Video: Signing statements, then and now

On the campaign trail, candidate Barack Obama railed against the use of signing statements as an abuse of presidential authority. Obama appears here in May 2008 in Grand Junction, Colorado, answering a question from the crowd about Bush’s signing statements. He goes into Constitutional professor mode, lecturing the crowd on the role of the president regarding legislation, and noting that presidents can either sign legislation or veto bills, but says that attempting to change bills through signing statements is a power grab:

President Barack Obama, on the other hand, has no problem with such “power grabs”, adding a significant one to the omnibus bill:

At the same time, after Democrats criticized former President George W. Bush’s signing statements, Mr. Obama issued one of his own, declaring five provisions in the spending bill to be unconstitutional and nonbinding, including one aimed at preventing punishment of whistleblowers.

Presidents have employed signing statements to reject provisions of a bill without vetoing the entire legislation. Democrats and some Republicans have complained that Mr. Bush abused such statements by declaring that he would ignore congressional intent on more than 1,200 sections of bills, easily a record. Mr. Obama has ordered a review of his predecessor’s signing statements and said he would rein in the practice.

“We’re having a repeat of what Democrats bitterly complained about under President Bush,” said Sen. Arlen Specter (R., Pa.), who drafted legislation to nullify Mr. Bush’s signing statements.

Not only did Obama object to signing statements on the campaign trail, he specifically told the Boston Globe (reported by the Washington Post) that objections on constitutional grounds are particularly inappropriate for signing statements:

“The problem with this administration is that it has attached signing statements to legislation in an effort to change the meaning of the legislation, to avoid enforcing certain provisions of the legislation that the President does not like, and to raise implausible or dubious constitutional objections to the legislation,” Obama answered.

If a President believes a bill to be unconstitional, John McCain argued, he has a duty to veto it. Obama apparently agreed … in 2008. By Obama’s own definition, he’s become power-mad after only seven weeks on the job.

Barack Obama and ‘Profit and Earnings Ratios’
The other day, in talking about the declining stock market, President Obama said: (emphasis added)

“… what you’re now seeing is profit and earning ratios are starting to get to the point where buying stocks is a potentially good deal if you’ve got a long-term perspective on it.”

The problem with this statement is that, up until now, there has never been anything called a ‘profit and earnings ratio.’

The president’s defenders argue that he simply misspoke, and meant to refer to ‘price-to-earnings ratios,’ while Obama’s detractors argue that this statement simply shows the president’s inexperience and lack of knowledge about the stock market.

I think both of the explanations are wrong.

When President Obama spoke of ‘profit and earnings ratios,’ he wasn’t misspeaking and he wasn’t showing his ignorance of the market. Instead, he was inventing a new stock-market measurement, proving to all who will bother to listen that he is a trendsetter and all about ‘change.’

Divide profit by earnings and what do you get? More proof that Barack Obama is the one.

This is much worse than just misspeaking a phrase. It obvious from this video that Ogama doesn’t know that “profits” and “earnings” are the same thing. Even if he meant to “Price-earning ratio,” what he is saying is still nonsense. Based on the catastrophic fourth quarter earnings reports, the P/E is over 40. Precrash the ratio was 25. The historic median 15.

Obama’s signing statement said he wouldn’t be bound by provisions of the bill in five areas. They involved negotiations with foreign governments, limits on using U.S. troops in U.N. missions, protections for government whistleblowers, a congressional claim of authority over the spending of money already approved by Congress and congressional demands that the administration submit budget requests in certain forms.

The last one dealing with the budget is interesting, because I have no idea on what these new rules Congress are demanding. I also have to wonder about the first one, because it is the Presidents job to negotiate with foreign nations, so I wonder what type of power grab Congress tried to do here.

What I would really like to see if someone has read this Pork Spending Feast and found what new rules Congress slipped in that no one knows about.

Anyone who supported Obama, or attempts from this time forward to support Obama, should be required to state, in reasonable terms, why his blatant lying is acceptable to them. Otherwise they should just shut up while the rest of us attempt to save our Republic.

Certain provisions of the bill, in titles I and IV of Division B, title IV of Division E, and title VII of Division H, would unduly interfere with my constitutional authority in the area of foreign affairs by effectively directing the Executive on how to proceed or not proceed in negotiations or discussions with international organizations and foreign governments. I will not treat these provisions as limiting my ability to negotiate and enter into agreements with foreign nations.

This also makes it sound like Queen Pelosi was demanding President Obama include specific things in his budget.

Recommendations Clause Concerns. Several provisions of the Act (including sections 211 and 224(b) of title II of Division I, and section 713 in Division A), effectively purport to require me and other executive officers to submit budget requests to the Congress in particular forms. Because the Constitution gives the President the discretion to recommend only “such Measures as he shall judge necessary and expedient” (Article II, section 3 of the Constitution), the specified officers and I shall treat these directions as precatory.

The real shame about this, with both Bush and Obama, is that their use of the signing statements lets Congress off the hook for consistently writing bad legislation. Courts are clogged with litigation over poorly written laws because Congress punts the hard decisions in favor of nice atmospherics that make good campaign soundbites. I would love it if someday we had a President who was willing to really instruct the country about how bad a job their Congress does. This President had a golden opportunity to do that, with high approval ratings and an obeisant Congress. But once again, he proves how small and unserious he really is, and how much Nancy Pelosi is really in control.
