Top Senate aides: GOP ready to roll over for Sotomayor

No surprise. Sessions hinted this morning in an interview that there’ll be no filibuster and Grassley told C-SPAN flatly that she’ll be confirmed. As I said yesterday, what’s the point of starting a nuclear war that you can’t win? Save the ICBMs for next time, when the other side might be weaker.

Top Senate Republican strategists tell POLITICO that, barring unknown facts about Judge Sonia Sotomayor, the GOP plans no scorched-earth opposition to her confirmation as a Supreme Court justice…

“The sentiment is overwhelming that the Senate should do due diligence but should not make a mountain out of a molehill,” said a top Senate Republican aide. “If there’s no ‘there’ there, we shouldn’t try to create one.”…

GOP officials say they realize the party needs to improve its standing among Hispanic voters in order to have any hope of winning a national election, and they admit that trashing the first Latina nominee to the court could cement stereotypes or further alienate minorities…

Republican officials said they still plan an aggressive investigation of her paper trail, since Supreme Court fights have often taken unpredictable turns…

Radio host Hugh Hewitt was among the leading conservative voices who indicated that no holy war will occur. “I don’t believe in charging up a hill when you’re going to be completely mowed down,” Hewitt said.

It’s worth reading the whole piece, if only for the matter-of-fact acknowledgment of media bias in favor of Democratic nominees near the end. Further to that point, via Greg Hengler, here’s Coulter on GMA fielding dopey questions from Diane Sawyer about whether her heart swelled with pride at the thought of a Latino nominee, a line of inquiry for which AC was well prepared. Note also Carville’s painfully heavy handed attempt to goad her and Rush et al. into freaking out over the Sotomayor pick in order to make life difficult for Senate Republicans with the base. Even a fool like me saw that coming from a mile away.

her replacing souter is really not much of a change, and she might still turn out to be less frightening than we think she is.

with any luck, next year will bring a power shift and then we can fight harder if scalia or someone else on our side retires…

Why didn’t the dems trashing of Miguel Estrada ‘alienate’ the Latino democrap base, why didn’t democraps calling Estrada an affirmative action candidate, breach that bright line of proper debate that the libtard media is so happy to draw; why does opposing someone whose values and intellectual groundings are 180 degrees from the founding fathers, suddenly turn into an improper inquiry?

It ain’t a matter of a “nuclear war” or a filibuster or whatever, since it’s not about Sotomayor. It’s about Obama. And if the Republicans don’t use this opportunity to talk about what’s fundamentally wrong with the whole stupid idea of “empathy” in a SCJ, then they’ve wasted yet another chance.

“Empathy” v “Impartiality,” as Jonah Goldberg puts it. That’s the whole debate, the one Republicans can -and must – win, and the one in which the Republicans won’t, apparently, engage.

They really, really, really have lost all sense of principle, and are basically a bunch of 60-70 year old fossils, being led by the nose by a bunch of over-paid 30-something hired-gun “consultants.”

I give up.

The Dems must start to fear the anti-American policies they are pushing will be exposed. There is no such thing as “saving fire”.

How many insane policies have already been rammed through in this first 4 months? What is the fire being saved for?

This country is very close to the point of no return and too many people don’t seem to realize that. The fight is now, it is over everything, and it is total war. There is nothing to save fire for.

There are a lot of things to criticize the Senate Repubs for…but this isn’t one of them. Because they aren’t going to try and organize a filibuster (a lost cause at this point anyway), doesn’t mean they support her.

If Jeff Sessions doesn’t think that effort will do any good, I trust his judgment. I also suspect she will be questioned very directly by Sessions. That’s about the best we can hope for on this one.

If they can’t make the fight worthwhile by EXPLAINING to the people in no uncertain terms why it is that a flaming liberal that doesn’t want to adhere to the constitution on constitutional issues should not be put on the supreme court, then to hell with the GOP.

Where is their spine? Where’s the morals, and the will to stand up for them and defend the constitution which zerobama clearly has no regard for?

Anne Coulter was really on her best behavior in that video. Still as effective as always and did a great job weaving in the Estrada story.

If the Sotomayor information remains the same (no bombshells) I don’t want the Republicans to try to fillibuster her. Obama should get his nominee.

But the GOP needs to use the hearings to educate the populace as to why Sotomayor is a poor choice for the Supreme Court and why Obama picked her. They need to be on the pundit shows talking about Miguel Estrada and what the Democrats have done in the past to highly qualified minority nominees.

I also think they should vote against confirmation if they believe she is not worthy of the court. But no fillibuster or attempt at a fillibuster, assuming the facts remain as they are.

When you can tell a person’s politics by looking at their face, and in Sotomayors case you certainly can, it’s very disturbing, more so considering she’s going to be a supreme court judge. Can you judge a book by its cover? Most books can be deduced by their cover. And we all know what is inside this book. That is reason enough to fight her.

