Granholm goes to the White House … and the Supreme Court?

Michigan Gov. Jennifer Granholm, one of Pres. Obama’s candidates for the Supreme Court, will be visiting the White House tomorrow, raising her profile among those handicapping the nomination.

These types of visits tend to surround Supreme Court nominations, and frequently are nothing more than courtesy calls. Granholm has distinct weaknesses as a nominee, but probably no fatal ones. She has no prior judicial experience. Rep. John Conyers (D-MI) withdrew his support for her, though one would expect him to back her if Obama actually nominated her. Moreover, Granholm has had tax problems, though at this juncture that seems more like a prerequisite for Obama than a disqualification. Besides, with the Senate Republicans already lowering expectations that they are planning any major political fight, Obama has a relatively free hand.

What Granholm has going for her is unpopularity. Many blame her for Michigan’s dire economic conditions, which are far worse than the national average. If Obama nominated her to the Court, the political prospects for Michigan Democrats — and ultimately Obama — would likely improve at the margins. Michiganders would be glad to see Granholm go. At least one poll shows Lt. Gov. John Cherry losing to prospective challengers; he would probably be more formidable as governor. Obama’s intrusive meddling with Chrysler and General Motors on behalf of the UAW demonstrates the president’s interest in holding onto the Rust Belt now and in 2012.

Granholm, like the other names being floated, also fits Obama’s long-standing suggestion that Supreme Court Justices should have “empathy” for the disadvantaged. Indeed, on the campaign trail Obama invoked “empathy” as the reason he opposed the nomination of now-Chief Justice John Roberts, who told the Senate he viewed the position as being a neutral umpire. It is probably not a coincidence that we are starting to see outlets like The New Yorker running pieces on how insensitive Chief Justice Roberts is to the plight of the disadvantaged. Lefty lapdogs like Jeffrey Toobin certainly recognize that the White House will sell Granholm — or any other Obama nominee — as a necessary balance to the cruel white men appointed by fmr. Pres. Bush.

It is probably not a coincidence that we are starting to see outlets like The New Yorker running pieces on how insensitive Chief Justice Roberts is to the plight of the disadvantaged.

It’s almost like those countries where the media is government owned and controlled.

He wouldn’t be breaking any new ethnic/gender/sexual orientation grounds with Granholm’s appointment. She is, however, completely unqualified – so he’s got that to fall back on.

I’m not interested in seeing them do so, but it will be interesting to compare the response. I’ll admit, in advance, that it’s an analogy that’s not entirely on all fours, but it’s darned close–a lot closer than the weak analogies drawn by too many liberal commenters at Hot Air.

On the other hand, I expect she knows about as much on consitutional law as Harriet Miers. Miers was withdrawn after it became painfuly obvious during her “murder boards” (practice questioning for the hearings) that she didn’t know squat about consitutional law.

Late Thursday, the Michigan Republican Party issued a statement skewering Granholm for “tax evasion,” and likening the IRS lien to an $800 lien placed against the Wayne County home of Granholm and her husband in 2006 for failing to file unemployment insurance reports on their nanny.

It’s quite likely that such problems were merely the result of oversights on the part of an accountant. After all, the last thing any elected official would want is to get caught trying to engage in tax evasion. But regardless, after several other appointments in his administration have been scuttled due to tax issues, the mere appearance of impropriety here, the faintest whiff of a tax problem, may well be enough to cross Granholm off the short list for a Supreme Court nomination — and even for a lower court nomination later in his administration.

Jennifer Grahamcracker runs the state of Michigan into the ground (even California looks like paradise compared to that state) and now has a chance of being rewarded with a Supreme Court seat. Never mind that she has no experience as a judge and that she’s probably the worst governor in the nation.

The Detroit Free Press reported that an $800 lien was “placed against the Wayne County home of Granholm and her husband in 2006 for failing to file unemployment insurance reports on their nanny.”

But that was only the start of the Governor’s difficulties with the tax man. Last year the Internal Revenue Service came calling on Jennifer Granholm in an attempt to collect nearly $20,000 in taxes she’d failed to pay on an inaugural committee, dating all the way back to 2003. To show they were serious they brought a nearly $20,000 tax lien with them.

The lien was necessary, according to Lansing’s WILX, because Granholm had ignored at least four previous attempts by the IRS to collect the back taxes. In other words, she isn’t just a tax cheat… she is a chronic tax cheater.

She can pull out her Harvard Law degree and Michigan Attorney General experience as qualifications, especially with the “nontraditional” buzz we’ve been getting. I’m beginning to think that the Founding Fathers of this country assumed way too much intelligence – when they allowed the Constitution to be so mute on the matter of qualifications – for President – for Congress – for the Supreme Court.

“No judicial experience” – I guess that means “will have empathy.”

I’m still lookin’ for that “penumbra” part of the Constitution. And now I have to find the “empathy” part for Supreme Court members?

What’s with Obama taking Governors out of their State houses? Napolitano (AZ), Sebelius (KS), Richardson (NM-oops!), Huntsman (R-UT), and maybe Granholm? Is this a tacit admission that Obama lacks executive experience? Is his next nominee Rod Blagojevich for Ambassador to Croatia?

There could be a political price to pay for this–Governors usually go on to become Senators, sometimes President. If Obama brings too many Dem Governors into his Cabinet, they may be replaced by Republicans. We saw this in reverse with the Bush Administration, which took Republican Governors Christie Whitman (R-NJ) and Tom Ridge (R-PA) into the Cabinet, who were then replaced by Democrats.

If Obama needs to nominate a woman or “minority” to the Supreme Court, and wants a Governor, may I suggest Governor Bobby Jindal of Louisiana, whose parents came from India?
