White House: We’ll cut off criticism of Porkulus

Mark Tapscott notices an interesting blog post by Norman Eisen, who works for Barack Obama as Special Counsel to the President on Ethics and Government Reform.  Anticipating a deluge of criticism over the thus-far ineffectual spending plan, Eisen has a straightforward plan to deal with criticism.  He’ll simply use the power of the federal government to silence it.  Problem solved!

“First, we will expand the restriction on oral communications to cover all persons, not just federally registered lobbyists. For the first time, we will reach contacts not only by registered lobbyists but also by unregistered ones, as well as anyone else exerting influence on the process. We concluded this was necessary under the unique circumstances of the stimulus program. [emphasis mine -- Ed]

“Second, we will focus the restriction on oral communications to target the scenario where concerns about merit-based decision-making are greatest –after competitive grant applications are submitted and before awards are made. Once such applications are on file, the competition should be strictly on the merits. To that end, comments (unless initiated by an agency official) must be in writing and will be posted on the Internet for every American to see.

“Third, we will continue to require immediate internet disclosure of all other communications with registered lobbyists. If registered lobbyists have conversations or meetings before an application is filed, a form must be completed and posted to each agency’s website documenting the contact.”

Silencing dissent and criticism is “necessary under the unique circumstances of the stimulus program”?  Gee, what “unique circumstances” might those be?  Perhaps the fact that it costs more than the Moon shot, and has yet to halt the economic skid.  Maybe it’s the fact that most of the stimulus package doesn’t actually stimulate anything except doctrinaire liberal dreams and the pens that check off the items from the Democratic wish list.

Remember when the Left took to the streets to declare dissent “patriotic” during wartime?  I didn’t have a problem with dissent then, but apparently the Left has a curious definition of “patriotism”.  Now, suddenly, the federal government can silence their critics at will, not to protect critical national-security programs or keep from undermining a war effort, but to protect a Democratic president intent on seizing control of private industry across a wide swath of the nation.  Suddenly, that kind of dissent threatens America.

Can the Obama administration get away with this?  I doubt it; I’m sure this is just a misunderstanding.  After all, if that were true, then I’ d be one of the first peo

Average Germans in 1935 or so said the same thing and look what happened. Sorry and with all courtesy, Mr. Morrissey, I can’t accept this is an aberration or another misstatement from the Administration. There is a plain intent here; maybe as a simple trial balloon at the moment but if they can get away with it…

As a Citizen of modest means, the most I can do is inform friends and family. I most deeply hope someone with clout fights this proposed notion at every possible legal level.

Left wing scumbags, being what they are, have never had a problem screeching for the obliteration of the first amendment. That is of course, unless their pro-communist rantings are being squelched by anything at all, then they go ballistic.

I think we need to make it not just a constitutional right, but a law. If you abridge anyone’s first amendment right you go to prison for each count for 5 years. The government should not only be included in that, but the special target of this law.

The communications they are talking about here are between Government officials and those trying to influence the bidding process.

It’s unreasonable to assume that you could have control over such a thing and actually get the records of conversations you demand but it is illustrating an entirely different problem than being an example of the thugocracy.

And, if he really wants to be pragmatic, he might want to do his own “listening tour” on the comment section of this site and others. It says a lot about the tone-deafness of our elected officials and the RNC mouthpiece that they refuse to use the resources at their disposal (media, microphone, events, etc.) to counter EVERY LAST THING coming from this admin. As it is, I hear nothing but what we are doing wrong or need to stop doing or be careful about. I don’t care one bit if we appear angry. WE ARE. And the public is too.

What infuriates me the most is the insistance that we lose because we aren’t MORE moderate. No. We lose because NO ONE IS LISTENING and we opt out. GET THE MESSAGE, STEELE and co. We are losing this country and cannot spare a second of time. Get it together.

Agreed. What, exactly, is the “problem” with the health care system? Certainly it isn’t the “care.” That is superb. It isn’t the tools because, for now, we have the best. It is the cost for insurance and cost for care out of pocket. Why might that be?

I haven’t researched this, but, doesn’t our preexisting entitlement structure and lawsuit threats/action already strain the system? Where does tort reform come in? The “health care problem” has much more to do with insurance than care. Butt out, government.

I agree with you in basic principle but how about this: Get rid of all laws regarding civil rights ‘violations’. That will clean out courts and remove uncounted layers of power from government and those special-interest groups favored by government.

For example, there have been many cases when police have acted within the law but later the departments and officers got creamed in civil-rights cases. I estimate it might be better to remove that entire notion except when a Citizen sues government as an entity for failing to abide by the Constitutions of the Union and/or an individual State.

Or how many owners of private property, who won’t rent to a gay couple because of the owner’s personal religious belief, end up being sued when religious liberty is one of the main reasons we broke with Britain in 1776?

In my estimate, only government as an entity can and should be sued for violating an American’s civil rights because our government was designed to protect the inalienable rights of the People.

Just a thought though, as I mentioned, I agree with you in basic principle.

