery Reparation Laws”

He is paying for it now, he just will want to put into law that turns every white male into an

“untouchable”,

“unemployable”,

and

“not worthy of owning property”

that we start to fight back.

But by then, of course, it will be too late……

……… and the “journalists” won’t blink an eye.

Dandapani on May 31, 2009 at 9:14 PM

Well … Republicans *could* do both – oppose this woman AND kill Socialist Health Care. In fact – the fight on the one hand could complement the fight on the other by defining Obama and all of his policies and picks as Socialist in nature. But …

In order to do that the “elites” like Cornyn to get out of the way and let the Limbaughs and the Hannitys have their way with Sotomeyer. They can define her and do a very good job of it.

But the Cornyn’s of the GOP elite want to silence the Conservative voice out there who are opposing Soto based on her racist statements.

Let’s get this straight shall we? I was in the military and I can tell you that when you’re in a desperate firefight – you launch all bullets at the enemy and NONE at the guy standing in the foxhole beside you.

But that’s not the way GOP elites like Cornyn see it – they feel a need to chastise OUR side.

This is not a recipe for success in battle.

Cornyn picked his path – he can live with it.

Sure, she’ll be confirmed. Sotomayor isn’t up for election. But some people who may not have thought about it much are getting a snootful of what “identity politics” and “judicial activism” are. Word is getting around, and a lot of people aren’t liking what they hear.

ddrintn on May 31, 2009 at 10:37 PM

Great debunking by Patterico!

This is obvious distortion, not news reporting, by the L.A. Times. How any news organization can take what Cornyn said and end up with what the L.A. Times did is unexplainable outside of outright bias involving making up whatever story they wanted and calling it news. It is almost like they had written the article before Cornyn’s appearance on the show.

willamettevalley on May 31, 2009 at 10:44 PM

Looks like the LA Times is finding an excuse to attack Cornyn of course he is in a weak position and that is why they are fingering him….Texas has a big Hispanic community so I am guessing they think the next Governor will be a Democrat if they smear him? Dirty Politics imagine in America of all places LOL!

Looks like they changed the wording in the article, which means that they have absolutely no excuse or defense whatsoever for saying what they did. As such, they should offer an apology for the damage done by the original version of the article which contained the lie. But they won’t of course.

The original will probably be in a Google cache but I’m not sure how to access it. We should make a point of forcing them to admit the fact that they lied and publish a screen shot of the cached page as proof.

Sharke on June 1, 2009 at 3:02 AM

The new “airbrushed” version:

Days earlier, Cornyn said in a radio interview that it was “terrible” for conservatives to be attacking Sotomayor as a racist. He did not reiterate those sentiments Sunday and pledged that he and other Republican lawmakers would investigate Sotomayor’s past comments and rulings to judge her fairness.

Brought to you direct from the L.A. Times chop shop.

Sharke on June 1, 2009 at 3:05 AM

I heard the left was growing uneasy about Sotomayor’s position on abortion. Obama said something like “I trust her interpretation of the constitution”, which bascially tells me he’s not sure of her position on that issue.

I wouldn’t be surprised if she turned out to be pro – life, and pro traditional marriage (what a pleasant that would be), but also supportive of big government programs like welfare. Latinos are social conservatives active in their churches, but they’ll vote liberals.

Some Latinos would love to see one of their own at the SCOTUS, but will they continue to support her if she consistently rules against the church and conservative values? I don’t think so.

Perhaps a way to expose these egregious agenda-driven (and less than ethical) “journalists” is to name their names as often as possible in online postings and in letters to the editor with examples of their maendacity. Expose them to scrutiny, and allow their names to come up often in Google searches. Let them wither in the spotlight.

Great Patterico…after exposing Bill O’Reilly you were banned…now you will never be allowed to read the LAT again…you will never learn.

Mad Kimchi on June 1, 2009 at 4:06 AM

Latino leadership is in bed with the Democrats – they’ll tell the community to support the Democrats come hell or high water. The ones that won’t are the well-off independently minded ones.

And don’t fool yourself. Soto is Pro-Choice. There is NO way that Obamba would nominate a Pro-Life candidate. He’s not George Bush.

Obama knows everything about this woman.

HondaV65 on June 1, 2009 at 7:18 AM

The penalty for being a pussy is to get f—–. No matter how obsequious you are it will never be enough. Even if you totally obeisant and apologize for living-taking up space and breathing out all that corrosive and globe-warming carbon dioxide-and vow to kill yourself, there will always be someone complaining about the “mess” a dead body makes.

BTW internationally, Obama will learn this lesson the hard way.

MaiDee on June 1, 2009 at 7:35 AM

At the risk of being repetitive, out of 45 million people the census bureau claimed as “Hispanic” people in the US, is Sotomayor the BEST that Obama could find? Surely he jests. She was picked for her flawed racist legal philosophies rather than her abilities.

