Schumer to GOP: Oppose Sotomayor at your peril

Via Greg Hengler. So mindlessly is he regurgitating talking points here about Sotomayor’s alleged moderation — which seems to be based entirely on cases about criminal law — that he actually congratulates Obama at the end for not choosing, and I quote, a “far-out liberal.” Because if there’s anyone whose heart would break at the thought of a hardcore lefty on the Supreme Court, it’s Chuck Schumer’s. As for Republican opposition, he’s worried over nothing. The head of the Congressional Hispanic Caucus has already sent up a racial flare warning them away from opposing her; the GOP contingent on the Senate Judiciary Committee consists entirely of white men, too, making the identity politics optics especially unfavorable. (Marco Rubio’s doing his best on their behalf from Florida.) I’ll be surprised if she gets less than 75 votes. Note also Schumer’s reference to the hardline “five percent” of Republicans who’ll agitate to try to block her. As I suggested in the Rush post, if any serious opposition to her does mount in the Senate, no doubt the party will be accused of doing Limbaugh’s bidding yet again. I’m sure they’ll press her on the “policy” quote and on the “wise Latina woman” bit from her speech, but given the identity politics here and the fact that they’re surely not going to filibuster her, what’s the political upside to them from a party-line “no” vote?

Don’t be too bummed, though. Frum may have found the silver lining here.

I agree. I also want it constantly pointed out that Obama voted against Roberts and Alito for purely ideological reasons. Obama is also highly critical of Thomas, who has a biography that could beat Sotomayor’s biography.

The best I can hope from this is they call out Obama and the Dems for what they’ve done to Republican nominees JUST BECAUSE.

If the dems hold the party line (plus Liebs and Sanders) as well as the same repubs that voted for her in ’98 (plus Grahamnesty), that’s 65 according to my math. I expect further (R) yays from both Texans, and Mel Martinez. If McCain flips, you may have a shot at 70. Otherwise, I can’t smell it.

Elections have consequences, isn’t that what we used to say around here? Short of having killed Natalie Holloway, she’ll be confirmed. The best that the GOP can hope for is to land a few shots and make Obama expend some political capital to drag her across the finish line. Give her 75+ votes as a qualified but not ideal candidate and be done with it.

By all means, make her squirm in the hearings, but there is no sense in going nuclear in a fight that cannot be won. Even if she does get bounced, there’ll be another liberal waiting to replace her.

Perhaps Sotomayor’s most controversial decision was in Ricci v. DeStefano, in which she was part of a panel ruling against a group of white firefighters in New Haven, Conn. — they objected after the city threw out the results of a promotion test because too many white firefighters, and not enough minority firefighters, scored high.

She and two other judges summarily dismissed the case without tackling the complex issues outlined in stacks of briefs and debated in extended oral arguments. Instead, the court issued an unsigned, one-paragraph opinion. Sotomayor’s colleague, Judge Jose Cabranes, was so concerned that he wrote a lengthy dissent highlighting what many saw as an attempt to bury the case.

“This perfunctory disposition rests uneasily with the weighty issues presented by this appeal,” he wrote.

The discrimination case was later kicked up to the Supreme Court, and a decision is expected by late June.

Sotomayor has a record of being rebuffed by the high court. Of the six decisions she was a part of that came before the high court, five were reversed. In the sixth, the court disagreed with Sotomayor’s reasoning.

No more compromises with leftists. They are anti-constitutionalists by nature. Do what it takes to stop these quacks and keep doing it.

Now, if I might, on to David Frum. What does Frum have to do with any of this, you ask? David has never recovered from my drubbing him on my radio show, or should I say the drubbing he gave himself. He immediately went crying to Newsweek, MSNBC, various broadcast networks, etc., to complain about the low state of conservatism. If only the rest of us would embrace the “true reformers” (you know, in addition to Frum, David Brooks and Ross Douthat, among others), we would be so much the better. Dare I say if they were intellectually coherent and consistent, not to mention principled, it might be easier to understand them. But they are, with a few exceptions, ineffective lightweights who shoot spitballs at conservatives from the backbenches. This is precisely why the media promote them during their little hissy fits.
