Harman caught on wiretap bargaining for intervention in espionage case

CQ Politics quotes two formal national-security officials in reporting that Jane Harman cut a deal with the American Israeli Public Affairs Committee (AIPAC) to get two of its officials off the hook on espionage charges in exchange for lobbying help with Nancy Pelosi to get Harman the chair of the House Intelligence Committee. If true, the wiretap transcript could provide an explicit quid pro quo that could result in obstruction of justice charges and an ethics probe that could allow Pelosi to expel her California rival from Congress:
Rep. Jane Harman , the California Democrat with a longtime involvement in intelligence issues, was overheard on an NSA wiretap telling a suspected Israeli agent that she would lobby the Justice Department to reduce espionage-related charges against two officials of the American Israeli Public Affairs Committee, the most powerful pro-Israel organization in Washington.
Harman was recorded saying she would “waddle into” the AIPAC case “if you think it’ll make a difference,” according to two former senior national security officials familiar with the NSA transcript.
In exchange for Harman’s help, the sources said, the suspected Israeli agent pledged to help lobby Nancy Pelosi , D-Calif., then-House minority leader, to appoint Harman chair of the Intelligence Committee after the 2006 elections, which the Democrats were heavily favored to win.
Seemingly wary of what she had just agreed to, according to an official who read the NSA transcript, Harman hung up after saying, “This conversation doesn’t exist.”
Harmon hotly denies the story; her spokesperson calls it a regurgitation of previous rumors over her ties to AIPAC:
“These claims are an outrageous and recycled canard, and have no basis in fact,” Harman said in a prepared statement. “I never engaged in any such activity. Those who are peddling these false accusations should be ashamed of themselves.”
For those who may not know the background, Harman had been the ranking member on the House Intelligence Committee when the Republicans had the majority. When the Democrats succeeded to power after the 2006 midterm elections, Harman expected to automatically get the chair, as tradition would dictate. However, Pelosi wanted to pay back Harman for her support on the Iraq war and especially on Harman’s support for the Bush administration’s surveillance programs — a nifty little bit of historical irony. Initially, Pelosi picked the impeached federal judge turned Congressman Alcee Hastings for the chair, but after an eruption of outrage over that selection, settled for Silvestre Reyes, who has held the position ever since.
This mess doesn’t end with Harman, either. According to CQ Politics, the probe got quashed by none other than Alberto Gonzales while serving as Attorney General. Gonzales, who later had to resign after botching the routine dismissal of political appointments at the DoJ, stopped the probe not because he thought the charges were baseless, but because he thought Harman was too valuable on the committee to put at risk. If true, it means that Gonzales — the man responsible for enforcing American law and a key member of the national-security effort — willingly turned a blind eye to espionage and obstruction of justice in order to protect a corrupt member of Congress.
Specifically, according to CQ-P, Gonzales felt that the administration needed a Democratic voice to support the NSA wiretap program that the New York Times was about to blow open. He got what he wanted. Harman went to bat for the administration, defending the program and pushing back against the outrage voiced by Pelosi, Harry Reid, and a host of Democrats. In the end, Harman was vindicated by the eventual position of Barack Obama on the wiretap program, but too late to gain an appointment with the Obama administration on national-security matters.
Now, the woman who defended the wiretaps may be undone by them. We’ll see how far Pelosi will go to satisfy her grudge against Harman, and whether Eric Holder will do better than Gonzales on this case.

Update II: Jazz Shaw wonders why I’m not mentioning that Israel got caught spying in the US — again. Well, it’s old news; I covered it pretty extensively in 2005-6, when the case came to light. The big breaking news in this story isn’t that Israel got caught spying (by the Bush administration!) in 2005, but that Harman got caught trying to sell her intervention for her personal gain — and that Gonzales apparently helped cover it up. Many of us have been around longer than the Israeli spy story, including the Boss.

If we can’t get a politician as dirty, despicable, odious, and vile as John Murtha out of office much less charged with anything why do you think this not exploding into a huge scandal is indicative of the Joos running the world?
No way Holder does a thing and Nancy is a viper she’ll just let this eat away at Harman’s credibility but won’t launch an investigation. Wildcard: Obama really does dislike Israel and specifically makes this an issue so he can use it to twist Israel’s arm in the “peace process.” Which will most certainly raise his star on the international stage, which is all that matters. Dang, if that actually happened! Jewish conservatives can look at their liberal counterparts with a big “Thanks stupid!”

