Video: Rush calls Sotomayor a racist, gets called a racist in return

Hark, the sound of a new Supreme Court nominee. The soundbite’s only part of an extended riff on what a disastrous pick he thinks she is, “the antithesis of a judge by her own admission”; see Mark Halperin for a transcript. The reply, naturally, is that her assertion about a “wise Latina woman” being the empathetic superior of a white man was yanked out of context. Was it? Quote:

Whether born from experience or inherent physiological or cultural differences, a possibility I abhor less or discount less than my colleague Judge Cedarbaum, our gender and national origins may and will make a difference in our judging. Justice O’Connor has often been cited as saying that a wise old man and wise old woman will reach the same conclusion in deciding cases. I am not so sure Justice O’Connor is the author of that line since Professor Resnik attributes that line to Supreme Court Justice Coyle. I am also not so sure that I agree with the statement. First, as Professor Martha Minnow has noted, there can never be a universal definition of wise. Second, I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn’t lived that life.

Let us not forget that wise men like Oliver Wendell Holmes and Justice Cardozo voted on cases which upheld both sex and race discrimination in our society. Until 1972, no Supreme Court case ever upheld the claim of a woman in a gender discrimination case. I, like Professor Carter, believe that we should not be so myopic as to believe that others of different experiences or backgrounds are incapable of understanding the values and needs of people from a different group. Many are so capable. As Judge Cedarbaum pointed out to me, nine white men on the Supreme Court in the past have done so on many occasions and on many issues including Brown.

However, to understand takes time and effort, something that not all people are willing to give. For others, their experiences limit their ability to understand the experiences of others. Other simply do not care. Hence, one must accept the proposition that a difference there will be by the presence of women and people of color on the bench. Personal experiences affect the facts that judges choose to see. My hope is that I will take the good from my experiences and extrapolate them further into areas with which I am unfamiliar. I simply do not know exactly what that difference will be in my judging. But I accept there will be some based on my gender and my Latina heritage.

I’m looking forward to hearing whether she thinks any of the white men on the Court currently aren’t devoting the “time and effort” needed to neutralize their white-male-ness, and to whether she’s devoted any of her own to understanding the “experiences” of people who aren’t female and Latino. I’ll go out on a limb and guess that Stevens and Breyer are in the clear. No doubt The One realized before picking her that this quote would be a big deal, but the upside for him is that it’s bound to spark another round of infighting between moderate and conservative Republicans over how hard to push on it, with his nemesis Rush leading the bomb-throwing brigade. The Senate GOP will go easy on her lest they lose more Hispanic votes — even Robert Bork’s predicting softballs — and that’ll only infuriate Rush and the base more, leading to yet another GOP clusterfark. Ah well. Let’s get on with it. Exit question: Who said this? “I think that the only reason Clarence Thomas is on the Court is because he is black. I don’t believe he could have won had he been white. And the reason is, I think it was a cynical ploy by President Bush.” Answer here.

Oliver Wendell Holmes? I would think it would be a good idea to keep things in the contexts of their times. I would not be surprised if the attitudes of a Latino woman in those times might well have seemed less than open minded by today’s standards.

Yes, I think that Obama really likes it when Republicans fight amongst themselves. I don’t know if I would call this woman a racist, but a comment such as the one she made is bound to cause her problems with all sorts of people, not just conservatives.

Leslie Crocker Synder is a lifelong Democrat, and like the vast majority of them, is an ignorant tool. For example, she is apparently is unaware that Rush was married in Clarence Thomas’ home by the Supreme Court Justice, and thus it is difficult to argue that he’s a “racist”.

Unless they played this clip over the weekend while The Won wasn’t on the links, I wouldn’t be too sure that he knows about it. The vetting practices of the White House have been less than impressive. If anyone listened to Rush they would know that he thinks that this nominee give Republicans the chance to paint a clearer picture of the president. I am sure the Judge will have a specfic number of times that she works in the word Constitution into her upcoming conversations. It’s will be like a game.

Rush actually started that line of thought by saying we’re not going to be allowed to challenge Sotomayor, because we’ll be called racist or sexist if we do.

The SCOTUS is charged with looking at everything, debating everything.

My hope is that I will take the good from my experiences and extrapolate them further into areas with which I am unfamiliar.

Again, Sotomayor hopes to take advantage of every opportunity to project HER experiences to be extrapolated even FURTHER (idealizing conjecture!) into areas she admits ignorance. Whatever bias she begins with, she’ll use to forge her way through unfamiliar territory.

