How HUD throws Grandma in the street

Audrey Jones thought she had found the last place she’d ever live when she moved into Huntsville’s Stone Manor apartments. Annie Harrison had a nice two-bedroom unit at the complex — until HUD and the federal government decided to convert Stone Manor into public housing. The Huntsville Housing Authority, backed by HUD and Washington, canceled all of the leases and started kicking out all of those who made too much money to qualify for assistance, including Jones, and left many residents in limbo (h/t HA reader Karen A):
Audrey Jones, widowed a year ago, sold her home in English Village last summer to move into a well-lit and quiet, two-bedroom place at Stone Manor Luxury Apartments.
“I thought I was going to be here the rest of my life,” Jones said. “I loved this place.”
But what happens when the Huntsville Housing Authority, backed by federal regulations and federal dollars, converts your home into public housing while you still live there?
At age 73, Jones now counts herself among the “displaced persons” – residents forced to leave Stone Manor because they earn too much money. Some will get a few thousand dollars to help with relocation. Others won’t get anything.
When HHA bought Stone Manor, it cancelled all the leases signed by the residents, who could be forgiven for thinking that a contract is a legally binding instrument. On February 27th, HHA sent a letter to all residents essentially demanding that they all apply for public housing or get the hell out of their homes. Many of them do not qualify, because they earn too much, although HHA didn’t do much to clarify that, either. Initially, residents were told that they couldn’t make more than $18k/year, but now they’ve adjusted that to $37,800 for individuals.
In some cases, that didn’t help. Harrison, for instance, found out that the initial word — that she wouldn’t qualify and had to move — was incorrect. Later, though, HHA officials assured her she could stay, but that she’d have to move out of her unit into a one-bedroom. And since she now qualified for the one-bedroom unit, they won’t pay moving expenses if she chooses to move elsewhere, because HHA says they’re not forcing her to move.
For typically heartless social engineering, try topping this:
Jana Rice makes more than $37,800 a year as a paralegal. That’s too much to avoid eviction at Stone Manor. But Rice says a representative of the Housing Authority suggested a way to keep her apartment.
“She said, ‘If you really want to stay all you have to do is get pregnant,’ ” Rice said. “I was flabbergasted.”
And for clueless bureaucratic fumbling, you just can’t beat this:
The first letter also warned that no one should move right away, not until they get a second letter called “a formal notice of relocation eligibility.” Otherwise, they could miss out on thousands of dollars in federal compensation.
“We’ll be sitting around for two months wondering if this notice is coming,” said Catherine DeRisi, who works for Teledyne Brown Engineering and who also counts among the displaced.
As of Friday, Jones said she’s still waiting. DeRisi said she received the second notice late Thursday. And it only made her angrier. “They are lowballing us,” DeRisi said.
They sent misleading information about other housing options in the area as well. HHA only had one caseworker on Stone Manor to deal with all of the applications and questions until a couple of weeks ago, when they added four more. Residents feel betrayed, and wonder why the federal government wants to force people onto public housing assistance when they got by just fine without it before the buyout at Stone Manor.
It’s a good question, but one that almost answers itself. HUD wants to show that it’s succeeding by providing more housing to more people, regardless of the fact that they actually have to dislocate people in order to do it. Bureaucrats want to ensure job security, especially when the economy makes the private sector even less appealing for paper-pushers. And this administration is not likely to mind getting more people dependent on government.

I can’t for the life of me see how this can be legal.
I wish some smart attorney would do something pro bono here & find out.
This is outrageous. But nothing new.
We in agriculture who have to deal with the govt have already found out this nasty side of our beloved Uncle Sam.

This is very stunning but is believable. This will happen more and more in other States as well. HUD is a joke of a program. Low Life People are on HUD and Section 8 here in CA. They get very nice places and let these lazy Welfare Rats move in and it won’t be a nice place after a few months. Disgusting that they would do this. Not surprising. What is next? Our homes?

This all boils down to the problem of the Feds under this administration disregarding contracts.
Without legal and binding contracts, commerce is impossible, capitalism is impossible, business is impossible, basically we are a banana republic with a “thug in chief” style of government which respects no limits on what it can do or violate.
Which suits the commie-lib in chief just fine.
Indeed, the Constitution ITSELF IS A CONTRACT between the People and the government, which grants the government only the limited powers enumerated.

You nailed it, right there! This makes my blood boil. I guarantee that within a year, or two, most, if not all of these “luxury” apartments will be in disrepair, and be a pale comparison, to what they look like now.