One of the first issues to be brought up is how Sotomayor resolves her stated opinions and rulings in relation to the oath that a SC justice takes. The questioning should be firm, complete, and rigorous, not hostile, because the only points that the public knows about Sotomayor is the WH-MSM narrative, worthy of “The View,” perhaps but not one that demonstrates reasoned jurisprudence.

Ann Coulter makes several solid points about the compelling stories of Clarence Thomas and Miguel Estrada, candidates who were trashed by the Dems for sleazy political reasons.

The weasel Carville typically tries to deflect the point by bringing up the totally irrelevant talking point about Gonzales. (What’s with the goofy faces that Carville was making at the end of that clip?)

Given how well Roberts and Alito did in their hearings (espcially Roberts, whose answers to the Dems’ questions had them going, “Duh. Ok”), Sotomayor has to come across as erudite as they were.

She will go through “murder boards” dry runs, but there are still plenty of areas where someone like Sessions could ask very hard questions, in the most courteous voice, that would show up her lack of qualifications.

Areas that might be explored:

Contracts clause (bankruptcy and creditor seniority, too)
property rights
Second Amendment
Full faith and credit
“penumbra” rights
First Amendment rights

I think it’s worth fighting a nominee that was overturned 60% of the time by higher courts. This means most of her rulings were wrong showing she has horrible judgement. A Supreme Court Justice should not have a record like this. I don’t care if she’s a communist, she’s a lousy judge and doesn’t follow the rule of law.

The dilemma here is with voting peeps with “R” after their name. If I change from “R” to “I”, then I cannot vote in the primaries and I want to defeat Charlie RINO Crist.

Something is going to change. And it ain’t like the hopenchange crap sandwich we’ve been forced to eat to date. This is going to be serious, well thought out, well funded, Non ACORN kinda change. And there will be little “Hope” for the D’s and R’s that are left in the dust.

First, . . . there can never be a universal definition of wise. Second, I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn’t lived that life.”

Justice O”Connor was speaking of a wise old man and a wise old woman reaching the same conclusion, Sotomayor is the one that brought race into it. Why did she have to say latina and white?

Also notice how O”Connor used wise in both describing the Old Man and the Old Woman but Sotomayor drops the wise from white male but keeps it for Latina Woman.

They will all be as bad or worse as Sotomayor. Obama is not going to nominate a strict constructionist. He’s not even going to nominate anyone who can say strict constructionist without a smirk.

The president should get his nominees if they are qualified for the position. We could make some hay out of the racism angle if there are more examples of racist statements from Sotomayor, but beyond that, she is, at the very least resume qualified.

If it is inevitable that she will be confirmed, along with the complete lack of investigation and reporting of her REAL background by the main stream media, do you all here really believe the average american who cares more about who wins American Idol each year and whether or not Jon cheated on Kate (Jon and Kate +8 show on TLC), will understand the NUANCE of impartiality of a SCOTUS member? Or know what “legislate from the bench” even means? Or even recognize reverse discrimination? Come on now.

I wish the GOP would make an ad showing the contrast in hearings between democrat nominees and republican nominees.

We need to start calling them out for their vile actions.

We also need a “dirt” squad. We need full time people digging up every piece of dirty laundry the democrats have … then we need to air it 24/7.

The GOP needs to remember how they approach the nomination of Sotomayor becomes a part of their record too.

Giving a pass to an activist Supreme court jurist defines them as much as it does the man who nominated her, which in my mind is the best option, associate her radical findings and personal feelings with his radical policies and direction he’s pointed the country.

Do you want the Senate Republicans to fillibuster every single Obama nominee?

I want them to try. Yes.

They will all be as bad or worse as Sotomayor. Obama is not going to nominate a strict constructionist. He’s not even going to nominate anyone who can say strict constructionist without a smirk.

And none of them should get through. They likely will, but they should be bloodied through the process as much as possible.

The president should get his nominees if they are qualified for the position.

Why? He’s not even eligible for his position. But that was another fight that we were advised not to engage, since he might win if went too far on that. Meanwhile, trillions of dollars later and with a large chunk of our industry falling directly under the thumb of the federal government …

We could make some hay out of the racism angle if there are more examples of racist statements from Sotomayor, but beyond that, she is, at the very least resume qualified.

I believe the Republican Party LEFT me behind a long time ago. Ergo no $ for the gutless, cluelees, stand for nothing, no principles party of pandering elites.

You can do that through the hearings. It doesn’t have to be done with an attempted fillibuster.

I also have no problem trying to bloody her up, through the hearings.

I just don’t think it is right to fillibuster a president’s nominees unless they are grossly unqualified. We lost the judicial philosophy battle (unfairly, I’d say) during the election.