Harmon is stuck between a rock and a hard spot. Given all the means that Pelosi has assumed and to date abused, I withhold judgment for now.
Do not conclude a synopsis without noting well the inevitable distraction from ALL that remains hidden behind the covert curtains that hide the dissolution of Constitutional integrity. Pelosi is applying condemnation selectively against opponents, a condemnation judgment derived by illegal sourcing and to be prosecuted by corrupt abusers from the Prosecution.
As per Gonzales, why put the standard on the ground for Holder to “jump” over since any Attorney General would be hard pressed to do a worse job and leave a worse mess. /ouch

I find the timing of this very odd in terms of Durbin2 and Achmeihatejew’s speech today.
Also, if I understand it correctly, the wiretap wasn’t aimed at Harman and it implicates Pelosi as well. However Gonzales is in here too and he will get the blame.
Interesting story. I hope a radio guy or gal covers it because I need this one broken down. It is confusing especially when you recall SanFran Nan in a burqua.

Two guys with AIPAC were charged with spying. Harman said she’d intervene and try to get the charges reduced if these guys would try to lobby Nancy Pelosi to make Harman a committee chair, since Pelosi was unlikely to appoint her because of her conservatism in some issues.
That’s almost certainly illegal (what Harman did, not what Pelosi did), and the Justice Department knew about it, but Alberto Gonzalez stopped the investigation from going further (apparently), because he wanted Harman’s vote on the committee.
This is extremely unethical at best, and almost certainly illegal.

Harman made some equivocal statements about “waddling in, if” she could be helpful in getting an AIPAC espionage investigation dropped or reduced. Her reward was to be a post she never received. Her services to the shadowy figure who proposed the ‘deal’ were apparently never rendered.
Shift to Alberto Gonzalez dropping the investigation. Link to Harman? None alleged.
The evidence comes from NSA wiretaps and it’s not clear if the “Israeli agent” even was/is one. To me it sounds like a political sting operation and fishing expedition designed to suck in any Israeli supporters.
Compare it to politicians going to bat for HAMAS (Muslim Brotherhood). They help Ikhwan (MB)/HAMAS/CAIR (all the same thing) and then the MB front groups (CAIR, MAS, MSAs, ICNA…) filter them millions in campaign case, including Obama and most of the CBC. No consequences for them, ever. Meanwhile there’s the obvious payoff for HAMAS in the form of $900,000,000 and four-year free rides for young jihadis in US universities as soon as Obama takes office.

We’ll see where this goes. I have a feeling that while it is certainly unethical, it probably isn’t illegal in the provable sense. If Harman has to backtrack from her blanket denial (the “background” sources are calling her denial b.s.), she will cave. I think last night Josh Marshall has the best background question, which is “Any particular reason people in the intel community would want to start talking to the press right now?”

Order is everything. If Harmon promised to look into things and the AIPAC guys then promised aid, that’s completely different from Harmon initiating the negotiations and making them an explicit quid pro quo.
If the former, then the AIPAC guys are heavy handed and Harmon is innocent; if the latter, Harmon sold herself.
The politics of the accusers are important as well — if they are pro-Obama pro-Pelosi types, their credibility is immediately suspect. Ditto if they are far to the right of Harmon.
These types of anonymous innuendo need to be backed up by people willing to put their names on the line.
So, my questions:
1. Can we listen to the recording ourselves?
2. If not, is it a true quid pro quo or does AIPAC blindside Harmon with an un-asked-for benefit?
3. If it is the latter in (2) above, whom do we blame for revealing this smear?

#1 should read Warrantless Wiretaps, but other than that, you’re right. It’s unclear whether the wiretaps on Harman were gained by proper procedure or not. If they were properly obtained, then I’m thrilled to see Harman, Gonzales, and AIPAC all go down.

Despite being a Dem, Harmon was somewhat respected by the ‘right wing extremists’ for being at least somewhat sensible about defending America. So this situation will hurt her image with the right, and perhaps force her back into the Pelosi wing of idiocy.