{^_^}

herself on June 1, 2009 at 7:36 AM

I still don’t understand what is “terrible” about suggesting the woman is a racist. If you change one word of her statement (from “latina” to “white”) the statement is pretty clearly racist, yes? So why isn’t it racist now?
Cornyn is just being a cheap pandering politician. He wants the illegal alien vote as much as the Democrats do and he will throw his friends under the bus to get it.

SKYFOX on June 1, 2009 at 7:48 AM

It couldn’t have happened to a better appeaser. I no longer have any illusion that conservatism has a dog in this fight. Occassionally they make a show of it to pretend we have some influence but it’s all a game. I am to the point that I now realize that the left will never give up, are fighting to the death and the game is all but over. Therefore I hope and enjoy seeing them degrade and damage the liars and fakes that have helped the left take America down the road to ruin. I can’t wait until they think boehners usefulness is over and they destroy him. The base has allowed the party to be taken over by professional, unethical, unprincipled politicians and we have no one to blame but ourselves.

HondaV65 on May 31, 2009 at 9:25 PM

Good clarification, Honda, that hits a chord.

Very chagrined, Texas Republicans want Big Bad John to do right. He will face our wrath, as will Kay Bailey. Nothing is worse than what you’ve pointed out, friendly fire with full premeditated intent. Sabotage. And her coming home to run against Perry to be Governor plays exactly into the enemy’s scheme; divide and conquer to obliterate all Republican opposition. Sickening, to watch Cornyn tap dance on us for Barry’s pleasure. I’m not putting it past Cornyn to have a very complex scheme he’s working towards on our behalf.

I can appreciate the frustration Cornyn has with Limbaugh. It isn’t that Limbaugh is wrong. And it isn’t that Limbaugh has no right to express things in his own way. But Limbaugh does play to his audience, us, and does enjoy heckling his opponents. And that is great until Limbaugh uses every day language (unlike lawyers) that the media and politicians abuse full throttle to misrepresent Limbaugh’s statement and attribute prejudice to every Republican politician (the LA Times smearing Cornyn).

Right or wrong, politicians make deals in order to get legislation passed. During negotiations wherein Republicans are on weak minority ground, Cornyn doesn’t appreciate having to fight extra heavy burdens resulting from a crudely worded truth that escapes Limbaugh’s lips during a daily 3-hour radio stint.

Obama and Democrats aside for a moment, to illustrate a frustration from Rush’s female supporters rather than Republicans in Washington, note (less frequently than in former years) that Rush puts things poorly and leaves the mess for his supporters to overlook. Morons need not imply that Rush is a male chauvinist; he supports Palin and conservative women. As a human, at times he expresses his dissatisfaction in generalities that are not always wise because of the obvious specifics that make him look prejudiced. Today more than ever, Senators do not have the luxury of any prejudicial appearance on PC Capitol Hill.

That’s the gist of the differences: approach. And Honda is right’ we’re in battle for survival, and we need our leaders to be on OUR side, not on the fence, not in the middle of the road used most frequently for left turns.

I heard the left was growing uneasy about Sotomayor’s position on abortion.

It is a scam, she is a doctrinaire leftist and will do as instructed.

peacenprosperity on June 1, 2009 at 8:15 AM

More than anything, Sotomayor was chosen because she will ignore the Constitution in her decisions. In that, her racial and sexist biases are based. No one would enjoy equality before the law when the law is absent.

maverick muse on June 1, 2009 at 8:18 AM

During negotiations wherein Republicans are on weak minority ground,

Maverick, they controlled the House, Senate and White House for almost 12 years. They solved nothing. They blamed the demofascists for blocking. Now they are saying they have to tread gently because they are in the minority. It’s all lies, all a scam. The republicans think the American people are just as stupid as the democrats think we are. The republicans, democrats and media live in their own self created buble together and have no clue as to what reality really is. They pay pollsters, who like any other business want to kepp their clients happy, and the pollsters go out and create the results the politicians think are there. In 20 years the democrats will drive around in their limos and marvel at the equality of the people waiting in the bread lines and the republicans will drive by in their limos and talk about how Americans should have the choice of which bread lines they wait in.

peacenprosperity on June 1, 2009 at 8:21 AM

Only days earlier, Cornyn said in a radio interview that it was “terrible” for conservatives to be attacking Sotomayor as a “racist.”

Will Republicans ever learn?

They bend over backwards to, go along and get along, with the Democrats and they are in turn viciously attacked. Their surrender to the left buys them nothing and their attacks on their own base voters only alienate the people they need on their side to win.

Republicans truly earn the name “Stupid Party” every day.
