TNR: Sotomayor not brilliant, but certainly egotistical

After the news of David Souter’s retirement, most of the speculation regarding his replacement centered on Sonia Sotomayor, currently on the US 2nd Circuit Court of Appeals.  Sotomayor’s name had come up during the Bush administration as well during the summer when two Supreme Court openings appeared.  The Right didn’t have any enthusiasm for the George H. W. Bush appointment, but many assumed she would get embraced by the Left.  Not so fast, says Jeffrey Rosen at TNR:

But despite the praise from some of her former clerks, and warm words from some of her Second Circuit colleagues, there are also many reservations about Sotomayor. Over the past few weeks, I’ve been talking to a range of people who have worked with her, nearly all of them former law clerks for other judges on the Second Circuit or former federal prosecutors in New York. Most are Democrats and all of them want President Obama to appoint a judicial star of the highest intellectual caliber who has the potential to change the direction of the court. Nearly all of them acknowledged that Sotomayor is a presumptive front-runner, but nearly none of them raved about her. They expressed questions about her temperament, her judicial craftsmanship, and most of all, her ability to provide an intellectual counterweight to the conservative justices, as well as a clear liberal alternative.

The most consistent concern was that Sotomayor, although an able lawyer, was “not that smart and kind of a bully on the bench,” as one former Second Circuit clerk for another judge put it. “She has an inflated opinion of herself, and is domineering during oral arguments, but her questions aren’t penetrating and don’t get to the heart of the issue.” (During one argument, an elderly judicial colleague is said to have leaned over and said, “Will you please stop talking and let them talk?”) Second Circuit judge Jose Cabranes, who would later become her colleague, put this point more charitably in a 1995 interview with The New York Times: “She is not intimidated or overwhelmed by the eminence or power or prestige of any party, or indeed of the media.”

Her opinions, although competent, are viewed by former prosecutors as not especially clean or tight, and sometimes miss the forest for the trees. It’s customary, for example, for Second Circuit judges to circulate their draft opinions to invite a robust exchange of views. Sotomayor, several former clerks complained, rankled her colleagues by sending long memos that didn’t distinguish between substantive and trivial points, with petty editing suggestions–fixing typos and the like–rather than focusing on the core analytical issues.

Not that smart and a bully.  Sounds wonderful!  At least Souter was a polite non-entity.

The biggest part of the problem for the Left will be what we on the Right feared with the Harriet Miers nomination.  Supreme Court nominations are rare opportunities to seed the legal system with well-reasoned precedents on behalf of one’s legal philosophy.  Nominating a lightweight surrenders that opportunity.  Republicans and conservatives held out for a better choice than Miers and got Samuel Alito, who had much more intellectual heft in his resumé.

Considering Obama’s other appointments, though, this could be seen as a feature and not a bug.  He hasn’t exactly made dazzling choices, from Tim Geithner to Tom Daschle to Bill Richardson to … well, Joe Biden is really the acid test here, since that choice reflects Obama’s judgment on who best represents his values and policies in case of a sudden emergency.  If Sotomayor is the mediocrity that Rosen suggests, then remember that I predicted exactly that kind of appointment from the beginning, and bet accordingly.

I have been reading reviews on this woman all weekend. I have come to the conclusion that she isn’t really qualified for the job she holds now. Why would anyone seriously consider this person for such an important position? Sounds like someone is trying to fill minority quotas.

The difference is the left isn’t looking for any intellectual heft of legal precedent behind any decisions made by Sotomayor or whomever Obama selection. They already know what the right answers are based on feelings, and if Sonia votes the right way while maybe throwing in one or two gratuitous jabs at Thomas or Scalia in her opinion that can be exerpted on the HuffPo or Daily Kos, that’s all they really want.

I’m holding off buying into this critique until real information is verified.

But my initial reaction is to feel discouraged. She has a very important job now.

Why is this incompetence, if it’s true, throughout banking, car industry, and the courts?

We are really not very disciplined as a nation.

So what if she’s a bully and not so bright? She’s Puerto Rican and a female, and that’s what matters. The Hispanics are still peeved that their one Cabinet appointment (Richardson at Commerce) was torpedoed. They’re “owed” for their support of Obama, and he’s going to pay the bill.

The sad thing is that we can’t do much about it.

Actually Obama has been so bad at making appointments that he could make a mistake in our favor like BushI made in theirs with Souter. We can only hope.

I do want someone who is competent. I am tired of minority appointments of “quackers.”

There are many, many bright and minority people working diligantly and producing good results.

Somehow, though, we seem to be promoting the incompetents.

I have instinctively hated Affirmative Action since I discovered what it was back in the seventies when I was in high school. Even then I knew that its existence implied inferiority for nonwhites and females–like me. Sotomayor and most other recipients of AA know this as well. The above-described behavior is how they cover for their feelings of nagging doubt, demonstrable inadequacy and lack of real education and preparation.

He will pick the Court candidate who delivers him the biggest bloc for 2012.

Why? Isn’t is good for us to have an incompetent liberal on the Court if we have to have another liberal? It could set the cause of affirmative action back a long way if Sotomayor proves to be an unqualified hack with no good legal ideas at all.

This White House seems much more concerned with window-dressing anyway. So let them have their token woman/Hispanic. I think we can be pretty sure she won’t be writing any opinions anytime soon. If she’s a bully then Scalia will make mincemeat of her.

The sting in any rebuke is the truth. I don’t care about Meggy Mac one way or another, but she is an annoying fat b*tch. It’s never nasty to tell the truth. it’s a moral imperative. And why would I give a f**k who you’re attracted to?

As to Sottovoce, or whatever her name is, as long as she votes the liberal positions on a given issue, who cares how stupid she is? We have a wet eared rookie for a President; a moron for a Vice President, and an aging empty headed barbie doll for the speaker of the house. A stupid Supreme Court justice doesn’t make much difference at this point.
Of course, the GOP really shouldn’t snicker about this. Look what we nominated for President.

This administartion should be a clarion call for underachievers everywhere. No matter how stupid you are, as long as you’re a flaming leftist nutbag, there’s always a chance you’ll be elected President, or appointed to the Stupreme Court.
