Auto czar to banks: Lose it all on Chrysler

posted at 12:18 pm on April 17, 2009 by Ed Morrissey

If anyone doubted that the bailouts have turned into nothing more than a big Ponzi scheme, this Washington Post report on the administration’s attempt to strong-arm debt forgiveness for Chrysler should confirm it.  Auto czar Steven Rattner — under investigation for pay-for-play with the New York state pension fund — tried to force banks holding Chrysler paper to simply write it off and allow the automaker off the hook.  Rattner demanded this after pointing out that most of them had already received TARP funding from Treasury:

At a meeting with executives from four of the nation’s largest banks earlier this month, the chief of the government’s auto task force, Steven Rattner, delivered a message that shocked some in the room.

To save Chrysler, he told them, the four banks and several other financial firms would have to surrender their claims to most of the $7 billion the automaker owed them. And what would the banks get in return for this sacrifice? Nothing.

“People’s jaws just dropped,” said a person familiar with the discussions.

The banks — J.P. Morgan Chase, Citigroup, Morgan Stanley and Goldman Sachs — have all since balked at the government’s proposal. This week, they are drafting a counteroffer.

But those four banks are themselves recipients of billions of dollars in government largesse. Collectively, they have received $90 billion from the rescue program for the country’s banks. Now, their critics say, the firms have an obligation to cooperate as the government seeks to save Chrysler.

Let’s try to break down the reasoning on this.  George Bush, Barack Obama, Henry Paulson, and Tim Geithner have all insisted that the TARP funding was necessary to get banks back into the black so that they could prevent a catastrophic collapse in the world’s financial systems.  How, exactly, does forcing the same banks to take billions in losses help them stay solvent?  The fact that Treasury felt it necessary to inject that much liquidity into these banks should behoove them to insist on sound financial decisions, which doesn’t include eliminating several billions of dollars in bonds.

When people talk about the creeping nationalization of banks and financial companies, this is exactly what they mean.  The debt relationship between Chrysler and JP Morgan Chase should remain between those two entities.  The government shouldn’t be picking winners and losers in this arrangement.  Instead, because they gave the banks a huge payoff, they expect the banks to do the same with Chrysler, who will then be expected to dance to the DC piper as well.

It’s a Ponzi scheme, except it really only has one winner: the political class in DC.  They get to make decisions on who gets the money and when, who gets the profit or not, and how businesses will operate.  That is not a private sector; it’s corporatism.

Chrysler sucks anyways – now the Obamatrix wants the banks to be the fallguy?
I thought the TARP money was for Troubled Asset Relief Program? Not Troubled Auto Relief Program?

The banks need to give the Feds back the money and tell Obama to take a walk off a short pier. And the banks need to loan money only to people who will PAY THEM back.

From Goldberg’s Liberal Fascism:

The fascist bargain goes something like this. The state says to the industrialist, “You may stay in business and own your factories. In the spirit of cooperation and unity, we will even guarantee you profits and a lack of serious competition. In exchange, we expect you to agree with—and help implement—our political agenda.

Gee, what a coincidence….

The government shouldn’t be picking winners and losers in this arrangement.

Ed, if Chrysler goes into bankruptcy, a federal judge will pick winners and losers. Of course, to be fair, the judge will be guided by the more structured rules of bankruptcy whereas the “car czar” is just one more Obama crony looking out for Big Labor.

Who do these people think they are? Has logic been tossed out with the bathwater? That would be like asking someone who took out a home equity loan on their house to pay off some bills to give some of that loan to their neighbor so they can pay some of theirs too. Stunning.

scalleywag on April 17, 2009 at 12:54 PM

When all is said and done, ownership is control.

Just to pick a nit: not under fascism. Ownership becomes a euphemism for state control. You can keep that company or business as long as you do what the government suggests, then demands, then orders. The Chrysler bankers are seeing the suggestion right now. It will get worse as they resist.

At least the bankers won’t have to do that silly salute. For now…

No farming-we just ranch.
Basically all pick ups, no matter what make can’t take the punishment we have to put them through.
If I just used to it 4-wheel some & pull a boat or the camper, it’d be ok.
But our pick ups are constantly driving through rough pastures, over washed-out culverts, through river crossings, not to mention on occasion chasing horses/cows, sometimes we have rope sick or out of control cows with the pick-up. There’s been times you have to drag a cow with the pick-up (not often-oh PETA STFU).
We also have put a hydraulic bed on our p/u to feed round bales with. All this is a lot of stress, not to mention pulling loaded stock trailers throughout the year.
We have just never really found a p/u that can take the punishment & survive in decent shape.
But Fords do keep running, & that is sure what I appreciate about them, though they may not run very well.

Badger40 on April 17, 2009 at 1:08 PM

I’m a bankruptcy lawyer, so let me speak from that context. The outrage needs to get dialed down. If Chrysler files an 11, the government can extend postpetition financing to Chrysler (called a dip, or debtor in possession, loan) and can take a super-priority security interest in Chrysler’s assets. So yes, the $7 billion is secured, but the government could force a subordination of a lot of that debt if it can convince a bankruptcy judge in New York or Delaware to let them do it. The government offered them 15% and the liquidation value is 30-50% (probably closer to 30 than 50). The government will bargain up from there.