No. Previously the system was set up to regulate communications between registered lobbyists and government officials. This new process regulates communications between “unregistered ones, as well as anyone else exerting influence on the process.” Therefor, if I contact my senators or congressman to urge them one way or another on the distribution of stimulus funds I become an “anyone else exerting influence on the process” and my right to petition the government is restricted or, at the very best, regulated.

This is alarming and very, very dangerous.

Got a thank you note signed by Palin for contributing to her defense fund. Made my day — even if a staffer or computer may have signed it(?). Don’t usually keep any political mailings, but this is a keeper. I say all conservatives must push back against the MSM attacks on her. Food for thought.
My kids were born in the sixties and the total expense was in the neighborhood of< $1500. Each. Their mother was in the hospital for 5-6 days.
In todays dollars, using a commonly accepted factor of 10, that would be about $15,000.
I understand the numbers are somewhere around $45,000 today for childbirth. And the lucky mom gets to spend 2 whole days in the hospital.
(these numbers are area specific BTW)
What is the major difference between the sixties and today? The Government has gotten involved in health care.

What will Obama have to do that will be”too far” for his media propagandists? In fact, when our next president is healing the nation from the deep wounds inflicted by this fascist president, I think a great move would be to fully eliminate that federal department, on the grounds that its focus on indoctrination rather than education softened the ground for the election of a fascist president and the near ruin of a great country. Someone must take the blame for this, and I think our education system — where leftist fascists are celebrated — is a good place to start.

I don’t understand why having an open, competitive bidding process on government contracts, as opposed to back room deal making and Bush-style no bid contracts, violates the 1st amendment. Was there an argument for that claim in this post? The 1st amendment guarantees a right to petition the government. That right is clearly preserved in the bidding process. It also guarantees the right to free speech, and anyone who doesn’t like the process can go to the press. I don’t see any argument to the contrary in this post. Where’s the argument?

This is the kind of doubletalk you can expect.

Folks, don’t be silly. I am as creeped by Obama on a daily basis as the rest of you, but this is a simple extension of a standard federal contracting practice. If you’re a bidder, for example, you can’t talk to anyone but the Contracting Specialist (or equivalent personnel) once an RFP/RFQ is released. Talking to any technical or program people will get you in big trouble, and for good reason. This isn’t intended to chill criticism of the ARRA. It looks like it’s intended to prevent grant steering.

It’s a little strange to complain about Murtech and its ilk and at the same time get antsy about a reg like this.

I think you’re a little guilty of malpractice there Doc. You must have missed this part “as well as anyone else exerting influence on the process.” That could be anybody! I don’t see where it is as narrowly focused as you portray it to be. We’ve all seen laws written that were vaguely worded and heard this, “Oh don’t worry about it, that’s not the intent of the bill” then we the law is signed, you find out that the wording was used exactly as it was feared. I put no abuse of power past these people. They are Clintonspeaking a law for a real purpose.

Hey,, look,, Obama’s election is historical,, OK?! We’re in a crisis,, OK?! Bush lied and people died,, OK?!
So,, debate and freedom of speech are fine,, but why is it needed once we find such a great and important President,, OK!?!
And as for elections,, well, we don’t need them either cause now that we found “the freakin one”,, why would anyone vote for someone else??! Wouldn’t that be like,, you know,, treasonous to want some other President??! You’d have to be suspicious of anyone who’d want to run against Obama!! (sarc!!)

And, if he really wants to be pragmatic, he might want to do his own “listening tour” on the comment section of this site and others. It says a lot about the tone-deafness of our elected officials and the RNC mouthpiece that they refuse to use the resources at their disposal (media, microphone, events, etc.) to counter EVERY LAST THING coming from this admin. As it is, I hear nothing but what we are doing wrong or need to stop doing or be careful about. I don’t care one bit if we appear angry. WE ARE. And the public is too.

What infuriates me the most is the insistance that we lose because we aren’t MORE moderate. No. We lose because NO ONE IS LISTENING and we opt out. GET THE MESSAGE, STEELE and co. We are losing this country and cannot spare a second of time. Get it together.

If it is not patently obvious by now that the two parties are two heads of the same beast, then you’ll never get it. The human spirit always carries a seed of hope which is why it is hard for us to accept this truth. But it could not be more apparent that this is the case. Conspiracies aside (though there have been REAL conspiracies throughout history), minimally the fight is for political survival no matter the cost.

Remember when the Left took to the streets to declare dissent “patriotic” during wartime? I didn’t have a problem with dissent then, but apparently the Left has a curious definition of “patriotism”.

…their idea of dissent is conditional upon whether or not they’re apt to win the argument, either by reason (which is never likely) or by brute force (“Who won this election?”).

…strangely, their patriotism is just as conditional. They’re only patriotic when the nation is acting like that little snow-globe of a pristine notion dancing in their heads like a demented ballerina…if it misses a step, they’re rooting for the Vietcong, the Sandinistas, or the Taliban.

…they love the nation in theory…it’s the messy fact of having to share that nation with peasants which frosts their bottoms….
