Justice Stevens of the current court came in for a fair share of criticism (all justified in my view) for his expansive reading in Kelo v. City of New London (2005) of the “public use language.” Of course, the takings clause of the Fifth Amendment is as complex as it is short: “Nor shall private property be taken for public use, without just compensation.” But he was surely done one better in the Summary Order in Didden v. Village of Port Chester issued by the Second Circuit in 2006. Judge Sotomayor was on the panel that issued the unsigned opinion–one that makes Justice Stevens look like a paradigmatic defender of strong property rights.

Sotomayor is going to be confirmed. There is little doubt about it. So, going into weeks or months of paroxysms and hysterics about alleged “judicial activism” is just going to make the party look bitter, mean, tone deaf, and out of touch…
So, for the good of the party, after applying reasonable due diligence, we ought to be prepared to wave a white flag on Sotomayor, give Colin Powell a big bear hug and sincere thanks for sticking it out, and move on.

I don’t care how Republicans will look. They need to fight this nomination tooth and nail. If they don’t that means that they were cowed by the identity argument, which signals the end. I want the Repubs to make this an absolute bloodfest, whether they win or lose, and I want them to do the same on every single issue The Precedent or his goons attempts to pass through. This is the end game.
There is nothing else if these traitors are allowed to disassemble the US, so the Repubs have to fight every single battle to the death and in a true no holds barred fashion. This has been a long war, that the Republicans have pretended wasn’t happening, and it is close to being decided.

Au contraire, it will make Republican’s look, in attempting to stop this racist and sexist who does not believe in the U.S. Constitution, look like they have at least some principles and some testosterone left. And that will be even if they do not succeed in stopping her, and in a way even more so for having risen to the challenge against the odds.

Look, just stand on principle — do not be nasty like the dems are so often — just make the case — activist judge, not too bright, (liked by Crissy Matthews! yikes!), = not what the oath and the framers had in mind — capitulate and the next nomination will be Saul Alinsky reincarnated (or maybe Bill Ayers!) I went to high school with Sonia. Couldn’t stand her then, can’t stand her now. I’m pretty sure she was an officer in the school’s chapter of ASPIRA, which in and of itself is not a bad thing, but that’s the main reason I remember her. She was overbearing and obnoxious, and good friends with another student named Paula Madison (nee Williams) who disrupted my graduation with their black power antics and signature black armbands.
So Sotomayor will soon be on the SCOTUS and Madison is now VP of….wait for it…..Diversity…….at NBC.
How depressing.

Yes, they need to put libs on the defensive about her stance on race and gender mattering to legislation. They’re probably not going to stop the appointment, but they’re missing a huge boat if they don’t sound some alarms and make a lot of prominent Democrats (elected, media and otherwise) openly defend racism against white people.
There’s still a lot of white people in this country, and they’re the ones that elected Obi “I Won” Kenobi.

And just what would Ms. Sotomayer classify as a real Latino? Would a Mexican-American of 100% Aztec ancestry qualify? How about a Spanish-American of 100% white European ancestry? Hispanic is not a race or even an ethnic group since Hispanic encompasses a broad range of ethnic groups.
But as we become ,ore “diverse” this type of division will only increase.

I know. But it’s a fact of life…and not everybody who does this is beautiful themselves and they know it. It’s a way of humanizing people who think they are above the rest of us…it’s a natural reaction to elitism. It levels the field a bit and reminds us all that our ‘betters’ aren’t as ‘better’ as they think they are.

Like hell it is! Even imbeciles know the difference between “public” and “private”. The Kelo v. City of New London decision would remain unconstitutional even if it had been a unanimous decision. Frankly, this alone is grounds enough to engage in some of the, um, activities espoused by our founding fathers in such circumstances, and they’ll only get away with it in this case, at least for a while, because only a small minority is directly impacted by this unconstitutional decision.

One more point…this is not some innocent waif who is being victimized by powerful people (Rush included). She is about to become an exceeding powerful, wealthy woman (for life) who can now justify her every whim with he stated identity politics agenda…the people who a making fun of her aren’t doing it from a position of natural social power…they are afraid of her, as I am. Making fun of her appearance is a very minor attack against someone who will hold a great deal of power over all of us…it doesn’t matter what her race or gender is. We know what is coming.

Someone MUST question Sotomayor about campaign finance rules. I would LOVE to hear someone give the hypothetical of a Presidential campaign that allows anonymous donations and ask about its Constitutionality – throwing that McCain-Feingold POS in just to let McCain know that he failed in keeping an eye over the enforcement of his own, cr@ppy, unConstitutional law. This should be an easy one, and even if she doesn’t answer, it could get that idea into the public, ready to discover that The Precedent’s campaign did exactly that. This opportunity cannot be allowed to pass by.

Yes, but my point is, it’s not really about physical ideals…it’s about taking someone down a few notches so that she can be dealt with on an intellectual level…she’s presented to us as an unassailable candidate exactly because of her appearances…because of her skin color and her gender. So, some quick shots are taken there…as a prelude to dealing with the fact that her appearances are the only qualifications she has.
