Shouldn’t a DHS Secretary know that illegal immigration is a crime?

The boss is all over an interview of Janet Napolitano on CNN this weekend, in which the Secretary of Homeland Security — the department that secures our borders — blithely asserts that illegal immigration is not a criminal offense.  No, really:

KING: A lot of Democrats in Congress want to you investigate [Joe Arpaio]. They think he is over the line. He says he is just enforcing the law and the problem is the federal government.

NAPOLITANO: Well, you know, Sheriff Joe, he is being very political in that statement, because he knows that there aren’t enough law enforcement officers, courtrooms or jail cells in the world to do what he is saying.

What we have to do is target the real evil-doers in this business, the employers who consistently hire illegal labor, the human traffickers who are exploiting human misery.

And yes, when we find illegal workers, yes, appropriate action, some of which is criminal, most of that is civil, because crossing the border is not a crime per se. It is civil. But anyway, going after those as well.

That makes perfect sense, except for a troubling entry in the actual penal code, as Julie Kirchner points out:

8 USC Sec. 1325

(a) Improper time or place; avoidance of examination or inspection; misrepresentation and concealment of facts

Any alien who (1) enters or attempts to enter the United States at any time or place other than as designated by immigration officers, or (2) eludes examination or inspection by immigration officers, or (3) attempts to enter or obtains entry to the United States by a willfully false or misleading representation or the willful concealment of a material fact, shall, for the first commission of any such  offense, be fined under title 18 or imprisoned not more than 6 months, or both, and, for a subsequent commission of any such offense, be fined under title 18, or imprisoned not more than 2 years, or both.

Hint to the DHS Secretary: We don’t toss people in prison for losing civil lawsuits.  The penal code makes illegal immigration a crime, one which Napolitano’s department is supposed to investigate and prosecute.  One might think that a person put in charge of the Department of Homeland Security would have familiarized herself with this particular law after having been in the position for several months.

But of course, Napolitano knows that illegal immigration is a crime.  She and the administration she serves don’t want to enforce that law; they want to pretend it doesn’t exist.  The DHS seems a lot more concerned about the danger of American combat veterans returning home than they do illegal aliens crossing the borders, which speaks volumes about the political bent of the Obama administration.

Why are we so hard on Napolitano? Tim Geithner apparently didn’t know he was supposed to file his taxes until selected to be the Tres Sec either. So let’s give another department head a break. There’s got to be a lot of stress coming up with language to paint, without any specific evidence, anyone who doesn’t like what the government is doing.

Was wondering when someone would mention the truth. I have a bad feeling that our so called TOTUS is going to push Amnesty for Illegal’s. Give her a break; it was a Freudian slip. It happened to me the other day. I was having dinner with my wife and meant to say “Please pass the coffee”, but instead said “you f’n bitch, you ruined my life”. She was angry at first, but I explained that what I really meant was “pass the coffee”, and everything was all right after that.

In the same vein, it won’t be long until J-No comes out and says she meant to say it was a crime, and history will be re-written.

Seattle PD accidently arrested some innocent illegal aliens. I would expect another apology from the DHS Secretary.

Despite their care, police said three men — whom immigration authorities have since determined to be illegal immigrants — were taken into custody Saturday. They are not suspected of any drug-related crimes and have not been charged. Brown said the arrests were made in “good faith.”

Ordinarily the three would have been released back into the community, but because of their immigration status they were remanded to ICE’s custody and are being held at the Northwest Detention Center in Tacoma, pending deportation.

You’d think that the current unemployment crisis would make the federal government more strident against illegal immigration, not less. Especially not to this degree less.

After all, we have about 6 million American citizens unemployed right now. Yet the number of illegals who hold jobs in the US is over 7 million.

She served as legal adviser to Anita Hill and was directly involved with her entirely unsubstantiated claims against one of the best human beings in the world, Supreme Court Justice Clarence Thomas. Roger Clegg commented about this on NRO last year.

Recall that one of the so-called corroborators of Hill’s story — that is, that she had been sexually harassed by her boss, Clarence Thomas— was one Susan Hoerchner. Hoerchner originally testified, however, that she heard Hill’s account of being harassed during a time period that turned out to be before she ever worked for Thomas. So her testimony not only didn’t corroborate Hill, it undermined her. But in the middle of this testimony, Napolitano — who was advising Hill — took Hoerchner off the record, and a few minutes late she came back and testified that she couldn’t remember the timing. I cannot believe that the Attorney General of the United States would make such a statement. After 35 years in law enforcement, I know that when speaking of the law there is no “per se”. After 35 days in law enforcement you know that. The law is the law, black and white, no if, ands buts or per se’s, she just does not want to enforce that law.

I have to say that I would support amnesty so long as each recipient paid a fine and that money was used to beef up border security to prevent further incursions.

These people are here, they aren’t going to leave, law enforcement won’t deport them, and they aren’t paying taxes (except in states like TX and FL that have sales taxes instead of income taxes). We’ve all complained about how unfair it is that we have to pay for their medical care, in-state tuitions, social security, etc. Let’s document them and put them on equal ground with the rest of us. “Hey, you’re a citizen now? No more free ride bucko!”

The end result of the initiative will the division of the US into gang zones, with an individual gang having exclusive rights to conduct gang-related activities without fear of transgressing on another gang’s turf.

The White House spokesman, Gibbs, said the POTUS is excited about the future prospects of reduced gang vs. gang violence now plaguing the country.

“Officially recognizing and assigning specific geographic areas, like a franchise, to gangs that participate in the plan”, said Obama, “is long overdue. It is important to note that this initiative is budget-neutral, in that the administrative costs to the Treasury will be offset by the fixed annual fees the gangs will pay, in addition to a percentage of their revenue”.

Shouldn’t they be demanding her to be fired in Congress and to every newspaper/TV station they can find?

Good grief, what’s the GOP doing these days? How hard is it to find a media outlet and call for action- especially when they can sweeten the message with the effect illegals have on US workers?

I’m not sure about how litigation is handled in Japan, but I know in England the loser in a lawsuit pays all court fees. Every time I hear about England’s health care system they always neglect to include the legal system. It nearly eliminates frivolous lawsuits…a person isn’t going to sue unless s/he feels there is a good chance of winning, and a lawyer isn’t going to take a case unless it has merit for fear of working for free.

This is the same Janet Napolitano who issued the “report” that criminalized conservatism.

As near as I can tell, this administration has its own set of laws written down somewhere. And they’re only going to announce them to the public on a need-to-know basis.

In a Socialist Utopia, any law which gets in the way is to be disregarded.

The Soviet Constitution was similar, in many ways, to ours … but words mean nothing, as we are finding out with our own Supreme Court and Congress, when it gets in the way of State control.

Napolitano is no different. The administration doesn’t care about illegal immigration; therefore, any applicable laws are simply disregarded.

The road to Utopia is long and difficult. Trust the State. The State knows what it is doing, and what is best for us.

Thats the first time I believe that you stated anything specifically, but you didn’t necessarily agree you would sacrifice your suburb for the sake of water boarding. For your information illegals worldside are prosecuted for illegally entering their nations. Look what happen to the North Koreans who entered China illegally. Right, the Obama administration and the Democratic congress are completely committed to stopping employers from hiring illegal aliens. That’s why they want to kill E-Verify, and that’s why they removed from the stimulus (and other recently-passed laws) all the provisions that would have required employers receiving federal money to use E-Verify.

That’s how they’re “targeting” employers who hire illegal aliens: by making damn sure they can keep doing it.