I’ve never heard of a local housing authority buying a privately owned, non-subsidized apartment complex like this and kicking out residents. I am wondering where the HHA got the money for it. HUD does not provide direct funding to housing authorities for expenses such as purchasing buildings. The HHA must have issued bonds to finance the purchase. HUD’s role is to provide limited operating subsidies to the local authorities for existing public housing.
So I think the outrage should be directed to the HHA, not HUD. So many of these local housing authorities are incompetent and/or corrupt. I’ll bet the owner of Stone Manor got quite a sweetheart deal, and I would not be surprised if some kickbacks were paid to people inside the HHA as well.
Unfortunately, the residents of Stone Manor probably have no legal recourse. I doubt that Alabama has very strong landlord-tenant laws. In some states, it would be illegal for a new owner – even a government agency – to refuse to honor existing leases, and in some places (Massachusetts, for example) there are requirements that residents be given the first opportunity to buy the building if the owner decides to sell it.

The poor souls who moved into the apartment complex under a legal agreement now are put at the mercy of HUD (not Paul Newman). A nice small community of like minded people is now to be infiltrated by low life scum who are either unemployed or unenployable. Most folks will probably have to get Rosetta Stone CDs to learn to speak Spanish to their overloads. This is f,ing criminal. My head is beginning to bleed! My guns are loaded.

This is the same kind of fuzzy math that Obambi uses for his job numbers. Tax and penalize a business into going under and laying people off, then the feds step in with a bailout, the layed off people get rehired and the next day he is on TV talking about the new jobs he created.

You have no idea what it’s done to the south suburbs of Chicago. Daley has virtually torn down the majority of the public housing here. The same public housing that his daddy built.
The south burbs are in shambles because of it. High crime, dropping property values because people want out, and gigantic property taxes. I guess the Section 8 landlords get cuts on property taxes……you know the story.

I worked at two different housing authorities for about 12 years. None of this is a surprise…especially the part where they told the woman she could qualify to stay in her apartment if she got pregnant.
Public Housing was originally conceived as a springboard for military families and was to be a hand-up…it quickly became a hand-out. Familes with four generations born and bred living in public housing is not unusual.

Sure they do. HUD has many different construction/rehabilitation/captial grants that they provide to HHAs, not to mention Section 202 and 212 subsidized (tax deferral properties) loans. HUD does much more than send subsidy payments to HAs….much, much more.
I’m not saying that HHA didn’t have enough of a reserve balance that would allow the board to purchase an apartment complex (but I doubt it), but to say that HUD doesn’t provide funding for these types of purchases is erroneous.

One can only imagine. I used to live in NC where the city that we lived in had 7 housing projects and is looking to add more. I may not have seen the scale of a Chicago housing project but, the ones that I have seen are beyond comprehension.

In our city, many would like this to be the other way around.
Years back, HUD housing was inserted into some of the nicest urban neighborhoods with old mansions, etc. The effects have been disheartening as once-prized neighborhoods have seen dramatic losses in property value.
To the point where a lot of people here would like to see the HUD homes removed from those neighborhoods, but don’t know how to do it.

By telling the residents to apply for public housing to see if they qualify to stay HUD is admitting that people who don’t really need public assistance (because they could afford to live in the apartment w/o assistance prior to the takeover) are possibly eligible for public assistance. And that they are only too willing to give it to them.

My thoughts exactly. I am wondering why any of these current residents would even WANT to stay, even if they did qualify. We’ve all seen housing projects I’m sure. My brother is a retired police officer in NY. He used to patrol in a precinct in Brooklyn that was heavily populated with “projects.” These places were hellholes. Graffiti covering the walls, garbage in the hallways, people urinating regularly in the courtyard. My brother’s partner wondered aloud how or why they would want to live that way and my brother wisely pointed out that they have no incentive to keep the place up because they owned no stake in it, and had to do nothing — literally — to get it. There’s certainly no reason to think that the same won’t happen at Stone Manor. The dregs and the addicts will move in and it will get trashed (assuming someone doesn’t burn it down in a meth lab explosion) and crime in the area will be up while property values go down. Sounds like a brilliant idea all around.
On a more alarming note . . . does contract law have any weight at all in this country anymore? It seems like Dear Leader is running around invalidating private contractual arrangements left and right anymore. I wonder how long until it becomes “illegal” to save and invest for your own retirement. I’m sure that’s on the agenda somewhere.