And squishy folk want that in the SCOTUS for life rather than reject on RECORD AND WORD.

Ahhh…how the rule of law has fallen.

I remember a conversation I had with our former attorney general (he was 100% Democrat elected and re-elected in a VERY red part of a red state)…he once told me that there were times he was going to try a case and he would just cringe when he found out who the defense attorney was…he said he wanted justice to be fair and impartial and he wanted a defense attorney as tough as he was. He despised when he got one that he knew was a slacker. He wanted both the state and the defendant to have the best attorney to represent their case, and he wanted the judge (and jury) to consider all the facts and then decide based on the law and if he had truly won beyond a reasonable doubt.

She’s a lot like Obama in that way. She’s had the benefit of every opportunity this country has to offer (and more, because of her minority status), but we’re somehow supposed to marvel at all the “obstacles” she’s had to overcome.

The Rush think is just a diversion so no one will say anything unkind about her or question her because they don’t want to be compared to Rush. And our guys will fall for it, immediately. I bet they are lining up at the mic to disavow him at this very moment.

I read a great article on PajamasMedia yesterday in which the author, David Solway, wrote what I think is a vivid and very accurate description of Obama’s nonstop schedule designed to wreck America .

Solway said that Obama was busily “catapulting of a veritable horde of swindlers, charlatans, and incompetents into responsible government positions…”

And as if on cue today … Enter Sotomayer.

Can you imagine, say, Justice Roberts or Scalia saying that the richness of their experiences as white males would enable them to come to better conclusions on the bench than a Latina woman?

What do we have to do to stop this ride. Obama is the ultimate evil carney.

P.P.S. I think the only way out is for as many of us as wish to, to pray perseveringly that the good Lord will deliver us … soon, please. I know many of us are doing that already, but perhaps we could have a HotAir Prayer Pact. Maybe everyday at a certain time (9:00 P.M., maybe)we could all say a short prayer for our deliverance and Obama’s complete repentence. It’s just a thought, but if anyone else thinks it might be a good idea, please whistle.

…welllllllll…here’s someone who’s out-of-step with the spirit of the Sixties….

…I remember the Civil Rights era quite well, although I was just a sprout during most of it…and I seem to remember that the whole point was that the whole “all pigs are equal but some are more equal than others” schtick was unfair…remember “if you’re white, you’re right/if you’re brown, stick around”?….as a political society, we even advanced the word “discriminatory” to the head of the vocabulary to address the unfairness of someone being judged on the basis not of who they are, but of what they are….

…I seem to remember someone saying “not on the color of their skin but on the content of their character”, or some such nonsense….

…well…fairness was getting fatiguing…it’s nice to see that we’ve found a supreme judical nominee who agrees with me….

…I guess we’ve put all that “colorblind” claptrap all back into the cupboard where it belongs…if Ms. Sotomayor is found to be a suitable justice (justica?), and we can go back to judging people by their skin color, their apparent ancestry, their accent, and the part of the town they live in….

…think of how it simplifies things…now, someone showing the Puertorican flag on every article of clothing, on ones car, tattooed on ones forehead and the like is no longer that pesky “expression of pride” thaaaang…it’s a sign, like wearing a Masonic ring, of being a part of an in-crowd…in Ms. Sotomayor’s case, one which can out-judge pitiful old white guys….

So…let’s get back to judging by the group, why don’t we…we’ve never really given it up.

…after all, we still judge that people from “historically disadvantaged” ethnic groups are themselves disadvantaged, regardless of their personal circumstances when it comes to college admission, the letting of contracts and the doling out of patronage.

…we can stop celebrating every “first black” and “first hispanic” this or that, as if getting to table is any more a victory for all black or hispanic layabouts than having white doctors or lawyers or legislators is a victory for the white layabouts out there.

Let us celebrate that a “latina” has been chosen…as if to say that this somehow validates all the “latinas” out there…as if to say that all of the “latinos” and “latinas” out there are the same…after all, demographically, don’t Puertoricans equal Mexicans equal Costaricans equal Dominicans equal Brazilians? As old guys in the barbershops of my youth used to say, they (and Italians, for some reason) all speak some form of “Mexican” to the ears of old, stick-in-the-mud white guys who used to natter to eachother in the days before Selma and King and the Voting Rights Act….

…it’s nice to see that we’ve evolved enough as a society to pick a judical Puertorican version of an old stick-in-the-mud for a plum job….

…but, maybe I’m being cynical…maybe, like Earl Warren, she’ll leave her resume behind her and bravely strike out in new, more fair directions….

…but I doubt it….