Bottom line — these negotiations happen in private sector bankruptcies all the time. The only thing that outrages me about this is why the government is pouring money down a rat hole trying to save Chrysler when the private sector is not willing to.

Ya know, if this isn’t fascism, what is? Besides actually implementing this order, of course. Which will probably happen.

Isn’t this just another direct 7 billion to Chrysler? If the Feds are saying “use our 90 billion and eat 7 billion” isn’t it easier to just give the banks 83 billion and Chrysler 7?

This is government moving money from one company to another. It’s classic fascism, since the banks are still in existence, unlike a true communist society.

So again, I reiterate, How is this not fascism?

Congress’s two fleet rule is a major cause of the U.S. auto companies financial problems. Get the government out of the way of business and most of the problem is solved.

Johan Klaus on April 17, 2009 at 1:16 PM

At least the bankers won’t have to do that silly salute. For now…

Man from Texas walks into Bank of America. Gimme some money.
Now what would BofA do? Where would the man from Texas be spending the next twenty odd years? Put an election certification in the pocket of the man from Texas and he gets to walk out of the bank with bags of Ben Franklins.

Not even Hollyweird could write this script, or if they did it wouldn’t find a producer for it.

i hate flip flops. I have no desire to see anyone’s toes. I hate toes. Man do I hate toes.

lorien1973 on April 17, 2009 at 1:12 PM

No fan of Dick Morris either?

Men who wear flip-flops are sexually challenged IMHO.

I’m losing my memory…along with my savings. I’m trying to remember a “K Car.” I kinda-sorta remember a joke about…look at the S car go? Relieve my mental misery…”Badger40.”

JoeySlippers on April 17, 2009 at 1:22 PM

No, that would be the K-Car, Cavalier or Tempo. When people tried to bring those cars to me, I just gave them a sad smile and told them to move on.

Bishop on April 17, 2009 at 12:50 PM

Ahh, the Tempo. We used to have them as city cars back in the day. What a great innovative example of engineering genius.

Definitely.

Face it. Most people’s feet are nasty. Their toe nails are long or they look like crap. Or worse, they have that retarded peticure thing on them. I hate that. It’s so pointless and stupid. Cover up your nasty, stinky feet.

lorien1973 on April 17, 2009 at 1:25 PM

The only thing that concerns me on this.

The union workers are going to get upset, and some may sabatage the vehicles they are making. Chrystler goes under (and we all know this is going to happen) yet people still buy the vehicles until they close.

So…. who do the people, who bought these defunked vehicles, blame when someone dies due to a union auto workers “get back at the system” mode. The Government? NICE!

upinak on April 17, 2009 at 12:38 PM

MORE REASONS NOT TO BUY GM or CHRYSLER….

Ford has come out with 12 month buyer protection.
3 months more than the Obama metromandate of 9 months.
Other auto makers will match the GM offer so why even
consider GM or Chrysler???

Don’t give them the money. If the banks do then that could
be considered money laundering. The Feds are WORSE than
organized crime! At least the mob is organized.

JoeySlippers on April 17, 2009 at 1:22 PM

I certainly can’t help you.
The only weird car I can remember coming out in my lifetime was the Yugo.

Badger40 on April 17, 2009 at 1:28 PM

lorien1973 on April 17, 2009 at 1:25 PM

Ditto. And while everybody’s at it, cover up all the stinky butt-cracks exposed by these damned hip hugging pants.
They make a girl’s but look 10 feet wide and an inch tall.
Disgusting.

Badger40 on April 17, 2009 at 1:29 PM

Lots of people in here about to be reported to DHS. Such a shame.

lorien1973 on April 17, 2009 at 12:33 PM

Well maybe if we’re lucky, the people making those calls to DHS will get the same response that people making calls to report illegal aliens to ICE get: “Sorry, we can’t do anything about it. There’s just too many of them.”

AZCoyote on April 17, 2009 at 1:05 PM

Hah, Hah, the government is lame. Obama and DHS cannot even tie their own shoes. Your safety is up to yourself. If the feds do mange to show up and say “I am from the government and I am here to help” – tell em to take a hike.

Ok guys. I’m confused.
I got mechanics here saying the Tempo is indestructible & that has been my experience with a ’94 & an ’86.
I couldn’t trash those cars & believe me, I tried.

Badger40 on April 17, 2009 at 1:30 PM

BTW-the BEST ranch car I have ever had (3 of them) have been ’90s Cadillacs.
I love them! I used mine to check water, chase stuff in the pasture as well as driving to school every day.
Now I drive an ’89 Honda accord. Runs on a rubber band & foot power.
Has 253,000 miles & it’s a little $hitbox-but it’s like the Energizer bunny!

Badger40 on April 17, 2009 at 1:33 PM

Paging Lee Iacocca: you’re needed to re-rescue Chrysler.

Steve Z on April 17, 2009 at 1:35 PM

You know, “giving” the banks TARP money sounds an awful lot like the “Gift Certificate” in Atlas Shrugged.
